英國升學顧問服務條款及細則
（受英格蘭及威爾斯法律管轄）
本《英國升學顧問服務條款及細則》（「本條款」）由 Elite Anglo Chinese Services Limited（「EliteACS」、「本公司」）與學生之家長或法定監護人（「客戶」）訂立。
客戶一經簽署、確認或支付費用，即表示同意受本條款約束。
1. 服務內容
1.1 EliteACS 將向學生提供大學升學顧問及申請輔導服務（「服務」），包括但不限於升學方向建議、申請策略指導、文件準備支援及相關諮詢。
1.2 EliteACS 並不保證任何大學錄取結果、入學機會或最終升學成果。
2. 合約期限
2.1 本合約自雙方簽署或確認之日起生效，並於以下任何一項情況最早發生之日自動終止（以先發生者為準）：
(a) 學生完成中學教育並正式畢業，且已成功申請並入讀大學或基礎課程（Foundation Course）；或
(b) 學生完成中學教育並正式畢業，惟選擇不入讀任何大學或基礎課程；或
(c) 學生或家長以書面形式通知 EliteACS 放棄升學申請或入學安排。
2.2 上述任何情況一經發生，即視為本合約服務期屆滿，EliteACS 將不再負有提供任何升學顧問或相關服務之義務。
2.3 合約期限不因延遲入學、重考、補考、間隔年（Gap Year）或其他非即時升學安排而自動延長，除非 EliteACS 與客戶另行以書面形式明確同意。
3. 費用及付款（不可退款條款）
3.1 所有升學顧問及輔導服務費用須於合約簽署或確認後即時全數繳付。
3.2 在法律允許的最大範圍內，所有已繳付之服務費用概不退款，包括但不限於以下情況：
學生或家長因任何個人原因決定中止或不再使用服務；
學生未能達到預期或理想之升學結果；
學生未能配合顧問所制定之時間表、課程安排或申請建議。
3.3 本條款不影響客戶於英格蘭及威爾斯法律下享有之任何不可排除之法定權利。
4. 資料準確性及披露義務
4.1 學生及家長須確保向 EliteACS 提供之一切資料、文件及陳述均為真實、完整及準確。
4.2 如因提供不實、不完整或具誤導性資料而影響服務提供，EliteACS 有權即時終止服務，且已繳付之費用概不退款。
5. 學生責任及配合義務
5.1 學生須合理配合顧問所制定之會議時間、功課安排、申請準備及相關指示。
5.2 如學生因個人行為、時間管理、態度或其他非 EliteACS 可控制之原因未能達到預期效果，該情況不構成任何退款理由。
6. 不包括之費用
6.1 本服務費用不包括以下任何費用：
大學或教育機構收取之學費或申請費；
考試費用；
政府或官方機構費用；
學生簽證費用及任何簽證申請相關程序。
6.2 如客戶要求 EliteACS 協助提供上述額外服務，EliteACS 有權另行收取合理費用，並會於提供前作出通知。
7. 合理例外及不可抗力
7.1 如 EliteACS 未能以合理技能及謹慎提供服務，客戶可依英格蘭及威爾斯法律尋求適當補救。
7.2 EliteACS 對因不可抗力事件（包括但不限於天災、疫情、政府政策或招生制度變動）所造成之延誤或影響概不承擔責任。
8. 適用法律及司法管轄
8.1 本條款受 英格蘭及威爾斯法律管轄並按其解釋。
8.2 因本條款或服務所引起或相關之一切爭議，均受英格蘭及威爾斯法院之專屬管轄。
University Advisory Services Agreement
(Governed by the Laws of England and Wales)
This Agreement is entered into between Elite Anglo Chinese Services Limited (“EliteACS”) and the parent(s) or legal guardian(s) of the student (“the Client”).
1. Scope of Services
EliteACS shall provide university advisory and application consultancy services to the student. No guarantee is given regarding admission outcomes.
2. Term
2.1 This Agreement shall commence upon acceptance and shall automatically terminate upon the earliest occurrence of any of the following events:
(a) the student has completed and graduated from secondary school and has successfully applied for and entered a university or foundation course; or
(b) the student has completed and graduated from secondary school but elects not to enter any university or foundation course; or
(c) the student or parent notifies EliteACS in writing of a decision to withdraw from or abandon the university or foundation application process.
2.2 Upon the occurrence of any of the above events, the service period shall be deemed completed and EliteACS shall have no further obligation to provide the Services.
2.3 The term shall not be extended by reason of deferred entry, resits, gap years, or alternative arrangements unless expressly agreed in writing by EliteACS.
3. Fees and Payment (Non-Refundable)
All fees are payable in full upon acceptance. To the fullest extent permitted by law, all fees paid are non-refundable, subject to statutory consumer rights.
4. Accuracy of Information
EliteACS reserves the right to terminate the Services immediately where inaccurate or misleading information is provided, with no refund payable.
5. Student Obligations
Failure by the student to comply with agreed schedules or guidance does not entitle the Client to any refund.
6. Excluded Costs
University fees, examination fees, government charges, and visa-related fees are excluded and may be charged separately if assistance is requested.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
