DLR Foster Agreemt & Waiver

This agreement is made between (owner) Dog Lover Rescue, herein after referred to as "Dog Lover Rescue" and : hereinafter referred to as "Foster." Foster is the primary party responsible for all other parties in the household where the dog, herein after referred to as "Dog," will be cared for. All parties must agree to and abide by these terms and be aware that the sole responsibility falls on Foster.

Foster agrees to the following:

Foster is agreeing to hold, care for and provide all assumed animal welfare duties for dog.*

I AGREE AND ACCEPT

While most dogs are spayed and neutered PRIOR to going into a foster home, should Dog not be fixed, prior to entering Foster Home, Foster agrees to have any unfixed dog spayed or neutered within 30 days of receiving dog, as agreed upon and scheduled by Dog Lover Rescue.*

Foster agrees to begin Heartworm treatment or any other necessary veterinary treatment, as advised by and agreed on, by Dog Lover Rescue.*

I AGREE AND ACCEPT

Under no circumstances, will Foster physically, mentally, or emotionally abuse Dog. This includes, but is not limited to, striking, or any such physical harm by person or object, or the threat of such acts. Foster is responsible to ensure the same conduct for any other human in Dog’s presence or that comes into contact with Dog.*

Foster agrees to actively work with and train dog, to the best of their ability, through positive reinforcement only.*

Foster agrees that Dog will never be chained, tied up or tethered, and left alone for any length of time. Foster also agrees Dog will not be neglected in their care, nor left in a crate, no smaller than double their size, for more than 8 hours at a time.*

Foster agrees that Dog will not be left alone or unsupervised with any minor, or unapproved individual(s), nor alone or unsupervised with other animals .*

Foster assumes all responsibility and costs associated with any illness or injury to Dog due to negligence or lack of supervision.*

Foster agrees to provide adequate food, water, shelter, and humane treatment for Dog at all times. In addition, Foster agrees to adhere to all state and local animal laws.*

I AGREE AND ACCEPT

Foster will accept and consider Dog in their care as a household companion, and will provide a safe and loving environment within the household. This includes, but is not limited to, sleeping indoors, protection from adverse weather conditions, loud noises, persistent stressors, toxic substances, hazardous materials or neglect or any other situation that presents as a danger or threat to Dog. Foster will not allow Dog to roam free, be unsupervised inside or outside, or without sizable physical boundaries, to ensure safety of Dog at all times.*

Should Foster need to leave for any temporary period of time, vacation, emergency, or otherwise leave the dog in someone else's care, Foster remains the responsible party, as stipulated above. Foster is responsible for procuring said accommodations, all costs associated, and any veterinary or emergency care for Dog, should the need arise while Foster is not present. Written approval of said arrangements is required by Dog Lover Rescue. At no time is a minor an approved option for interim responsibility and care of Dog.*

Foster understands, acknowledges, and agrees that Dog Lover Rescue makes no guarantees, representations, warranties, or promises, whatsoever, expressed or implied, known or unknown, written or unwritten, regarding Dog’s disposition, temperament, and/or past, current or future health and personality. The Foster agrees to take Dog, as-is.*

Foster fully understands and agrees that there is a minimum three week, 21 day, decompression period, during which, Dog is to remain in a safe space without any stimuli, such as children, animals, or other situational stressors. Occasionally, there is a longer decompression period needed, which would be discussed and determined by Dog Lover Rescue.

Foster understands and agrees it is not possible to estimate or determine when a forever home will be found for Dog and that the foster period could take weeks or months. Therefore, Foster agrees and is committed to Dog for as long as is necessary. Should Foster become unable or unwilling to care for Dog, Foster will notify Dog Lover Rescue in writing and make every effort to find an agreed upon alternative foster or adoptive home for dog. Foster understands that it is impossible to determine the amount of time it will take to procure a sufficient replacement foster or adopter. Dog Lover Rescue maintains ownership of dog at all times until said new foster or adopter has been secured and approved and formal arrangements for dog have been made through Dog Lover Rescue. At any time during the foster period, Dog Lover Rescue has sole and absolute discretion to recover Dog from Foster.

