Loan Acknowledgement of Debt

The debtor warrants that such funds will be used ONLY for the purchase of food, perishables and clothing for Yom Tov or towards an airline ticket to be used for a child attending yeshiva/seminary.
The debtor undertakes to repay the above amount, free of interest in 6 equal monthly instalments, the first repayment is due on the first day of the full calendar month following the loan date.
In the event of any one payment not being made on due date, the full balance then outstanding shall immediately become due, owing and payable.
The debtor confirms that this acknowledgement of debt shall not be construed as a promissory note in terms of Section 87 of the Bills Exchange Act, No 34 of 1964. There shall be no variation or amendment to this Acknowledgment of Debt, unless reduced to writing and signed by the creditor and the debtor.
In the event of any dispute arising from this Acknowledgement of Debt, the debtor hereby consents to the Beth Din of Johannesburg being the sole arbitrator in such dispute and accepts that the Beth Din’s decision shall be final and binding. The aforegoing is without prejudice to the creditor’s rights to enforce compliance with the debtor’s obligation/s to make payment in terms of this acknowledgement of debt in the appropriate Civil Court.
