    CERTIFICATE OF ADOPTION AND RATIFICATION PREAMBLE

    We the People, of The American First Republic in The United States of America, hereby form the Articles of Confederation Trucking Union and invoke the Divine guidance of our Creator, in order to secure to ourselves and our posterity the rights and benefits of laws set forth herein this constitution to promote the common welfare and to foster continued loyalty and allegiance to The American First Republic in The United States of America, We do establish this Trucking Union within The American First Republic in The United States of America for the original Union of 1776-1781-Present, and hereby ratify this Constitution and By-Laws. ARTICLE I. NAME The name of this Union shall be styled as hereinafter "Articles of Confederation Trucking Union", This Public "Articles of Confederation Trucking Union" shall be within The American First Republic in The United States of America, and it is derived from the authority of people in social compact by and between people as the collective body of people, Therefore, this "Articles of Confederation Trucking Union" shall never hold the People of The American First Republic in The United States of America at peril.

    ARTICLE II. "Articles of Confederation Trucking Union" Assembly is composed of businesses of various types that wish to do business within The American First Republic in The United States

    SECTION A. The "Articles of Confederation Trucking Union" Assembly shall be of four levels: 1. Private Membership Association Membership Any person doing business as a private club, association, foundation or other type of private business: A) All private organizations must have its existence published in the following publication of

  • 2. Corporate Party A) All corporations within The American First Republic in The United States of America shall

    have its existence published in the following publication of record The American First Republic

    Press or another approved publication of record by this assembly majority vote. regardless of

    type. No type shall not break the standing law of The American First Republic in The United

    3. Associate Party A) Open to all foreign businesses registered to do business within The American First Republic

    in The United States of America.

    4. Public Service(s) A) Public Commercial service providers 5. Organization Associate Party A) All other organizations, political in nature or otherwise shall be qualified as organization associate parties which can not hold any other allegiance higher than equal to this one.

    SECTION B. Vacancies and Reinstatement of signatories Assembled in this "Articles of Confederation Trucking Union", A vacancy occurs when a signatory resigns, retires, dies or is removed by and through due process of law within The American First Republic in The United States of America Supreme Court. Reinstatement of signatories Assembled in this "Articles of Confederation Trucking Union" occurs when a signatories Reinstatement has been entered by signatory and approved and acknowledged by this "Articles of Confederation Trucking Union".

    SECTION C. Assembly Powers; The General and Supreme power of "Articles of Confederation Trucking Union" resides in its Assembly, by and through It's office holders. This Assembly reserves the authority to Delegate specific duties and responsibilities to "Articles of Confederation Trucking Union" officers in accordance with this constitution and By-Laws. This "Articles of Confederation Trucking Union" Assembly shall have the following specific powers: To generally carry out the purpose and responsibilities of "Articles of Confederation Trucking Union"; To elect officers and determine their duties; To adopt and amend any and all By-Laws of the "Articles of Confederation Trucking Union"; To authorize the obligation of the "Articles of Confederation Trucking Union" assets and resources; To support or oppose public law as it pertains to or impacts membership; To determine the time and location of the "Articles of Confederation Trucking Union" Annual Convention meetings; and, To constitute committees for such purposes as it deems necessary. This union is perpetual and shall not be dissolved without

    unanimous vote of all office holders.

    SECTION D. Meetings The official meetings for "Articles of Confederation Trucking Union' Assembly shall be, but not limited to; every Wednesday at 8 pm eastern time and the Annual Convention first month seventh day at eight pm eastern time, and the Mid-Year Conference sixth month seventh day at eight pm eastern time on zoom room ID

    time and on-line location designated by "Articles of Confederation Trucking Union". A quorum of the Annual Convention or the Mid-Year Conference shall be at least 25% of the Assembly having met the requirements aforementioned and two or more office holders.

  • 2. All meetings shall be conducted in accordance with this Constitution and By-Laws.