If, at at any time, Foster feels the need to remove Dog from foster home and has not yet procured another foster or adopter, Foster assumes all costs for any transport, housing or boarding in safe and suitable accommodations for Dog, which must be approved in writing by Dog Lover Rescue. Foster understands moving Dog for any reason, into yet another home or environment, can be detrimental to Dog’s progress and emotional well-being, often creating behavioral issues and an overall decline, making adoption prospects more difficult to secure.*

I AGREE AND ACCEPT

Foster will not permit Dog to become a public nuisance. Foster will keep means of identification on the dog at all times. While most all of the rescue dogs are already microchipped, should Dog not be microchipped prior to Dog coming into their care, Foster will get Dog microchipped within 2 weeks, 14 days, of arrival. Foster will have the microchip registered under Dog Lover Rescue and will send all records to Dog Lover Rescue within 48 hours of microchipping. In the event that Dog becomes lost, Foster will begin an immediate and serious effort to locate and claim Dog, by notifying all local agencies, posting on social media and posting to other public forums and will inform Dog Lover Rescue immediately, as soon as it is determined Dog is missing. Foster will retrieve dog from any pound or shelter immediately after being notified that Dog is being held in their care.*

Foster will not, under any circumstances, give up or sell Dog to any other person(s), relative, friend, shelter, adoption center, rescue group, humane association, or any other individual unless pre-approved and vetted by Dog Lover Rescue. No exchange of Dog is permitted without explicit written permission from Dog Lover Rescue.*

Foster, under no circumstances, will give up or sell Dog to any medical or experimental laboratory, or any organization or group or individual for entertainment or sport.*

I AGREE AND ACCEPT

Foster agrees not to alter in any way, shape or form, the appearance of Dog, without explicit written permission from Dog Lover Rescue. This includes, but is not limited to, declawing, cropping of ears or tails or dyeing dog's hair.*

I AGREE AND ACCEPT

The Foster will permit Dog Lover Rescue to visit Foster and Dog, and agree to virtual meetings to see and confirm Dog’s well-being, at the discretion of Dog Lover Rescue.*

I AGREE AND ACCEPT

Foster understands that during the foster period, Dog Lover Rescue has complete ownership of Dog, and any retrieval of Dog from Foster, is at Dog Lover Rescue’s sole discretion. Should Dog Lover Rescue determine immediate removal of Dog is necessary, any costs associated with safely removing and transporting Dog from Foster’s care, are the responsibility of Foster.*

Foster acknowledges that Dog Lover Rescue has the right to reclaim Dog, at any time, due to the failure of the Foster complying and adhering to the terms of this contract, or for any misrepresentation of fact made on the Foster Application or in this contract. As stipulated above, financial responsibility for Dog Lover Rescue to secure and relocate Dog to alternative, suitable accommodations, fall on Foster.*

The Foster Coordinator will be Foster' source of contact at Dog Lover Rescue, and Foster agrees to communicate to it’s designated Foster Coordinator, or a communicated proxy, in connection with the care and fostering of Dog.*

Foster agrees to confirm and inform of all medical, veterinary, and training appointments for the dog through the Foster Coordinator, and Foster is responsible for the transportation of the dog to and from all such appointments.*

Foster will not under any circumstances breed the dog. Foster will immediately notify Dog Lover Rescue in the event of the dogs injury, illness, or death, during the duration of the foster care period.*

Foster agrees to take on the responsibility of monitoring and maintaining the health and wellbeing of the dog, which includes making Dog Lover Rescue aware of any and all medical and behavioral issues immediately in writing by way of email. Dog Lover Rescue also asks for a text to alert of any urgent issues and concurrent email, to eliminate any potential confusion. Dog Lover Rescue ensures that no concern is too small and appreciates being kept in the loop of even the smallest details. However, due to the overwhelming volume of messaging and calls, DogLover Rescue asks that calls or texts be reserved for emergencies, unless otherwise noted and that all other correspondence be through email. Foster is, at all times, allowed to bring the dog for immediate medical care to the closest emergency hospital, if any medical emergency should arise. Foster agrees, for all non emergency issues, to contact Dog Lover Rescue to determine the best veterinary practice to schedule with. Any fosters within a close distance to VEG on Rt 17, in Paramus, NJ, we strongly recommend their emergency services. Their emergency clinic is open 24/7: Veterinary Emergency Group located at 141 NJ-17, Paramus, NJ 07652.*

