The Agreement
1. Bring My Delivery is a marketing company that facilitates product delivery to consumers. Bring My Delivery will receive orders from consumers and fax, call, or message them to the business with an estimated pick-up time. The business will provide Bring My Delivery, in a timely fashion, the same quality food or product as regularly serves in the restaurant or is regularly provided by the business. Bring My Delivery will arrange and pay for the delivery of the food/product by a contracted, insured, independent delivery driver.
2. The Business agrees to pay a one-time Setup Fee of $99 to cover the cost of menu buildout and for shipping the tablet that is provided by Bring My Delivery for the business to receive its orders. (Note: This tablet is the sole property of Bring My Delivery and must be returned if the subscription is canceled. Failure to return the tablet within 30 days of cancellation or returning a damaged or non-working tablet, will result in the business being charged an additional fee of $99 for the cost of replacing the tablet).
FREE MARKETING:
In exchange for paying this one-time $99 Setup Fee, Bring My Delivery will list the restaurant or business (one time) at no additional cost on its Co-Op Marketing Flyer and distribute that marketing material to 5,000 single-family homes and apartment complex's in your delivery zone. This includes the Design, Print, and Distribution of said Flyer.
3. The restaurant or business partner agrees to pay the weekly subscription cost of $19.99 plus any additional add-on services; like adding a printer for the tablet, or any additional marketing products/services ordered at the discretion of the business. The payments will be initially deducted upon setup and will pay for the next full week of service, and then will be reoccurring every Monday until terminated by either party.
NOTE: Initially the business will be offered a UNIQUE 90-Day Trial for 50% OFF the regular subscription cost. During this 90-Day trial, the weekly subscription cost is ONLY $9.99.
4. This agreement shall be initially for a term of 90 days (the 90-day trial) that 90 days begins from the date first entered below, and then continues on a weekly basis. This agreement shall automatically renew on a weekly basis until terminated in writing by either party.
Note: Cancelation can take up to 7 business days.
5. Bring My Delivery will ONLY pay the printed menu price, if you increase the menu prices, the restaurant or business will need to provide a new printed menu to their dedicated account manager or to Restaurant Support (RestaurantSupport@BringMyDelivery.com).
Any and all discounts or promotions shall be deducted from the restaurant’s or business's regular menu price as printed on the restaurant’s or business's menu.
Special order items not on the restaurant’s or business's regular menu will be quoted by the restaurant or business. It is understood that Bring My Delivery also collects delivery fees and tips on behalf of its affiliated self-employed delivery professionals, these delivery fees and tips belong solely to the self-employed delivery professionals and/or Bring My Delivery. Also, any processing fees or service fees that are collected from its customers, belong solely to Bring My Delivery.
6. Payment to Business for Products or Goods:
For those businesses who are paying the weekly subscription fee: Bring My Delivery agrees to pay the business its FULL MENU PRICE! We DO NOT charge the business ANY Commission. We make DAILY Payouts to all of our Restaurant and Business Partners by ACH. Please See our ACH Payout Schedule Below:
ACH PAYOUT SCHEDULE
You will be emailed or faxed a Daily Sales Report of your daily sales activity. This Daily Sales Report will tell you the amount to expect for your ACH Payout and the date it will be sent to your bank.
- Monday's Orders = Wednesday ACH Payout
- Tuesday's Orders = Thursday ACH Payout
- Wednesday's Orders = Friday ACH Payout
- Thursday's Orders = Monday ACH Payout
- Friday's Order = Tuesday ACH Payout
- Saturday's Orders = Tuesday's ACH Payout
- Sundays Orders = Tuesday's ACH Payout
For those businesses that prefer to pay a commission of 15%, They will receive their payment once a week (Fridays) by ACH. You will be sent an invoice on Mondays for you to review. If you have any questions or errors they must be addressed by Wednesday, if no concerns/questions have been brought up, then all parties agree the invoice is correct and true and the payment will be processed for the amount stated on the invoice.
Notes: If your bank is closed due to a National Holiday your ACH deposit may be delayed until the next business day.
ACH Payout Day is the day your ACH deposit is initiated to your bank. However, your bank may take 2-3 days to complete the deposit.
7. Bring My Delivery will contact the business with any issues regarding product or food quality, incorrect preparation, or timeliness issues. Bring My Delivery will be responsible for any adjustments to the customers due to the driver's mishandling of the food or product, order-taking errors, or timeliness issues that are controllable by Bring My Delivery.
8. The Restaurant or Business agrees that they MUST call our Restaurant Support Line to inform us on the same business day of ANY orders that were not picked up by the customers. In this instance, we will dispatch a Delivery Specialist to pick up the food and donate it to the homeless. As long as the food is picked up by our Delivery Specialist, we will pay the restaurant for making the food.
9. The restaurant or business partner will provide Bring My Delivery with a current menu. Bring My Delivery will ONLY pay the printed menu price, if you increase the menu prices, then the restaurant or business partner will need to provide a new printed menu to their dedicated account manager or to Restaurant Support (RestaurantSupport@BringMyDelivery.com). The restaurant or business partner agrees to notify Bring My Delivery of any menu changes as soon as possible. In the event of a menu price increase, you agree to honor old prices for a period of 48 hours, beginning upon your notification to us, this is to give us sufficient time to update your online menu. Bring My Delivery reserves the right to increase the menu price and service fees to cover their cost of operations, fuel surcharges, and marketing campaigns.
10. Bring My Delivery will carry insurance as required by state law. -- We pay for this Policy by using a portion of the "Service Fee" we charge to the customer with every order.
11. The restaurant or business partner will indemnify Bring My Delivery from any claims, or expenses due to any product defects or mishandling by the restaurant or business, or by any of its employees, of its product.
12. Bring My Delivery publishes a Menu Guide and other advertising materials, both printed and online, on a periodic basis. The restaurant or business partner hereby grants permission for Bring My Delivery, at its sole option, to include the restaurant’s or business partner's menu and logo in said menu guide and any/all other advertising and marketing. The menu guide will reflect prices charged to the customer as indicated in Paragraph Nine.
13. Google Food Ordering (GFO): unless otherwise stated above, you agree that you have the authority to give Bring My Delivery permission to use your logo and Menu Images and Descriptions on our platform, and furthermore you give us permission to extend the right of use of said logo's, menu images, and menu descriptions to Google for the GFO Program. This is offered at NO ADDITIONAL COST TO YOU.