    SECTION E. Office elections; The duly constituted officers of This "Articles of Confederation Trucking Union" shall be a Chairman, a Deputy Chairman, a Secretary, and a Treasurer elected by this assembly once every four years, at onset the aforementioned officers shall be verbally elected by and through majority of people in Bilateral Social Compact Agreement by and between the people of The American First Republic in The United States of America convened. Other officers may be elected or appointed by "Articles of Confederation Trucking Union" as the Assembly deems necessary or desirable when convened, by majority vote of this Assembly. 1. .Nominations for the Chairman, Deputy Chairman, Secretary, and Treasurer shall be made from the floor of the Convention on the first day of the convention. After nominations have concluded, the balloting for these offices shall be entered by all in assembly with equal suffrage through secret ballot. b. Qualifications: (1) to qualify for nomination, 25% or more of this assembly must elect the nominee from within this Union. 2.Election Process: Chairman, Deputy Chairman, Secretary and Treasurer shall be elected by secret ballot of this Assembly and by the majority vote of this assembly who votes within one week beginning the day after nominations conclude. b. Certification Procedures: (1) An Election Committee of four shall be appointed by the Assembly majority vote convened and current office holders, to conduct the elections and certify the election results. Votes, everyone in the Assembly is entitled to one (1) vote. 4. Terms of Office, The regular term of officers shall be four (4) years, from the adjournment of the Annual Convention at which they are elected until the adjournment of the next Annual Convention four (4) years henceforth. No officer may hold the same office continuously for more than twelve (12) years. b. Office holders shall be considered to have submitted their resignation when they no longer hold the aforementioned qualifications, but may continue to serve the remainder of their term with the support of the Assembly. 5. Vacancy(s) In the event of the death, resignation, or loss of ability to perform the essential duties of office with or without reasonable accommodations from Articles of Confederation Trucking Union, a replacement shall be appointed interim for the remainder of the term(s) as follows: (1) This Assembly shall select a

    replacement by majority vote of this Assembly convened after one week notice in The American

    First Republic Press or another approved publication of record by this assembly majority vote.

    (2) Upon the death, resignation, or loss of ability to perform the essential duties of office with or without reasonable accommodations of the Chairman, the office duties shall be completed by the Deputy Chairman until a new Chairman is seated.

    ARTICLE III. Office Holders duties Chairman, Deputy Chairman, Secretary, and Treasurer in "Articles of Confederation Trucking Union" shall hold an Annual Conference meeting within the first quarter of each year in a designated place that is convenient for them to meet with a one

    week notice published in The American First Republic Press or another approved publication of

    record by this assembly majority vote. It shall also meet on such other occasions as it shall be determined necessary by majority vote of this Assembly, or in case of emergency, or at the call

    of the Chairman to address any emergency issues after one day's notice in The American First

    Republic Press or another approved publication of record by this assembly majority vote.

  • SECTION A. Chairman, Deputy Chairman, Secretary, and Treasurer Powers; The control, administration, and execution of this of this "Articles of Confederation Trucking Union" in accordance with this Constitution and By-Laws shall be vested in the aforementioned office holders with authority to Delegate specific duties and responsibilities, provided however, that such acts shall not be in conflict with actions taken by the convened Annual Convention. It shall, without limitation, have the following specific powers: 1. To organize for business 2. regulate its own procedure(s), 3. to engage in reciprical agreement(s) from time to time, 4. to amend By-Laws for administration of affairs of this Trucking Union not inconsistent with this Constitution. 5. To affix transfer fees payable by parties herein, by majority vote of the Assembly. 6. To accept gifts, bequests, and contributions from any sources except known subversive organizations or individuals, all contributions shall be directly deposited within the "Articles of Confederation Trucking Union" Treasury as an asset of "Articles of Confederation Trucking Union ".7. To appropriate, allocate and budget funds to effectuate the purposes of "Articles of Confederation Trucking Union". 8. To adopt and determine upon policies on behalf of "Articles of Confederation Trucking Union", taking fully into account any relevant action of the Annual Convention, provided that no action taken by the office holders shall be in conflict with the terms provided herein. 9. To constitute committees for such purposes as it deems necessary. 10. To affiliate with other Trucking Union(s) and sub-Trucking Union(s) to permit affiliation with this "Articles of Confederation Trucking Union" as will support the purposes of this "Articles of Confederation Trucking Union". In general, to settle affairs between members of "Articles of Confederation Trucking Union" and carry out other purposes of this "Articles of Confederation Trucking Union" as proclaimed by this Constitution and these By-Laws.

