  • Notice to all Members of the Bendor Village Home Owners Association

    Letting, Marketing, Sales and Transfers of Properties in Bendor Village

    (Extracts from the Company Rules of the Bendor Village Home Owners’ Association NPC)

     
    A. Letting of residential properties in Bendor Village

    To summarise, the main requirements are:

    Copies of ID documents of prospective tenants must be provided to the secretary before finalisation of a lease agreement.

    Prior arrangements must be made for fingerprint access for the tenant with the secretary.

    The lease agreement must be submitted to the secretary of the Home Owners’ Association before tenants are allowed to move in.

    To elaborate, further particulars are:

    Members may only let their properties if they are in full compliance with the rules of the Home Owners’ Association.

    Written confirmation must be obtained from the Home Owners’ Association prior to the finalisation of a lease with a tenant.

    The names and copies of identity documents of tenants must be provided to the secretary (together with contact details and e-mail addresses) with the request for permission to let a property and particulars of the proposed lease.

    The member is held liable for the actions of his tenants and the visitors of his tenants, including contractors, delivery vehicles, domestic workers and gardeners.

    Members letting properties are also obliged to maintain their gardens and swimming pools in a clean, neat and tidy condition at all times.

    Members letting properties must make provision in their rental agreements that the tenant is bound to the rules of the Bendor Village Home Owners’ Association.

    All persons who wish to occupy properties in Bendor Village as tenants of members must also consent to have their criminal records examined and for this purpose, agree to have their fingerprints taken by the Home Owners’ Association.

     
    In view of this rule and the limitation on the number of tenants occupying any property (two persons per bedroom on the approved building plans, with a maximum of eight per property), members are strongly advised to include the following two clauses in rental agreements for properties in Bendor Village as well:

    The lessee agrees and consents thereto that the Bendor Village Home Owners’ Association shall be entitled to examine the criminal record of the lessee and any other adult intending to occupy the property, and for this reason agrees to have his/her (and any other adult intending to occupy the property) fingerprints taken by the Home Owners’ Association or its agents.

    The lessee confirms that the following persons (including all adults and children) will occupy the property during the currency of the lease (and no other persons, without the prior written consent of the lessor):

    B. Marketing of properties in Bendor Village

    Estate agents will not be allowed access unless they have permission from the particular property owner or occupant.

    No advertising boards may be displayed in front of the house that is for sale, anywhere within the boundaries of Bendor Village and not at the entrance to Bendor Village.

    Houses may not be placed on show. Potential buyers wishing to view the property must be accompanied by the estate agent who has the permission of the particular property owner or occupant.

    Where a house is to be sold by public auction, the auctioneers must make arrangements with the secretary at least seven days before the day of the auction.

     

  • Screening of Tenants

    In the interest of the safety and security of all the residents of Bendor Village, the Board of Directors has decided to forthwith introduce stricter control measures before tenants will be permitted to rent property inside Bendor Village.

    This follows upon recent press reports and specifically on an article carried in a leading daily newspaper with the heading “Robber tenants hit ‘secure’ complexes”. The article warns that crime in residential estates in on the increase, especially in Gauteng, where syndicates are moving into complexes as tenants and breaking into houses for months before disappearing with the goods. Nearer home, Ithuba Security has confirmed that, in a security complex elsewhere in Polokwane, suspicion exists that a person residing inside the complex concerned has been responsible for a number of incidents relating to theft.

    For the above reasons, it has been deemed prudent to check on the criminal record of tenants before allowing them to reside in the Village. In future, the following particulars of prospective tenants must therefore be supplied to the Secretary:

    1. Full names of tenant

    2. Present residential address

    3. ID number

    4. Cell number

    Members making use of estate agents should please bring this new regulation to their attention.

  • Refuse Collection

  • Polokwane Municipality collects refuse on Tuesdays, please ensure that items are placed in the wheeliebin only. No refuse bags on the sidewalk allowed.

  • Registrations

    General
  • Pro Satellite (Gerbrandt) is our appointed contractor for registrations. For all registrations, the Secretary must be notified. The Secretary will forward the necessary forms to complete and liaise with Pro Satellite for a date and time of registration. All residents are registered with fingerprint and facial recognition.

     

  • Member's Acceptance of Association Rules and Regulations

  • The Member acknowledges that they have received a copy of the Rules and Regulations (“Rules”) of Bendor Village Home Owners' Association, which are attached hereto and incorporated herein by reference. Members are expected to familiarise themselves with the Rules and to comply with them throughout their membership in the Association.

    The Member further acknowledges that all Rules are also available on the Association’s official website at [https://bendorvillage.co.za/documents/], and confirms that they have been informed of where to access them electronically.

    Failure to adhere to the Rules may result in penalties, and the Member agrees to indemnify and hold harmless the Association from any losses, damages, or liabilities arising from any non-compliance.

  • Renovations // Additions to exterior

  • Should you wish to do any renovations or additions to the external property, plans must be submitted for approval to the Aestheticts Committee. Please contact the Secretary for any inquiries. No construction may extend beyond six months.

    Rule Regarding Sidewalk Deposit

    Rule Regarding Sidewalk Deposit - Part 1:

    If a member is undergoing renovation and does not utilise the sidewalk, an automatic sidewalk deposit of R5000.00 will be levied.

    Rule Regarding Sidewalk Deposit - Part 2:

    Should the member utilise the sidewalk during renovation, the account will be levied at R5000.00 as well.

    Explanation:

    The Board has decided to split the rule regarding sidewalk deposits into two parts to ensure clarity and transparency regarding the use of the sidewalk during renovation activities.

    Part 1 specifies that if a member undergoing renovation does not use the sidewalk, they will be subject to an automatic sidewalk deposit of R5000.00. This deposit will be used for any damages incurred by the sidewalk due to the renovation activities.

    Part 2 states that if the member does utilise the sidewalk during renovation, they will also be subject to a sidewalk deposit of R5000.00. Similarly, this deposit will be utilised for the repair of any damages caused to the sidewalk by the renovation activities.

    These rules aim to ensure that any damages to the sidewalk caused by renovation activities are appropriately addressed and repaired, thereby maintaining the overall integrity and safety of the HOA's sidewalks.
