  • The following agreement (the "Agreement") for dog training services is made andentered into  Pick a Date  by and between Mary Puppins Dog Training LLC ("Trainer") and          ("Client") (collectively referred to as "the Parties") for training services, as fully described herein. This Agreement sets forth the full, written intention of both parties and supersedes all other written and/ or oral agreements between the parties.

  • 1. SCOPE OF TRAINING SERVICES: Trainer’s methodology does not advocate for the use of prong or shock collars, intimidation methods, alpha theory or the use of physical force to correct a dog’s behavior. Instead, Trainer uses force-free, positive reinforcement practices, food luring, body harnesses, double ended leashes, muzzles, shaping exercises and various toys for training wanted behaviors in dogs. Further information as to Trainer’s methodology can be found on Trainer’s website.

    A. Trainer will provide an initial consultation with Client and Client’s dog(s).

    B. The first session will include evaluation/consultation, multiple training games/exercises catered to clients needs, a home management plan and weekly follow ups via text message (unless phone call or email is requested).

    C. Sessions are typically 1-1.5 hours long and can be scheduled as needed for client's goals whether that is weekly, biweekly or monthly. Every dog is different and there is no specific number of sessions set to guarantee results. Client, other household residents and Client's dog should be present for the session. Trainer will follow up weekly in between sessions.  

  • 2. PAYMENT.
    A. Deposit: to reserve and hold a training session for privates or group classes, Client shall pay $20 deposit. This will go towards the remainder of the cost(s) for training sessions and is not an additional expense. Deposit is non refundable. If client needs to reschedule a reservation, they must do so 24hours in advance for deposit to be transferred to new reservation time, otherwise a new deposit shall be requested for further reservations. Boarding clients must pay a deposit of $50 for single boarding nights or $100 for multiple boarding nights. As space is limited and clients may be turned away to save space for your pup, this deposit is non refudable if client cancels within 5 days before your pups reservation.

    B. Prices: for Private Training Sessions Client shall pay an amount of $150 for initial session and $100 per session reoccuring single sessions. Private training packages are 3 sessions for $250 and 5 sessions for $400. There is no frequency restriction for how sessions are scheduled; you can schedule weekly, every few weeks, monthly or as needed. There is a $25 fee for multidog households and clients more than 25 miles from 92105 zip code added to private sessions and packages. For group classes, full payment is due the first day for 3 classes/ $125 or 10 classes $400. Clients can drop in single classes for $50/class. Enrichment MeetUps and Reactivity Workshops also have payment due the day of the event. Walk & Train 30min Visits are $50/ $125 3 pack/ $200 5 pack and Training Field Trip 1hr Visits are $75/ $200 3 pack/ $325 5 pack are due at booking. For Boarding and Board & Train stays Client shall pay $85/night for boarding only, $125/ night board & train. Board & Train packages are $350/ 3 nights, $700/ 5 nights, $1000/ week and $2000/ 2 weeks. DayCare is $40/ half day (3-5hrs) and $70/ full day (6-12hrs). DayCare hours are 7am-7pm; $10 Early Drop Off or Late Pick Up. 

    C. Payment shall be made via Venmo (@marypuppinsdogtraining), PayPal (@MaryPuppinsDogTrain), Zelle (marypuppinsdogtraining@yahoo.com, Stephanie Smith), cash or check, on the day of training. In the event Client fails to pay such amount, Trainer in her sole and absolute discretion, retains the right to cancel this Agreement. Client agrees that in the event Client’s payment is returned to Trainer as the result of in-sufcient funds, or otherwise, Client agrees that in addition to any rightsand remedies Trainer may have under this Agreement, at law, or inequity, Client shall immediately tender to Trainer the payment set forth a twenty five dollar ($25) fee. Client agrees that the payment set forth herein is non-rufundable.

  • 1.    CLIENT RESPONSIBILITIES.  Client acknowledges that the Trainer is only able to teach Client techniques, and that Client itself, has their own responsibilities to implement such techniques.  For these reasons, Client agrees to do the following:
    A.   Prior to Training Session:
    (i)    Client shall have realistic expectations and understand that no training is guaranteed to solve issues instantly.
    (ii)   Client shall provide detailed and truthful information about their dog’s behavior, restrictions and health before training on the client information form.
    (iii) Client shall provide proof of current vaccinations, ensure that their dog is current on their flea preventatives and any other medications. 
    (iv) Client shall ensure that their dog used the bathroom before to avoid taking lengthy potty breaks during the session.


    B.    During the Training Session:
    (i).   Clients to provide their dog’s daily food ration in addition to any treats.
    (ii).    Clients shall provide appropriate collar/harnesses, leash and muzzles if needed for their dog.

