  • Liability Release/Indemnification

    For and in consideration of the South Bay Athletic Club its officers, trustees, employees, agents, representatives, and any department, organization or group affiliated there with permitting Participant and/or Legal Guardian access to the Colich Throws and Weightlifting Center training facilities and use of the facilities equipment stated in Exhibit A (attached hereto and incorporated herein by reference and Participant and/or Legal Guardian, his/her spouse, assignees, heir, guardians, and legal representatives hereby voluntary indemnify. release from liability, and agree to defend and hold harmless South Bay Athetic Club, for any accident, injury, illness, death, loss, damage to person or property, or other consequence suffered by Participant and/or Legal Guardian or any other any other person arising or resulting directly from Participant and/or Legal Guardian's access to or use of any of the facilities or equipment identified in Exhibit A (the "Activity"), including but not limited to claims arising from or related to South Bay Athletic Clubs negligence, if any. In the event that Participant and/or Legal Guardian is injured. Participant and/or Legal Guardian agrees to assume any financial obligation either through Participant and/or Legal Guardian's health insurance. or through some other means, for any medical costs or other damages which Participant and/or Legal Guardian incurs.

    South Bay Athletic Club assumes no responsibility for any medical expenses, injury, or damage suffered by Participant and/or Legal Guardian in connection with the use of any South Bay Athletic Club facilities or services in connection with the Activity. Participant and/or Legal Guardian further agrees to conform to all rules and regulations adopted by South Bay Athletic Club relating to the Activity, including without limitation, all then-existing COVID-19 protocols administered by South Bay Athletic Club. IT IS THE INTENTION OF PARTICIPANT AND/OR LEGAL GUARDIAN BY SIGNING

    BELOW TO EXPESSLY ASSUME ALL RISK OF PERSONAL INJURY, ILLNESS. DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OF ANY KIND UPON HIM/HERSELF, TO THE EXCLUSION OF SOUTH BAY ATHLETIC CLUB AND TO EXEMPT AND RELIEVE SOUTH BAY ATHLETIC CLUB FROM LIABILITY FOR PERSONAL INJURY, ILLNESS, DEATH,

    PROPERTY DAMAGE, OR OTHER DAMAGES OF ANY KIND. Participant and/or Legal Guardian further agrees that Participant and/or Legal Guardian, his/her spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue or attach the property of South Bay Athletic Club for any loss or damage resulting from the Participant and/or Legal Guardian's participation in the Activity.

    PARTICIPANT AND/OR LEGAL GUARDIAN UNDERSTANDS THAT HE/SHE SHALL BE

    PERMITTED TO ONLY USE THE EQUIPMENT SPECIFICALLY DESCRIBED IN EXHIBIT A AND REPRESENTS AND WARRANT THAT HE/SHE WILL NOT USE ANY OTHER EQUIPMENT PARTICIPANT AND/OR LEGAL GUARDIAN SHALL BE SOLELY RESPONSIBLE FOR ANY INJURY OR

    DAMAGE SUFFERED AS A RESULT OF PARTICIPANT AND/OR LEGAL GUARDIAN'S BREACHOF THIS WARRANTY.

    For the personal safety of the Participant and/or Legal Guardian, Participant and/or Legal Guardian agrees not to use the facilities without the presence of an approved throws coach. Participant and/or Legal Guardian is aware of the potential dangers incidental to the Activity, that thisis a release of liability, a waiver of the Participant and/or Legal Guardian's legal right to collect damages in the event of injury, death or property damage and a contract between Participant and/or Legal Guardian and South Bay Athletic Club, and Participant and/or Legal Guardian signs it of his/her own free will.



    SBAC Facility Use Rules
    SAFETY & Procedural Policies:
    • A Coach, Official, or other qualified individual – approved by SBAC must be on site during any and all facility use.
    • Throwing events are inherently dangerous due to the nature of the implements used. Constant alertness is required.
    • All officials, coaches, spectators, and athletes must stay aware of activity at the circle or runway at all times.
    • Never cross runways or field areas during warm-ups or competition.
    • Keep your eye on the runway or circle when in or near the sector.
    • Warm-ups should be supervised by an official or coach at all levels of competition.
    • All persons in the field or at the runway/circle must be standing and ready to move in case of an errant throw.
    • Keep at least 10 feet away from the sector lines at all times—more distance is better if possible.
    • In the impact area:
    o Position yourself to the side and slightly in front of the expected landing zone.
    o Do not stand directly behind or too close to implements.
    • For hammer throws, remain at least 10 feet away from the impact point to avoid the wire.
    • Being too close can reduce visibility for spotting landing marks.
    • Account for wind direction and thrower handedness, which can affect trajectory.
    • Avoid crowding in the field. In congested areas:
    o Use horns or noise devices to signal that an implement is about to be thrown.
    o Allow batches of 5–6 throws before closing the ring/runway to retrieve implements.
    • Athletes should not retrieve their own implements unless absolutely necessary and only after halting all throwing.
    • Only field officials should enter the impact area.

    • Never throw implements back—carry or roll them out of the sector.
    • If enough volunteers are present, return implements to the ring/runway manually.
    • Athletes and officials must remain at least 6 feet behind the cage or foul line while waiting to throw.
    • Around the shot put circle:
    o Everyone must face the circle at all times.
    o No area within 20 feet of the circle is considered safe, especially during rotational throws.
    • Warm-ups with implements must be confined to:
    o Inside the cage
    o Inside the circle
    o On the designated runway
    • Cages are mandatory for hammer, discus, and weight throw events.
    • For javelin:
    o Short warm-up throws (10–15 ft) are acceptable only in a designated side area.
    o The best layout is a 20–25 ft controlled warm-up zone.
    o All longer throws must occur only from the runway.
    • Anyone entering the field must face the circle or runway at all times.
    • Do not call up the next thrower until:
    o All individuals are ready.
    o Implements are cleared from the field or jumping areas.
    • Confirm facility safety before allowing an athlete to throw.
    • When using cages:
    o Athletes must be behind the opening and back several feet from the cage.
    o Inspect for holes or weak spots in netting that could allow implements to escape.
    • Stop events immediately if safety is compromised—either in your event or others nearby.
    • Once competition begins:

    o Athletes may not practice or use the circles/runways/sectors—even without implements.
    • After the event:
    o The facilities should be closed and not used for further practice during the meet.

  • I, the undersigned parent and/or legal guardian, affirm that I am freely signing this agreement. I have read this form and fully understand that by signing this form I am giving up legal rights and/or remedies which may otherwise be available to myself, the minor Participant and/or Legal Guardian and Parent or Legal Guardian regarding any losses the Participant and/or Legal Guardian and Parent or Legal Guardian may sustain as a result of participation in the activity. I agree that if any portion is held invalid, the remainder will continue in full legal force and effect.
