SUNRISE STUDIO LLC – LIABILITY WAIVER AND RELEASE OF LIABILITY

ACKNOWLEDGMENT OF RISK

I, the undersigned participant (“Participant”), acknowledge that I am voluntarily participating in physical exercise, fitness instruction, personal training, group classes, and related activities offered by SUNRISE STUDIO LLC (“Studio”).

I understand and agree that these activities may involve strenuous physical exertion and carry inherent risks, including but not limited to injury or death. These risks include, without limitation:

Musculoskeletal injuries (including sprains, strains, fractures, or joint injuries)
Cardiovascular events (including dizziness, fainting, abnormal heart rate, abnormal blood pressure response, heart attack, or stroke)
Respiratory complications
Other physical or psychological injuries
I understand that not all risks can be foreseen, and I voluntarily assume full responsibility for any and all risks associated with participation.

I am encouraged by SUNRISE STUDIO LLC to consult a physician before beginning any exercise program.

ASSUMPTION OF RISK

I voluntarily assume all risks, known and unknown, associated with participation in any class, training, or activity at SUNRISE STUDIO LLC, whether occurring on or off the premises, and I accept full responsibility for any injury, illness, damage, or loss that may result.

RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate, I hereby, for myself, my heirs, executors, administrators, assigns, and personal representatives (collectively, “Releasor”), fully and forever release, waive, discharge, and hold harmless SUNRISE STUDIO LLC, its owners, members, managers, employees, contractors, instructors, agents, volunteers, successors, and affiliates (collectively, “Releasees”) from any and all claims, demands, causes of action, damages, losses, or liability of any kind arising out of or related to my participation in any Studio activity.

This release includes claims arising from negligence, to the fullest extent permitted under Alaska law.

INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, actions, damages, liabilities, costs, or expenses (including attorney fees) arising out of or related to:

My participation in Studio activities
My actions or omissions
Damage caused by me, my family members, or my guests

MEDICAL AUTHORIZATION AND RESPONSIBILITY

I authorize SUNRISE STUDIO LLC to obtain or provide emergency medical treatment if deemed necessary, including but not limited to first aid, CPR, AED use, and emergency transport.

I understand and agree that:

I am solely responsible for all medical costs incurred
SUNRISE STUDIO LLC assumes no responsibility for medical expenses
I am responsible for maintaining my own health insurance

PERSONAL PROPERTY

I understand that SUNRISE STUDIO LLC is not responsible for the loss, theft, or damage of personal belongings brought into the studio.

EQUIPMENT AND FACILITY DAMAGE

I agree to be financially responsible for any damage to Studio equipment, property, or facilities caused by my intentional actions, negligence, or misuse.

NO-SHOW AND CANCELLATION POLICY

I authorize SUNRISE STUDIO LLC to enforce its booking policies, including charging applicable fees.

I understand that:

A $15 + tax no-show fee may be charged to my card on file if I fail to attend a reserved class under eligible membership plans
Class packs or passes may be forfeited if I am marked as a no-show
It is my responsibility to check in upon arrival
I am responsible for reviewing the most current cancellation and no-show policies via the Studio’s website or booking platform

MEDIA RELEASE

I grant SUNRISE STUDIO LLC permission to photograph and/or record me during classes, sessions, or events.

I understand that:

Media may be used for promotional purposes including social media, marketing, and print materials
My name will not be used without my consent
I waive any rights to compensation or ownership of such media
 

SEVERABILITY AND INTERPRETATION

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

This agreement shall be interpreted according to its plain meaning and intent, without ambiguity against any party.

ACKNOWLEDGMENT OF UNDERSTANDING

I acknowledge that:

I have read and fully understand this waiver and release
I am voluntarily signing it
I am at least 18 years of age, or I am a minor with a parent/guardian signing below
I understand that I am giving up substantial legal rights by signing this document
