Friday Dogz Inc. Release and Waiver of Liability and Assumption of Risk Agreement

Inconsideration for being permitted to skateboard and hang out on and around the Friday Dogz skate ramp and to participate in any other Friday Dogz activities I, the undersigned, acknowledge and agree to the following:

1. Assumption of Risk. I fully understand that participating in Friday Dogz activities ("the Event") may not only involve risk of serious injury or death, economic loss, property damage, or loss that may result from my own actions, inactions, or negligence, but also from the actions, inactions, or negligence of others and/or the condition of the property at 522 West Main Street, and I voluntarily agree to assume this risk.

2. Covenant Not to Sue. I, on behalf of myself and my legal representatives, heirs, successors and next of kin, will not make any claim or bring any proceedings against Friday Dogz, a Colorado non-profit Corporation, or any of its present or former owners, directors, officers, employees, subcontractors, landlords, agents, attorneys, insurers and/or representatives, and their respective successors, heirs and assigns, or any volunteer(s) thereof (collectively, "Released Parties"), for injury, damage, death or any other loss or cost arising from or related to participating in the Event.

3. Waiver, Release, and Indemnification I, on behalf of myself and my legal representatives, heirs, successors and next of kin hereby forever release, waive, discharge, relinquish, indemnify and hold harmless the Released Parties from any and all actions, causes of action, claims, charges, demands, losses, damages, costs, attorney's fees, judgments, liens, indebtedness, and liabilities of every kind and character, whether known or unknown, including foreseen or unforeseen bodily injury and personal injuries, and property damage that may be sustained by me or any other person in any way connected to, related to, or arising out of my participation in the Event, regardless of any negligence of the Released Parties,

4. Good Health. I represent and warrant that am in good health and have no physical condition that would prevent me from participating in the Event. have had the opportunity to seek medical advice for any concerns I may have or had regarding my health.

5. COVID-19 Representation and Waiver. I represent that I:

a. do not currently have and have not had in the last fourteen (14) days: a fever or fever symptoms; a sore throat; a cough; or shortness of breath.

b. have not been in close contact with someone diagnosed with COVID-19 within the last

c. have not tested positive for COVID-19 within the last fourteen (14) days.

By signing below, I acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By attending the Event, I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold the Released Parties liable for any COVID-19-related illness or injury resulting from my attendance at the Event.

6. Photography Waiver: I hereby grant the Released Parties permission to use my likeness in a photograph, video, or other digital media ("photo") in all its publications, including web-based publications, without payment or other consideration I understand and agree that all photos will become the property of the Released Parties and will not be returned I hereby irrevocably authorize the Released Parties to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

 

7. Capacity. I am (a) over the age of 18 and competent to make this release or (b) if under 18 or otherwise not competent to make this release, my parent or legal guardian will also sign below on my behalf.

I have carefully read this Release and Waiver of Liability and Assumption of Risk Agreement (the "Agreement") and fully understand its contents. I am aware that have given up substantial rights by signing the Agreement, and am signing the Agreement voluntarily. I have no obligation to participate in the Event and am not required to sign this Agreement, but hereby desire to do so. have been advised to consult an attorney prior to signing this Agreement if have any questions regarding this Agreement.

This Agreement is as broad and inclusive as is permitted by the laws of the State of Colorado. In the event any provision or term or part of any provision of this Agreement shall be found to be void or unenforceable, the remaining provisions and parts thereof of this Agreement shall nevertheless be binding. enforceable and have the same force and effect as though the void or unenforceable part had been severed

I, the undersigned parent/person having legal custody/guardianship of the aforementioned minor, hereby give permission for the minor to participate in the Firday Dogz activities program which may consist of activities such as skateboarding and outdoor activities I agree that my minor is physically able and mentally prepared to participate in all Friday Dogz activities.

I give permission for the minor to participate in skateboarding the Mini Ramp and all other skate features, as well as other activities conducted by Friday Dogz. These activities are supervised and lead by trained staff. The equipment is inspected before and after each use and the skate features are inspected annually by professional staff. I understand that skateboarding and other outdoor activities are strenuous physical activities presenting the risk of accident, injury, illness, or death. I also understand that no amount of supervision or care can eliminate the possible danger involved

I voluntarily and knowingly assume all risks and dangers inherent and incidental to the activities of Friday Dogz. I will not hold Friday Dogz liable for any injuries incurred during the program, whether caused by equipment or the actsof omission of others, excepting damage or injury solely caused by the willful misconduct or negligence of Friday Dogz or its employees or agents.

I release Friday Dogz, its directors, staff, volunteers, agents, landlords, successors and assigns from all liabilities, claims and causes of action, of any kind or nature whatsoever, whether caused by breach of contract or any other fault, in any way relating to or arising at any time out of my child's participation in any activity of Friday Dogz or useof Friday Dogz equipment or facilities.

I assume liability for, and agree to indemnify, protect and hold harmless Friday Dogz., its directors, staff, volunteers, agents, successors and assigns from and against any and all liabilities, losses, damages, expenses (including reasonable attorney fees), claims, suits and causes of action, of any kind or nature whatsoever, in any way relating to my child's participation in any activities organized by Friday Dogz.

I give permission for photographs or video footage of my child to be used by Friday Dogz for promotional purposes.

If any provision of this agreement, as applied to either party or to any circumstance, shall be adjudged by a courtto be void or unenforceable, the same shall in no way affect any other provision of this agreement or the validity or enforceability to this agreement

I HAVE READ AND UNDERSTAND THIS AGREEMENT I have read the section above and understand the possible risks. I understand that by entering into this agreement I surrender valuable rights. do so freely and voluntarily.