I AGREE AND ACCEPT

Should Foster elect to take animal to their preferred Veterinary clinic or hospital, for any non emergency care, and without consulting Dog Lover Rescue first, assumes costs associated with said visit.*

Dog Lover Rescue will share a “Foster Folder,” specifically created for Dog. There will be subfolders, “Records,” “Pix / Vids,” and “Behavioral / Notes” where Foster is asked to upload material and update, accordingly.*

All medical records, emergency and non-emergency, must be uploaded to “Records,” subfolder with 24-48 hrs of appointments.*

Foster is expected to assist in marketing the dog as adoptable and in need of a forever home Through social media, word of mouth, and adoption events. Foster is expected to upload pictures and videos of Dog for promotional purposes, in effort to also find Dog a forever home, to the “Pix / Vids,” folder in their Foster Folder. Foster is asked to routinely update “Behavioral / notes,” folder with any anything worth mentioning that will aid in determining the best home for Dog, as well as, progress of Dog, especially those that are a part of any training.*

I AGREE AND ACCEPT

Foster agrees to make the dog available for adoption events and meet and greets with potential forever homes, as well as attend any trainings, as stipulated by Dog Lover Rescue. Foster is required to attend said events, unless otherwise communicated and agreed upon with Dog Lover Rescue. Foster’s insight and experience with Dog is helpful for new potential forever homes to learn about first hand!*

If Foster decides to permanently adopt the dog in their care, Foster shall notify Dog Lover Rescue and subsequently submit a separate adoption application and agreement. If Foster finds a permanent/adoptive home for Dog, while in their care, they shall notify Dog Lover Rescue, and the adoption procedures will begin with said adopter. No exchange of the dog is permitted without explicit written approval from Dog Lover Rescue.*

Foster agrees to pay Dog Lover Rescue the sum of $1,000.00 as liquidated damages in the event that Foster breaches any of the terms in this agreement. Payment of liquidated damages does not bar Dog Lover Rescue from requiring the return of animal of seeking payment of further damages.*

Should it become necessary to take action to recover Dog or otherwise enforce the provisions of the agreement, the undersigned Foster will be responsible for all costs, including but not limited to, court costs and attorney fees representing either the Foster or Dog Lover Rescue*

Foster acknowledges that due to the unpredictable nature of animals, there are inherent risks and dangers associated with the care and custody of the dog, including but not limited to risk of injury to persons or property. Foster voluntarily agrees to assume full responsibility for all such risks, and waives and releases Dog Lover Rescue, owners, employees, volunteers, and representatives from all claims, losses, liabilities, injury, or damages of any kind or nature arising from or relating to the foster and care of the dog. Including but not limited to claims of bodily injury, property damage sustained by Foster or others. Foster agrees to be solely responsible for any actions of the dog, and agrees to indemnify and hold harmless Dog Lover Rescue, it’s owners, employees, volunteers, and representatives from all liabilities, injury, or losses caused by the dog or any causes of actions, claims, suits, or demands that arise from such injury, damages or losses.*

Foster represents and warrants that all information provided to Dog Lover Rescue and/or memorialized in this contract is correct, complete and accurate.*

This contract constitutes the entire agreement between the Parties,( Foster and Dog Lover Rescue,) concerning the matters covered herein and supersedes all prior agreements and/or understandings, between the Parties, whether written or oral, concerning the matters covered herein; and there are no understandings, agreements, representations, or warrants, expressed or implied, which are not specified in writing and signed by the Parties hereto.*

This contract is valid and binding and shall govern this Dog and all Dogs under the Foster's care on behalf of Dog Lover Rescue.*
