Backstage Pass Volunteer Waiver & Agreement
By agreeing to become a volunteer, I, the volunteer (or volunteer’s legal guardian), acknowledge that entry into this agreement (“Agreement”) is in consideration of my participation as a volunteer, and confirm my understanding and agreement to the following:
Safety and Conduct
I will comply with The Backstage Foundation's policies, safety rules, conduct expectations, and other directions. I understand that The Backstage Foundation does not tolerate bullying, harassment, threatening behavior, or violence of any kind from its participants and/or their parents, guardians, invitees, or associates. The Backstage Foundation, in its full discretion, reserves the right to terminate my participation as a Backstage Pass Volunteer or as a participant at The Backstage Foundation events or disallow me from representing the Backstage Foundation at events hosted by third parties, immediately upon learning of allegations of bullying, harassment, threatening behaviors, or violence towards any person, whether affiliated with The Backstage Foundation or not. If any legal action is brought against me for any reason or if I am terminated from a dance company/team contract for reasons other than financial, The Backstage Foundation has the right to revoke my participation in any and all current or future programs/events. If I am informed of such revocation, I will refrain from suggesting, stating, or allowing others to believe that I am affiliated with The Backstage Foundation.
This paragraph extends to PARENTS and LEGAL GUARDIANS of volunteers of The Backstage Foundation.
Expectations
Backstage Pass volunteers acknowledge that their conduct reflects on the Backstage Foundation and agree to hold themselves to high moral standards, model good sportsmanship, and adhere to the code of conducts published by their studios and event they are participating in. Volunteers agree to arrive at the scheduled time and agree to stay through the scheduled departure time. Volunteers also agree to use appropriate language, no profanities, dress appropriately for the event, keep all dance movements appropriate for the style of event and age of attendees, refrain from wearing attire with political or profanity statements/images, and to wear The Backstage Foundation volunteer t-shirt if directed. The Backstage Foundation is not liable for lost or stolen items/valuables. Volunteers are solely responsible for any personal items/valuables brought to volunteer events. The Backstage Foundation reserves the right to dismiss a volunteer from any event immediately if expectations are not adhered to.
Volunteer Not an Employee
I understand that I am not an employee of The Backstage Foundation and will not be paid for participation as a volunteer.
Background Check
Required for volunteers ages 16 and over. Background checks are done through local state patrol at no cost to participants. Background checks are only conducted once the applicant has been offered and accepted a position as a volunteer in the Backstage Pass Program.
Assistant Teacher
I understand that as an assistant teacher, I am required to arrive on time and remain for the duration of class. If for any reason I am unable to attend I must notify The Backstage Foundation and the class instructor of my absence at least 24 hrs. in advance. I further understand that this is a volunteer position, and I will not be paid for my participation as a volunteer. I understand that I will need to provide my own transportation to the dance class location. The Backstage Foundation reserves the right to discontinue my assistant teaching volunteer position at any time.
Awareness and Assumption of Risk
I acknowledge that volunteering at The Backstage Foundation has risks. These risks may arise in a variety of ways, including from:
- Lifting heavy objects or other physical exertion
- Working with office equipment
- Working in a theater/on stage
- Exposure to loud noise, bright lights, crowds, weather conditions
- Interacting with or being in the presence of other volunteers, visitors, children, dancers, or others
- Exposure to COVID-19 or other infectious disease
I assume and accept any and all risks of injury, illness, death, and property damage or loss that may arise from my presence at The Backstage Foundation facilities/events or participation as a The Backstage Foundation volunteer.
Waiver and Release of Claims
I waive and release The Backstage Foundation or any of its affiliated organizations, its officers, directors, employees, other volunteers, and facilities/venues from any and all claims and liabilities arising from my participation as a The Backstage Foundation volunteer, including, without limitation, claims in respect of death, illness, or injury to my person or property. I will not sue The Backstage Foundation on the basis of these waived and released claims.
Disclosure of Medical Conditions
I understand that I am solely responsible for knowing my own physical condition and making my own decision about volunteering. I have disclosed all medications and conditions relevant to my participation to The Backstage Foundation team, including, without limitation, chronic conditions such as asthma, allergies, seizures, or diabetes. I understand that The Backstage Foundation needs such information because some medication side effects, or medical conditions could affect my safety or that of others at The Backstage Foundation. I consent to The Backstage Foundation sharing this information with health professionals or first responders should I become ill or injured while participating as a volunteer at The Backstage Foundation's facilities/events.
Medical Care Consent
I authorize The Backstage Foundation to provide me first aid, emergency medical assistance, and transportation. I understand that The Backstage Foundation is not obligated to provide this care. I also understand that I am solely responsible for any costs related to my medical treatment and transport, and that The Backstage Foundation does not provide health, medical, disability, or other insurance coverage for me.
Use by The Backstage Foundation of My Name and Image
I consent to use by The Backstage Foundation of my image, voice, name, and story, and of images of any works I may create as a volunteer, in The Backstage Foundation’s digital and print promotional, fundraising, educational, and other communications. The Backstage Foundation may use them without obtaining my approval or paying me for such use. I waive any legal claims related to such use, including claims relating to copyright or rights of publicity or privacy.
Assignment of Work Product
I grant full rights to The Backstage Foundation in any reports, brochures, website content, photos, images, videos, or other materials or works, I may create, including choreography, in the course of volunteer activities, and any intellectual property rights in or derivatives of such materials.
Confidentiality
I may have access to The Backstage Foundation’s confidential information. I will hold any such information in confidence and not disclose or use it except as The Backstage Foundation expressly authorizes.
Applicable to All Volunteer Work
I understand this Agreement applies throughout the duration of my participation as a Backstage Foundation volunteer, at any and all programs/events.
Volunteer T-Shirt
The Backstage Foundation will provide one (1) t-shirt per volunteer. If the t-shirt is lost, misplaced, or damaged the volunteer is responsible for purchasing a new volunteer t-shirt from The Backstage Foundation. Volunteer agrees to bring their Backstage Foundation t-shirt to all volunteer events.
Backstage Pass Volunteer Program Lanyards
The Backstage Foundation will provide one (1) volunteer lanyard. If the lanyard is lost, misplaced, or damaged the volunteer is responsible for purchasing a new volunteer lanyard from The Backstage Foundation. The volunteer agrees to bring their Backstage Foundation lanyard to all volunteer events.
General Provisions
This Agreement will run in favor of The Backstage Foundation and its board, directors, employees, and other volunteers, and will bind my heirs, next of kin, and legal representatives. If any provision of this Agreement is found to be unenforceable, the other terms will remain effective.
No oral agreements have been made between the parties. The waiver or failure of either party to exercise, in any respect, any right provided in this Agreement shall not be deemed a waiver of any other right or remedy to which the party may be entitled. This Agreement shall be construed and interpreted in accordance with the laws of the State of Washington, without regard to residence of the recipient.
