  • Under the Bush Fires Act 1954 a Fire Permit is required during the Restricted Burning Periods in the Shire of Gingin which occur generally between 1 April - 15 May and 1 October - 30 November Annually. 

    Please complete the following application form to apply for your Fire Permit. Please ensure that your information is true and correct as per the Shire of Gingin's Terms and Conditions. 

    Fire Permits ARE REQUIRED for: 

    • Garden refuse (less than 1 sqm outside stipulated hours)
    • Garden refuse (where burning multiple 1 sqm piles at once or burning piles larger than 1 sqm)
    • Paddock burn
    • Vegetation (bush) burn

    Fire Permits are NOT REQUIRED for:

    • Fire pits (between 6pm and 11pm)
    • Solid fuel barbecues
    • Garden refuse (between 6pm and 11pm, burning just one at a time 1 square meter pile) 

     

    NOTE:

    Fire permits are valid only during the Restricted Burning Period within the Shire of Gingin district and are automatically cancelled in the event of a Fire Ban being declared by the Shire of Gingin or any other relevant authority or in the event where the forecast fire danger rating is High or above as per the Bush Fires Act 1954. 

    Fire Permits are issued subject to the provisions of Section 46 of the Bush Fires Act 1954 and may be revoked or suspended by any of the Shire's Fire Control Officers if, in their opinion the fire (if lit), would become a source of danger. 

    A Fire Control Officer is not compelled to inspect an area to be burnt before issuing a permit to burn. The onus lies on the permit holder not only to comply with the provisions of the Bush Fires Act 1954 but also to ensure there is no danger of the fire escaping. The issue of this permit in no way affects that responsibility. 

    The permit to burn does not allow you to breach the requirements of other legislation such as the Public Health Act 2016 or the Environmental Protection Act 1986. It is an offence to cause a smoke nuisance to persons or to cause pollution with excessive smoke. It is also an offence to burn tyres, plastics, chemicals or similar material which could cause thick or toxic smoke.

  • Conditions which apply when burning garden refuse piles during the Restricted Burning Period:

    • There is no flammable material (other than that being burned) within 3 metres of the fire at any time.
    • The Fire Danger Rating must not exceed 'High'.
    • Your neighbours have been informed that you will be burning material.
    • A hose or spray pack is kept at hand to dampen down fierce fires.
  • Conditions for a paddock or bush burn:

    • Minium of 600L of water available on a vehicle or trailer
    • Fire breaks to be compliant with current order