    (iii).   It is best if all members of the family are present at the initial training session to ensure consistency and success for the dog. 
    C.   After the Training Session:
    (i)    Client shall apply training exercises and management strategies demonstrated by Trainer. 
    (ii)   Clients should communicate regularly with Trainer to track progress, for additional support and determine if/ what further training is needed. Client can contact Trainer via text/email/phone call to get assistance with training; Trainer will respond within 24 hours. If Client fails to return contact 3 times then Trainer will discontinue check ins and consider Client uninterested in further training.

    D.  For 1 on 1 Training Visits:

    (i) Client shall provide Trainer with a key, gate codes and other appropriate methods for accessing the residence where the dog(s) will be kept.

    (ii) Trainer will meet Client before booking to review where dog supplies are kept and any home protocols requested by Client. There is no charge for this visit and is included in the services.

    (iii) Cient can ask for key to residence back at any time if they wish to discontinue services. 

    (iv) Trainer will send Client visit updates after each visit via text message unless other communication method is requested. 

    E.  For Boarding and DayCare Services:

    (i) Client shall ensure that pup is up to date with vaccinations and free of contagious illness before their reservation begins. Trainer acknowledges that unplanned illnesses can happen, but reserves the right to cancel a reservation for the health and safety of other clients in the facility. 

    (ii) If Trainer has medical concerns about the health and well being of a pup they may call the veterarian on file to discuss the best treatment plan while Client is away.

  • 1.    DATE CHANGES & CANCELLATIONS.  All requests for a scheduling change shall be submitted to Trainer with at least forty-eight (48) hours in advance. Any requests for a change in appointment, are not binding until Client receives notice from Trainer with a new day and time.  In the event Client reschedules with less than forty-eight (48) hours notice, Client shall pay a twenty-five ($25) deposit to hold their new time.  

  • 1.    MEDIA RELEASE.  Trainer may take photos or videos during training sessions for use on Trainer’s promotional materials or as needed in Trainer’s business, which may include, but is not limited to; illustrations,  portfolios, art, promotional materials, advertising, trade, or any other purpose related to Trainer’s business.  In the event neither box is initialed below, Trainer shall be deemed to have Client’s consent.  

  • 1.    WAIVER.  Client agrees that the Trainer’s services are highly subjective in nature.  Client agrees that Trainer makes no representations as to the quality or results of Trainer’s Services or Client’s general satisfaction thereof.  Nothing within this Agreement shall be construed as being conditional upon Client’s satisfaction with the Trainer’s Services. Client hereby waives any cause of action against Trainer including, but not limited to, Client’s satisfaction of Trainer’s Services.

  • 1.    DISPUTE RESOLUTION.  Any controversy or claim arising out of or relating to the terms and conditions of this Agreement, or breach hereof, shall be settled by mediation.   The mediation shall be conducted by a single, licensed mediator in San Diego, County unless the Parties mutually agree otherwise.  If  Trainer is forced to take action to enforce any provision of this Agreement, Trainer shall be entitled to recover reasonable costs and attorneys’ fees in addition to any relief to which it may be otherwise entitled.

  • 1.    MISCELLANEOUS TERMS
    A.   Waiver and Release of Liability; Indemnity.  Client agrees to indemnify, defend, and hold harmless Trainer, from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorneys’ fees and costs) arising either directly or indirectly from or related to any and all claims made by or against  Trainer due to bodily injury, for any loss or damage, and any claim or demands on account of any property damage or any injury to, or the death of, Client, directly or indirectly, whether caused by the negligence, active, gross, or passive, of Trainer.  This provision shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
    B.    Damage and Personal Injury.  Client assumes any and all responsibility and risk for any damages, and injuries to any and all persons or properties that may arise during or after any training sessions or any work completed by Trainer. 
    C.   Assumption of Risk.  Client hereby assumes all risks associated with Trainer’s services and agrees to be responsible for its own personal safety, as well as the safety of others.
    D.   Health & Safety, COVID-19, Other Infectious Diseases.  Client agrees that they will call to reschedule if anyone in their household is positive for Covid-19 or is unwell.  Trainer will work with Client to reschedule or conduct the session virtually. Client agrees to comply with all restrictions and guidelines set forth by the State of California. Client acknowledges that despite the best efforts of Trainer, in-person training carries with it the potential for exposure to infectious diseases and associated illness and death. Client hereby assumes these risks. 
    E.    If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
    This is the entire agreement between Trainer and Client and shall not be modified except in writing, signed by both parties.
