This Rental Agreement (this "Agreement") is made by and between the Facility Owner (hereinafter known as "Owner") and the above-named Renter.
Reservation and Usage of Facility
Reservation of the facility shall be on a first-come, first-serve basis. Usage of the facility shall be for the purpose agreed upon reservation and cannot be used for other purposes. Subleasing shall not be allowed without prior consent of the administrators of the facility.
Reservation Hours
Setup, interior design, vendor drop-offs, and cleanup must take place within the specified rental period.
Booking and Payment and Security Deposit
Fees shall be paid as follows:
Security Deposit: A $150 security deposit is due upon execution of the service agreement. Sponsor shall leave the Facility, including fields and parking lots, in the same condition in which they were found. Sponsor shall ensure that all lights and water faucets are turned off and doors and windows are locked before leaving the Facility. If the Facility is not returned to its original condition, the Location may, at its sole discretion, retain the Security Deposit, and seek additional damages as it deems appropriate. If the Facility is returned in good order, the Security Deposit will be promptly returned.
Balance due is payable 10 days before the event - Please Note: The Security Deposit shall be refunded after the event provided the hall is left in acceptable condition
Rental of facilities and dates is a contractual commitment. The date is not confirmed until the security payment is made.
Event Insurance
Event insurance shall be required by all not for profit rentals. If the sponsoring organization cannot provide a certificate of insurance from their insurance carrier, insurance must be purchased from the Archdiocese of Philadelphia through St. Ignatius. Cost for each event is $145.
Cancellation
If the Sponsor desires to cancel this Agreement, Sponsor shall give notice to the Location at least 14 days prior to the scheduled use. Upon receipt of such notice, the Location will return any monies paid. If Sponsor cancels within 14 days prior to the scheduled use, all fees, except for the Security Deposit will be returned to the Sponsor. The Location may terminate or cancel this Agreement at any time without liability. If the Location deems it necessary to cancel this Agreement, all fees paid shall be returned to Sponsor, and the Sponsor shall have no claim upon the Location.
Decorations
No decorations, temporary fixtures, or any materials or application that may cause irreversible damage may be affixed to the walls of the facility that requires the puncturing of walls such as the use of nails, staples, or tacks.
Food and Alcohol
Alcohol may only be served to persons over the age of 21 under the terms and under the conditions applicable to the laws of the state. Any penalties in violation of the state and federal laws by which may be caused during the event shall solely be the responsibility of the renter.
Refreshments may be provided consisting of packaged snack food, non-alcoholic canned and bottled soda, water and juices, coffee and tea. The presence and consumption of alcoholic beverages shall be only on a BYOB basis and limited to beer and wine and persons 21 and older. In order to be compliant with federal, state and local laws and requirements, other food and alcoholic options must be discussed and approved by LOCATION prior to a signed agreement. Gaming (bingo, games of chance, etc.) also requires discussion and approval prior to a signed agreement as gaming is governed by PA and local law and federal IRS requirements.
Security and Safety:
Sponsor shall make appropriate arrangements to protect the Facility and provide security and safety of persons using the Facility. The Sponsor shall advise the Location of the arrangements made at least one week prior to the scheduled use.
Acknowledgement and Assumption of Risk:
Sponsor acknowledges that in the course of the Event, the Sponsor or its agents or representatives might cause injuries, death, property damage or other harm to third parties. Sponsor accepts and voluntarily incurs all risks of any such injuries, damages, or harm which arise during or result from the Event, except and only to the extent caused by the gross negligence or intentional misconduct of the Location or its members, officers, employees, volunteers, agents, and representatives.
Waiver and Release:
Sponsor waives, releases, and forever discharges all claims against the Location, the Archbishop of Philadelphia, and the Archdiocese of Philadelphia, along with their respective affiliates, successors, and assigns, and their respective members, directors, officers, employees, volunteers, agents, contractors, and representatives (hereinafter collectively "Released Parties") for any injuries, damages, losses, Or claims, whether known or unknown, which arise during or result from the Event, except and only to the extent caused by the gross negligence or intentional misconduct of any of the Released Parties which shall not be imputed to the other Released Parties.
Indemnification and Hold Harmless:
To the fullest extent permitted by law, the Sponsor agrees to defend, indemnify, and hold harmless the Released Parties from and against all losses, costs, obligations, liabilities, damages, actions, suits, muses of action, claims, demands, settlements, judgments, and other expenses, including but not limited to defense costs and reasonable attorneys' fees, relating to, arising out of, or existing under this Agreement, and to the extent caused in whole or in part by any negligent act or omission of the Sponsor or anyone directly or indirectly employed by the Sponsor or anyone for whose acts the Sponsor may be liable, regardless of whether it is caused in part by a party indemnified hereunder except and only to the extent caused by the gross negligence or intentional misconduct of such party which shall not be imputed to the other parties indemnified hereunder.
Use
This Agreement is made solely for the Event set forth in this agreement. Sponsor shall not use the Facility for any other purpose unless the Location expressly agrees in writing. Sponsor may not assign this Agreement. Sponsor shall not permit smoking at the Facility or on the grounds, including the fields and parking lots. Sponsor shall observe all other regulations related to the use of the Facility and shall comply with any Special Provisions identified. Sponsor recognizes the nature of the property as Catholic property and agrees to respect and observe appropriate behavior consistent with such property. Sponsor agrees that the Facility shall not be used for any activities that are contrary to the teachings of the Roman Catholic Church and that conduct during the Event shall be consistent with the values of the Catholic Church. Sponsor shall be responsible for the actions of all organizations and persons allowed access to the Facility by Sponsor, including, but not limited to, all participants, attendees, youth, visitors, and invitees while they are occupying the Facility or grounds. Sponsor shall be responsible for obtaining all permits, licenses and other legally required approvals for the Sponsor’s intended use of the Facility. Sponsor shall be solely responsible for providing supervision and control over the Facility while it is being used by the Sponsor
The Entire Agreement
This Agreement constitutes the terms and conditions agreed upon by the parties and supersedes any and all verbal agreements made in the prior or in the future. Any modifications set forth after the execution of this Agreement must be set forth in writing and signed by both parties hereto.
Governing Law
Sponsor shall comply with all applicable laws and regulations, including local or municipal ordinances and regulations regarding public assemblies and use of the Facility. Sponsor must arrange for security as required by the local Police Department or ordinance.
This agreement shall be governed by rules of the state of Pennsylvania, to the exclusion of other state laws and jurisdictions.
