• Region 8 Flexiplace Violation and Grievance of the Parties

    Council 222 will be filing a Grievance of the Parties on Denial of Remote Work Requests. We have changed this form, you can now resubmit and include 1) Remote Denial letter from mgmt; 2) A copy of your 21 performance year end review.
  • Apply for remote work if that is the arrangement you were intending to apply for (use online form via Management site). If any employees teleworked previously and had taken the telework training that was required at the time, they do not need to take the new training, even if they do not have the certificate to prove it. They only need to attest that they previously took the training. See Supplement 33 # 19:

    As soon as you are denied remote work, upload your copy of the written denial AND your 21 performance year end review in this form. It must be immediately grieved.

    • If you have received your email notification from Management with a pre-decisional denial of remote work before you applied, you should ignore the pre-decisional denial of remote work.

      If you are offered routine telework, please note that routine telework includes expanded telework which means "you are required to report to an approved HUD office at least twice per pay period." That's up to 4 days a week if your supervisor agrees. Your supervisor cannot make an arbitrary and capricious decision if they disagree. They must put in writing and their reasons why they don't approve 4 days per week telework. Go to Section 2 to read the contract violation.

    • The pre-decisional denial is in Violation of National Supplement 33, Section 3 which states:

      "Employees shall make requests for remote work through their immediate supervisor (or designee or other Management official). Requests made through the EFS shall be directed to the employee's immediate supervisor (or designee or other Managemwnt official). The approving official for remote work arrangements (approval, modification, or termination) is the lowest level Management official designated by the Assistant Secretary (or equivalent) for the program office, following coordination with the program office Funds Control/Budget Officer."
