I would like to choose the images to be edited. I want you, the photographer, to choose them and I will be surprised. I haven't decided yet, I will let you know at the session.

This is a binding, legal contract between Kati Schwieger Photography, hereafter known as the "Photographer" and the "Clients". Please read this contract thoroughly and completely. The only way to change this contract is to do so in writing and in the presence of both the Photographer and the Clients.

COOPERATION: Each party agrees to cooperate in a cheerful manner and communicate in the best possible way to complete the assignment at hand. If the Clients is more than 15 minutes late to the scheduled session time without proper communication to the Photograher, the Photographer will cancel the session and not issue a refund to the Clients. The Clients will also be rescheduled another session until payment for a new session is paid in full.

IMAGES AND COPYRIGHTS: The copyrights of the photos stays with the Photographer and and are protected by Federal Copyright Law and may not be reproduced in any manner with the Photographer's explicitly written permission. The Clients have limited copyright owernship of the resulting images which may be used only for personal use and may not be copied, or reprinted without express permission of the Photorapher. The Clients must obtain written permission from, the Photographer prior to the Clients, or its friends/relatives publishing or selling the images for profit. The Client agree to NOT crop, alter, edit, or filter the images from the Photographer in any way and understand that this is copyright infrigement.

REPRODUCTION OF POSES: There are many sources for reproduction of poses from places such as Pinterest and the internet. While the Photographer will do her best to reproduce certain poses requested by The Client, it cannot be guaranteed that the reproduced poses will be exact.

PRINTING: The Photographer releases the printing rights to The Client. The Client has the ability to print the images at any photo printing facility of their choosing. The Photographer takes no responsibility for the quality of the images from any photo printing facility besides the photo printing facility The Photographer uses to print images.

MODEL RELEASE. The Clients hereby grant the Photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Clients or in which the Clients may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same; and to copyright the same. The Clients hereby releases the Photographer and its legal representatives and assigns from all claims and liability relating to said photographs.

LIMIT OF LIABILITY: In the unlikely event that the Photographer is injured or becomes too ill, or has an extreme emergency that prevents her from photographing the event, the Photographer will make every effort to reschedule the event. If for whatever reason this is not possible, responsibility and liability is limited to the return of all payments received for the package purchased. The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond The Photographer's control, thePhotographers liability is limited to the return of all payments received for the portrait package.

PAYMENT SCHEDULE & TURN AROUND TIME: 100% of the payment is due one week before the date of the scheduled session date. The payment may be made via PayPal or check or cash. This is a NON-REFUNDABLE payment. In the event of cancellation, the payment paid is non-refundable. It shall be liquidated for damages to the Photographer in the event of a cancelation, or breach of contract by the Clients. The Clients shall also be responsible for payment of any of the Photographer's materials/charges incurred up to time of cancellation. Photos will not be distributed to Clients whom have not paid in full. A $25 return check fee will be applied to any checks returned from the bank. Turnaround time for a portrait session is 3-4 weeks. Photos will be edited, uploaded to the website, katischwiegerphotography.com and the Clients will be messaged or emailed instructions on how to download their digital images. Clients will be presented with 20-25 digital images for a standard portrait session. Clients will also be issued a print release to print their digital images. If for any reason the Clients are unhappy with the images, a request to the Photographer must be made within 5 days of receipt of the download link. If the photos have been downloaded, there will be no refund issued for any reason.

COVID-19 CLAUSE

Once payment is made by the client and received by the photographer, no refunds will be issued back to the client from the photographer due to COVID-19 related situations. The photographer will work with the client to reschedule as many times as needed to accommodate the client.
