KITE PROGRESS TARIFA, BOOKING AND PAYMENT POLICY
To ensure quality and efficiency we follow a policy regarding lessons, bookings and payments. This policy helps us to make most of the windy days and therefore to get you up and riding before you know it:
1.Lessons are given in winds from 10 to 35 knots. The instructor is to decide if conditons are suitable.
2.Students must commit to a minimum of 2 hour lesson.
3.All students have to wear helmets during all times they are on the lessons time.
4.To confirm a booking a deposit of 65 euro must be made.
5.Payments for individual lessons are due before the session. Multiple bookings have to be fully paid before the second session.
6.Confirmed bookings that cannot be attended must be cancelled at least two days before the scheduled session. A penalty of 100% of the deposit or full payment will apply for lessons cancelled with less than two days' notice. With notice of more than 2 to 7 days, a refund will be issued via a voucher valid during the current season; more than 7 days, a full refund will be issued. In the event of a lack of wind or waves, or unsuitable or unsafe weather conditions, the amount paid may be used for other activities offered or for products sold in the shop, a voucher will be issued, or the full refund will be issued.
7.Please arrive at the meeting point 15 minutes before the agreed-upon time. KPT and its team reserve the right to schedule flexible times and are not responsible for delays in the start of lessons due to unforeseen technical issues resulting from natural causes. If weather conditions cause a delay in the start of lessons, the program will be postponed hourly or rescheduled depending on possibilities and availability. KPT reserves the right to consider the lesson completed, even in the event of a no-show.
RELEASE OF LIABILITY, WAIVER FORM OF LEGAL RIGHTS AND ASSUMPTION OF RISK
In exchange for using, renting, and/or purchasing kitesurfing, wing foiling, surfing, and other equipment owned by the company during lessons, and/or using the facilities of KPT - KITE PROGRESS TARIFA, I hereby acknowledge and agree that:
1. The practice of surfing activities such as kitesurfing, wing foiling, and surfing can cause accidents and even injuries, and I hereby RELEASE AND RELEASE KITE PROGRESS TARIFA and its officers, directors, elected officials, agents, employees, instructors, and owners of the equipment and land used for the activities described (hereinafter collectively referred to as the "Released Parties") from any liability, claim, demand, or cause of action I may have in the future for injury, disability, death, or damages arising from my participation in the aforementioned activities. including, but not limited to, losses caused by the Released Parties' negligence.
2. I understand and acknowledge that surfing activities present inherent dangers that no amount of care, caution, instruction, or skill can totally eliminate. I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF PERSONAL INJURY OR DEATH INCURRED DURING PARTICIPATION IN KITEBOARDING, WING FOILING, SURFING, AND OTHER RELATED ACTIVITIES, REGARDLESS OF THE RELEASED PARTIES' NEGLIGENCE, and further agree not to sue or assert a claim against the Released Parties for damages or other losses incurred as a result of my participation in such activity. I further agree to indemnify and hold the Released Parties harmless from all claims, judgments, and costs, including attorneys' fees, incurred in connection with any action brought as a result of my participation in such activity.
3. I agree to use the aforementioned kitesurfing equipment in a reasonable and safe manner, in a manner that does not endanger the lives of others or the property of any individual.
4. I have read and understand the above and acknowledge that this constitutes a release of liability and a waiver of my legal rights, as well as an acknowledgment that I assume all risks arising from my participation in kitesurfing, wing-foiling, surfing, and other related activities.
5. I further declare that this release of liability, waiver of legal rights, and assumption of risk will remain in full force and effect as long as I engage in surfing activities in any way connected with the Released Parties.
6. I further declare that I am at least 18 years of age, or that, as a parent or legal guardian, I waive and relinquish any legal rights that may be available to me or my minor child as a result of any injury my son or daughter (minor) may suffer while participating in kitesurfing activities.
7. KITE PROGRESS TARIFA is authorized to use my photos for promotional purposes.