    SECTION B. Chairman, Deputy Chairman, Secretary, and Treasurer may act upon any matter brought by any means within their power at any time between Annual Conventions through the following procedures: At the direction of this Assembly or At the direction of the office holder(s); Through a petition stating the issue to be voted upon by this Assembly after one weeks notice in

    The American First Republic Press or another approved publication of record by this assembly

    majority vote. The aforementioned shall take effect immediatley in accordance with the majority vote of the Assembly convened, and vote of this Assembly by email to Chairman and Secretary

    ARTICLE IV. POLITICAL ACTIVITY The "Articles of Confederation Trucking Union" office holders and this Assembly shall engage and lend themselves to political activity.

    SECTION A. No Truck operator, driver or any variation thereof shall be forced to use or association in use of electronic logging or tracking device as a condition of contract, statute, code, law or employment. Truck operator, driver or any variation thereof shall be the only party to enforce any hours of service and shall not suffer peril for enforcing said hours of service. Truck operator, driver or any variation thereof shall be accountable for being under the influence of alcohol and or any controlled substance and or fatigue in any damages as a result of the aforementioned, by a jury of peers in due process of law within this jurisdiction. All parties within this Union are responsible for their own actions, including equipment owners who limit Truck operator, driver or any variation thereof with equipment by electric and or physical governors.

  • ARTICLE V. AMENDMENTS TO CONSTITUTION This Constitution may only be amended by two thirds (2/3) vote of the total registered Assembly majority vote at the Annual Convention. Proposed amendments must be submitted to Chairman, Deputy Chairman, Secretary, and Treasurer not later than three months prior to the Annual Convention. All proposed amendments shall be submitted to this Assembly no later than two months prior to the Annual Convention. Before forwarding, the Chairman, Deputy Chairman, Secretary, and Treasurer; may review proposed amendments and make recommendations to the Assembly regarding whether the amendment is in order and promote the purpose of "Articles of Confederation Trucking Union" to advocate for the interests of all. Consideration of Constitutional amendments shall take priority over any other business during Annual Conventions.

    Article VI. Any officer elected or appointed shall (accept, swear, or affirm) the following Oath of

    1. If an officer elected or appointed choses they may enter with a letter of acceptance only stating they have read, comprehended and agreed to the terms and duties of the office. "I, "Full Name" do solemnly (accept, swear, or affirm) that I will faithfully execute the duties and responsibilities of (office) for "Articles of Confederation Trucking Union" for The American First Republic in The United States of America, and will to the best of my Ability, protect the honor of American First Republic in The United States of America and defend the Articles of Association 1776-1781-Present as amended 03/06/2022. I will defend The American First Republic in The United States of America against all hostile foreign and domestic powers.

    LETTER OF ACCEPTANCE AND ACKNOWLEDGMENT OF OFFICE

    Article VII. Any officer elected or appointed shall enter the following letter of acceptance I, "Full Name" hereby duly claim the office of the "Articles of Confederation Trucking Union" for The American First Republic in The United States of America, and do hereby accept and acknowledge the said position, duties and responsibilities and will faithfully fulfill the aforesaid, I have read and comprehend the oath of aforesaid office and I hereby, agree to the terms and duties of the office while operating the office; on this 4 th month and this 10 th day of the year 2022,"

    CERTIFICATE OF ADOPTION AND RATIFICATION
