Equestrian and Equine Liability Waiver
I AGREE in consideration and of my participation in any competition and/or activity held at or relating to this facility and all related business owners/affiliates, to the following:
I AGREE that I choose to participate voluntarily in the competition/activity with my horse, as a rider, handler, lessee, owner, agent, coach, trainer, or as the parent or guardian of a junior/minor. I am fully aware and acknowledge that horse sports and competition inherit dangerous risks of accident, loss and serious bodily injury including broken bones, head injuries, trauma, pain, suffering and/or death ('Harm").
I AGREE to release this facility and all related business owners/affiliates from all claims for money damages or otherwise for any harm to me, my horse or for any harm caused by me or my horse to others, even if the harm resulted directly or indirectly from the negligence of this facility and all related business owners/affiliates.
I AGREE to expressly assume all risks of harm to me or my horse including harm resulting from the negligence of this facility and all related business owners/affiliates.
I AGREE to indemnify (that is, to pay any loss, damage or cost incurred by) this facility and all related business owners/affiliates and to hold them harmless with respect to claims for harm to me or my horse and for claims made by others for any harm caused by me or my horse in any competition and/or activity.
I AGREE that I am entitled to wear protective equipment without penalty and I acknowledge that this facility and all related business owners/affiliates require ASTM/SEI certified helmets to be worn by ALL RIDERS while riding at any time, including on the flat or over fences; warning that no protective equipment can guard against all injury.
I AGREE to be bound by all applicable rules (stated and/or presented to me by this facility and all related business owners/affiliates on paper or in speech at any time) and all terms and prohibitions of this document from this date forward.
WARNING: "Under Florida Law, an equine activity sponsor or equine professional is not responsible for the injury to or death of a participant in equine activities resulting from the inherent risks of equine activities."
By Signing below, I agree to all stipulations within this Liability Release Form which apply to the property owners: Richard and Elizabeth Cefola, Iron Star Equestrian Owner: Sarah MacKusick Mills, and all affiliates, staff members, volunteers, agents and additional family or business members of each, having been referred to as "This Facility and all related business owners/affiliates" throughout.
