    *This permit is for burning inside the city limits of BENTON, AR in SALINE County*

  • This permit is issued on the following terms and conditions and for the purposes stated herein:

    1. Piles for Open Burning larger than 10 feet by 10 feet by 5 feet (10' x 10' 5'), or ceremonial fires larger than 5 feet by 5 feet by 5 feet (5' X 5' x 15') will require a permit.
    2. Only natural vegetation shall be burned. The fire shall not contain any lumber, rubber products, asphalt products, petroleum products, plastics, garbage, or any waste material that emits black smoke or creates offensive odors. ONLY YARD WASTE MAY BE BURNED.
    3. Persons and equipment capable of extinguishing the fire shall be on the burn site and in attendance at all times.
    4. A representative of the Fire Marshal's office and the Applicant or his representative must inspect burn site and pile prior to burning.
    5. Location of burn pile(s) shall be determined by a representative of the Fire Marshal's office.
    6. Particulate matter from the outdoor fires must not be allowed to become deposited upon the property of others.
    7. The Applicant assumes liability for any damages caused by this fire.
    8. The Applicant or his representative must notify Benton Communications (776-5958) each day of burning.
    9. The burn pile(s) must be totally extinguished before site abandonment.

    VIOLATION OF ANY OF THESE TERMS OR CONDITIONS MAY RESULT IN REVOCATION OF THIS PERMIT, AND MAY SUBJECT THE APPLICANT TO CITATION AS PRESCRIBED IN ORDINANCE #31 OF 2007.

    * Any permit issued may be revoked for the protection of life or property or to prevent or abate the nuisances caused by such burning. (A nuisance is defined as ash fallout or smoke accumulation in the area of residential occupancies.

    *The Fire Chief, or his representatives, may prohibit any outdoor fires when atmospheric conditions or local circumstances make such fires hazardous.
