WHOLESALE PARTNER'S CODE OF CONDUCT
The POWER of Elderberries, LLC (hereinafter referred to as “The P.O.E.”) is committed to improving people’s lives. The below Wholesale Partner's Code of Conduct (the “Code”) gives clear information on the standard of behavior that we expect from our Wholesale Partners, as well as the types of unwanted behaviors which will not be tolerated. The Code covers all contact with Wholesale Partners.
When a Wholesale Partner contacts us over the telephone, in person, in writing, by email, or via social media we expect them to:
- Always show respect and courtesy to our employees
- Treat employees as you would like to be treated yourself
- Assist The P.O.E. by providing as much information as possible so that we can make a prompt response or decision
- Allow employees reasonable time to respond to your request
- Answer any appropriate correspondence received from The P.O.E.
The P.O.E. will not tolerate Wholesale Partners:
- Using foul, abusive, or offensive language (for example swearing or remarks that are discriminatory)
- Making threats or unreasonable demands towards other customers or employees
- Engaging in any form of harassment
The P.O.E. Team:
The P.O.E. expects its employees to adhere to this same standard of professional conduct and integrity. All employees should be respectful, courteous, and mindful of others’ feelings and needs. General cooperation between our employees and you, as our Wholesale Partner, is expected. Individuals who act in an unprofessional manner may be subject to disciplinary action.
POLICIES, CONDITIONS & GUARANTEE
The Wholesale Partner is responsible for selling the product(s) within a reasonable time frame to give their patients/clients enough time to consume the product by the best buy date indicated on the products. The P.O.E. is not responsible for replacing any expired products. Furthermore, any expired product must be removed from the wholesale partners' selling inventory by the best-by date indicated on the bottom of the bottle.
It’s the responsibility of the Wholesale Partner to rotate inventory on the shelves to ensure the oldest dated products are sold first.
All Wholesale Partners are required at a minimum, to sell our products at the price indicated under the MSRP column of our Wholesale Partner Pricing Sheet. The P.O.E. reserves the right to amend its Wholesale Partner Pricing Sheet at any time.
Wrapped refrigerators with The POWER of Elderberries® branding are available upon request, subject to availability, and determined by distance from The POWER of Elderberries® facility, and at The POWER of Elderberries® discretion.
Effective November 1st, 2024, refrigerator use, set-up, and delivery will require a non-refundable fee of $199.
If the Wholesale Partner has one of our wrapped refrigerators, it’s the responsibility of the Wholesale Partner to:
1) keep the cooler clean.
2) check the temperature of the fridge to ensure it’s at the necessary temperature of keep the temperature of the refrigerator between 38 to 40 degrees Fahrenheit to maintain the integrity of the Syrup; and
3) make sure no other product brand is displayed in or on our refrigerator. If other products are found in or on top of the refrigerator including marketing material for other products, we will ask for them to be removed. Non-compliance will result in the removal of the refrigerator.
Should the Wholesale Partner no longer sell our products (or does not show the activity of ordering product within a three-month time frame), The P.O.E. has the right to pick up its refrigerator from the Wholesale Partner.
HOW TO ORDER:
To place an order, please go online to our website and log into your respective online wholesale portal account.
Shipments will be sent out Monday through Thursday. Orders placed on Friday through Sunday will be shipped the following Monday. Shipping hours may vary on holidays as outlined below:
The POWER of Elderberries® is exclusively sold and shipped within the contiguous United States.
During non-peak times, orders are shipped within 24-36 hours of receipt. Shipment times vary by destination but start from the time of shipment, not the time of order placed. * Normal shipping hours are M-TH 8:30 am -1 pm EST excluding USPS holidays. Due to unforeseen circumstances, such as weather, insufficient delivery information, strikes, refusal of delivery, etc., the delivery date is not guaranteed. Order tracking and confirmation will be provided to assist in the prompt care of the products.
SALES TAX:
Accounts with a Resale Certificate on file will not be charged sales tax. South Carolina/Horry County/Myrtle Beach Retail Sales Tax (9%) will be charged if no Resale Certificate is on file.
SHIPPING COST:
A calculated shipping cost will be applied along with a $1.5 handling fee. FREE shipping will be offered for orders totaling a minimum of $1700.
DELIVERY INFORMATION:
The POWER of Elderberries® Elderberry Syrup must be refrigerated as soon as possible upon delivery. Order tracking and confirmation will be provided to assist in the prompt care of the products.
No refrigeration is necessary for The P.O.E. Elderberry Syrup Bites.
PAYMENT INFORMATION:
When placing an order, you will be pre-paying via credit card before the order is processed. All credit card processing fees will be waived. Checks are not accepted.
CERTIFICATION:
By submitting this Agreement, I, the undersigned, certify that all information on this Agreement is accurate and true to the best of my knowledge, information, and belief. In addition, the undersigned acknowledges and understands that this Wholesale Agreement is strictly offered to Wholesale Partners that intend to resell The P.O.E. products. The P.O.E. reserves the right to revise and/or terminate this Agreement at any time.
