What Best Describes Your Organization?
STATE or LOCAL GOVERNMENT: if your organization is part of a U.S. state, territorial or local govt such as state agencies, state-owned enterprises, & state legislatures. Common local govt's include counties & local municipalities, such as cities/towns/villages.
SURETIES: Also called a guarantor, promises to assume responsibility for the debt obligation of a borrower if that borrower defaults. Select only if your organization is a surety performing under a takeover agreement entered into with a federal agency pursuant to a performance bond.
INSTITUTION of HIGHER EDUCATION: your organization is an institution of higher education as defined 20 U.S.C. §1001(a).
FEDERALLY RECOGNIZED INDIAN TRIBE: organization is a federally recognized Indian tribe. A federally recognized Indian tribe is an American Indian or Alaska Native tribal entity that is recognized as having a government-to-government relationship with the United States, with the responsibilities, powers, limitations, and obligations attached to that designation, and is eligible for funding & services from the U.S. Bureau of Indian Affairs.
NONE OF THESE APPLY: if none of the other categories apply to your organization.
What Employees Will Your Company Verify?
The federal contractor rule has minimum requirements regarding which employees your organization must verify. The rule also permits your organization to verify additional employees beyond the minimum requirements. As an institution of higher education, a state or local government, a federally recognized Indian tribe or a surety, your organization has three options.
Only employees assigned to a covered Federal Contract: Select this option if your organization intends to verify all of its newly hired and existing employees assigned to a covered contract only.
New-hires & existing employees assigned to federal contract: Select this option if your organization intends to verify all of its newly hired employees throughout the organization and all existing employees assigned to a covered contract.
Entire workforce (all new hires and existing employees throughout company): Select this option if your organization intends to verify its entire workforce, which includes all newly hired and existing employees throughout the organization except for exempt employees. By selecting this option, you are providing notification to the U.S. Department of Homeland Security (DHS) that you have elected to verify your entire workforce. Selecting this option is permanent—you are not permitted to change your decision once your organization begins verifying its existing workforce outside a covered contract.
