    • Has the property been condemned by the municipality?
    • IF THE PROPERTY THAT IS BEING REFERRED TO THE VACANT PROPERTY REINVESTMENT BOARD PROGRAM BECOMES OCCUPIED, THEN THE PROPERTY WILL NO LONGER BE CONSIDERED VACANT.  THUS, THE PROPERTY WILL BE REMOVED FROM THE PROGRAM, EFFECTIVE THE DATE THAT THE INITIAL OCCUPANCY TAKES PLACE.

    • Elements of Blight 
    • Actions taken by the Vacant Property Reinvestment Board are based on the determination that blighted conditions exist on the subject property. The following includes a list of conditions that support a legal determination of blight. Please indicate which conditions below apply to the subject property and document this for each category. While it is technically possible to determine blight based on any one of the categories, please document all conditions that apply in any of the categories to the subject property.

    • THE CONDITIONS BELOW MUST BE ADDRESSED AND DOCUMENTED (IF APPLICABLE), FOR THE PROPERTY TO BE CONSIDERED.

       

      “Blighted Property” - Blighted property shall include:

    • Any premises which because of physical condition or use is regarded as a public nuisance at common law or has been declared a public nuisance in accordance with the local housing, building, plumbing, fire and related codes. The referring municipality must formally declare the property as a public nuisance for this element of blight to be cited.
    • Any premises which because of physical condition, use or occupancy is considered an attractive nuisance to children, including but not limited to, abandoned wells, shafts, basements, excavations, and unsafe fences or structures. This may include unauthorized entry because the owner has failed to take reasonable and necessary measures to secure the building or the municipality has secured the building to prevent such hazards after the owner has failed to do so. If the municipality has secured the building, documentation stating such should be included. Photographs of dangerous conditions should be attached.
    • Any dwelling which because it is dilapidated, unsanitary, unsafe, vermin infested or lacking in the facilities and equipment required by the Housing Code of the municipality, has been designated by the department responsible for enforcement of the Code as unfit for human habitation or condemned by the municipality.
    • Any structure which is a fire hazard, or is otherwise dangerous to the safety of persons or property. This element of blight can only be cited if either the property has had a previous fire or if there have been citations for excessive garbage or flammable materials in the building that would increase the risk of fire.
    • Any structure from which the utilities, plumbing, heating, sewage or other facilities have been disconnected, destroyed, removed or rendered ineffective so that the property is unfit for its intended use.
    • Any vacant or unimproved lot or parcel of ground in a predominantly built up neighborhood, which due to neglect or lack of maintenance, has become a place for accumulation of trash and debris, or a haven for rodents or other vermin.
    • Any property which is vacant and tax delinquent for a period of two years.
    • A property which is vacant but not tax delinquent and which has not been rehabilitated within one year of the receipt of notice to rehabilitate from the appropriate enforcement agency.
    • A property shall be considered abandoned under this paragraph if it:

      • Is a vacant or unimproved lot or parcel of ground on which a municipal lien for the cost of demolition of a structure located on the property remains unpaid for a period of six months;
      • Is a vacant property or vacant or unimproved lot or parcel of ground on which the total of municipal liens on the property for tax or other type of claim of the municipality is in excess of 150% of the fair market value of the property as established by the Board of Revisions of Taxes or other body with legal authority to determine the taxable value of the property; or
      • Has been declared abandoned by the owner, including an estate that is in possession of the property.
    • With these considerations in mind, an abandoned property.
    • A property which has defective or unusual conditions of title or no known owners, rendering title unmarketable.
    • A property which has environmentally hazardous conditions, solid waste pollution or contamination in a building or on the land which poses a direct and immediate threat to the health, safety and welfare of the community.

    • We will acknowledge all property referral forms received; however, because of resource restraints, the Vacant Property Reinvestment Board may not be able to pursue every property referral.
