Texas State does not have a separate income tax for businesses. But, the State imposes the Franchise Tax on businesses operating in Texas.
Therefore, businesses operating in Texas (LLC as Corporation or S-Corporation and partnerships) can file a tax extension Form 05-164 (Texas Franchise Tax Extension Request) with the state department to request additional 3-months time to file the franchise tax with the state.
Note: The Comptroller’s office will grant an extension of time to file a franchise tax report upon receipt of a timely request. Timely means submitted or postmarked on or before the due date of the original report.
Generally, for an extension to be valid, 100% of your previous year tax or 90% of your current year’s taxes i.e., May 15th.
