YALE MODEL UNITED NATIONS KOREA 2022 YALE INTERNATIONAL RELATIONS ASSOCIATION WAIVER AND RELEASE OF LIABILITY

My child,blanks*[Name of Delegate], will participate in the Yale Model United Nations Korea 2022 (the “Program”) from Nov 25th to November 27th, 2022, which is being organized and run by the Yale International Relations Association (“YIRA”), a registered undergraduate student organization of Yale University. This document (“Agreement”) covers all aspects of my child’s participation in the Program. In this Agreement, “Yale” refers to Yale University, its trustees, officers, employees, trainees, appointees, students, volunteers, and agents and YIRA.

1) Release of Liability. By registering for the Yale Model United Nations Korea 2022 conference, the undersigned hereby waives all legal rights to bring a lawsuit against Yale. Waiver of all claims shall include any and all claims for damages for either personal injury or financial losses. No additional rights or claims shall arise from the representations made by any of the administration, Yale students, Yale employees, or their representatives. Students may be expelled from the Program for misconduct whether proven or alleged. No additional claims shall arise if a student is expelled from the Program with or without cause. In order to attend the Program, this waiver must be signed by both parents and the student. Any disputes shall be decided by the Yale Model United Nations Korea Secretariat in accordance with the Terms and Conditions, which is available online on the official website. By attending the Program, both student and parent recognize that no remedies of action exist in either Korean or United States courts against the organizers or sponsors of the Program as these claims are all waived by signing this liability.

2) Program Risks. I understand that participation in the Program involves risks that Yale cannot eliminate, including but not limited to, risk of property damage, illness, accidents from accompanied or unaccompanied domestic or international travel to and from the conference, bodily injury, permanent disability, and other risks or accidents which may occur involving the Program.

3) Assumption of Risk. I voluntarily take personal responsibility for all risks of participating in the Program.

4) Release. In exchange for Yale allowing my child to participate in the Program, I release Yale from all legal and financial responsibility for any harm that I, my child, or our property might suffer as a result of my child’s participation, even if the harm is caused by Yale’s negligence.

5) Use of Personal Information. I understand that my and my child’s personal information submitted for registration will be used only for the purposes of the preparation and execution of the conference, and will be disclosed to Yale and only those third parties that are directly related to the conference and, in the case of the latter, only in cases that are deemed necessary for the successful and safe operation of the conference, including but not limited to event insurance. I grant Yale the right to use my personal information for the aforementioned purposes, and neither I nor anyone else acting on behalf of my child will have any right to make a legal claim as a result of Yale’s use of this information for these specific purposes.

6) Indemnification. I agree to indemnify and hold Yale harmless from (that is to say, I agree to pay or reimburse Yale for) any costs, penalties, legal fees, or judgments (“Costs”) that Yale has to pay related to my child’s participation in the Program, even if the Costs resulted from Yale’s negligence.

7) Governing Law and Jurisdiction. The laws of Connecticut shall govern and the courts of the Connecticut shall interpret this Agreement.

8) Binding Agreement. This Agreement shall legally bind me, my child, family members, spouse, estate, heirs, administrators, or personal representatives.

9) Severability. If a court decides that any part of this Agreement cannot be enforced, I agree to change that part to make it enforceable. If the unenforceable part cannot legally be changed, it will be severed, but the rest of the Agreement will remain in effect.

10) Signature. I agree that I have read and understood this Agreement, I am competent to sign it, and I do so voluntarily and without relying on anything Yale wrote or told me except what is written above. I understand that I am free not to sign this Agreement and not have my child participate in the Program.

In exchange for Yale allowing your child to participate in the Program, you agree to the following: 

1) You grant to Yale the permanent right to use and edit the Images and Recordings in all types of media in connection with the Program and for other purposes that support Yale’s not-for-profit mission. This permission includes use of the Images and Recordings in any new types of media that might be developed in the future.

2) Neither you nor anyone else acting on behalf of your child will have any right to approve or be paid for Yale’s use of the Images and Recordings.

3) Neither you nor anyone else acting on behalf of your child will have any right to make a legal claim as a result of Yale’s use of the Images and Recordings, and any such claim is covered by the “Assumption of Risk, Release from Liability and Indemnification” that you have signed.

4) I acknowledge and fully understand that I am free not to sign this Permission and not participate in the Program.
