  • This Agreement, dated (see date entered below), by and between the Property Owner named above, and OTFSC, in consideration of public service for the prevention of wildfire to be performed by OTFSC and its contractors, hereby allows OTFSC and its licensed contractors use of the property (described below) under
    ownership/control of said Property Owner.

  • PURPOSE:

    To allow OTFSC and its contractors onto the property as part of a project to create a 28,800 acre shaded fuel break, known as the Pinehurst-Miramonte Ingress-Egress Fuel Break (PMIE) by removing brush, small trees, dead trees, and thinning between trees, leaving larger trees intact within 30ft on either side of roadways.

  • SUBJECT TO:

    • To the extent that they legally can do so, both parties to this agreement agree to hold each other harmless against any and all claims of injury to or death of any person, pet, or livestock, or damage to property arising from the uses herein stated, except where injury or damage is proximately caused by neglect or
    willful acts of a party’s representatives, agents, or employees.

    • Property Owner shall make his/her best efforts to mark any utilities, septic tanks, and water lines located on the premises, as well as any other facilities meriting special protection during this work.

    • Property owner represents and warrants that he/she has full power and authority to fully perform his/her obligations under this Agreement, and that the person(s) executing this Agreement on behalf of the Property Owner are the duly designated agent(s) of the owner and are authorized to do so, and the fee title to the Property vests solely to the owner.

    • Either party shall have the right to terminate this Agreement with 15 days written notice to the other party.
