Terms and Conditions
Photography/Compositing Contract: Tara Mapes | Enchanted Eye Creations
This agreement is between Tara Mapes (hereafter “Photographer” “the Photographer” or “Photography Company”) and you hereafter referred to as “CLIENT”).
Scope of Work:
This contract is for services and products related to Photoshop digital compositing (hereafter “composite” or “the composite”).
PHOTOGRAPHER agrees to provide ordered and paid in full composites for CLIENT upon payment. Photographer will not begin composite work on photos that are not paid for in advance.
Work Product
PHOTOGRAPHER offers 'digital creations' of photos called composites that include external components such as added elements, backgrounds or other stock photos to create a digital art scene with CLIENT'S photo. CLIENT can request a specific scene or pose, but ultimately PHOTOGRAPHER retains the final decision on how to create and edit the photos to achieve requested composite scene.
Client is providing a photo that he/she is representing to be his/her OWN photo. PHOTOGRAPHER cannot and will not guarantee the quality of the photo in the scene. PHOTOGRAPHER provides feedback on photo, and it is ultimately the Client's decision to use the photo.
Due to the digital nature and time investment in the creation of the composites, NO REFUNDS will be given.
One MINOR revision edit will be offered if client determines a minor imperfection needs touched up, which is common in compositing given the complete free-hand nature of the editing. No revisions for scene changes, pose changes or component changes will be permitted due to time investment in creating the composites. ONE VERSION of the image will be delivered. If client wants variations, upon PHOTOGRAPHERS agreement, additional charges will apply.
PHOTOGRAPHER will deliver an electronic file (via DropBox or Email) of digital photos to CLIENT .
The composite will be delivered in full resolution at 300 PPI at the size of the background chosen.
All photos delivered to CLIENT are licensedfor CLIENT’S personal use only. The image cannot be resold, used in contests or contracts, or redistributed other than shared personally. 48 hours after delivery of the digital file, the client's file will be closed. No additional deliveries, emails or revisions will be provided.
After 30 days, the images may be deleted/archived for storage space demands.
CLIENT understands and agrees that CLIENT is responsible for the quality of the images and photographer cannot guarantee overall quality in digital or print format.
NOTE, due to digital editing imperfections that may be viewable when enlarged, photographer cannot guarantee the absence of editing imperfections in large prints.
4. Duty of Client
CLIENT will obtain all permissions necessary for PHOTOGRAPHER to USE PHOTOS for COMPOSITING. If the photo was taken by another photographer, CLIENT must obtain written permission to use that photo from the original Photographer.
5. PERMISSION
CLIENT understands and agrees that any failure to obtain these permissions or misrepresenting the ownership or permissions of a photo that may result in the CLIENT being unable to use or share photo is not the fault, liability, or responsibility of photographer.
6. Model Release
CLIENT grants permission to PHOTOGRAPHER image on PHOTOGRAPHER’S website or other advertising.
