Cuddle Cat Rescue can make no warranty as to the temperament, physical condition, overall health, or psychological status of the adoptee. The adoptee is being adopted as is at the time of adoption. All warranties with regards to the adoptee, including any implied warranty of merchantability and fitness for a particular purpose, where they are applicable, are hereby specifically disclaimed. The rescue cannot make or offer a guarantee against any unforeseen health defects, hereditary problems, physical abnormalities, or medical illnesses that comprehensive and elective testing may identify if the rescue could afford extensive testing on every cat. However, UPON WRITTEN REQUEST ONLY, the adopter may ask the staff of Cuddle Cat Rescue to schedule a veterinary examination at owner cost prior to bringing the cat home if the adopter wishes to ensure the health of the adoptee before finalizing an adoption with Cuddle Cat Rescue. By not taking the rescue up on this offer for a pre-adoption health screen – the adopter fully understands the implications involved and assumes all responsibility for both the owned cat and any cat, dog, or person that will be sharing the same living space as the cat that is being adopted from Cuddle Cat Rescue.
Adopter hereby releases Cuddle Cat Rescue from any and all liability for personal injury, property damage, legal fees, veterinary care, medical expenses for humans, or any other expense or liability incurred by the adopter as a result of adopting a cat from Cuddle Cat Rescue. Adopter agrees to indemnify Cuddle Cat Rescue from any and all such claims and to pay, without limitation, any costs related to such injury, damage, or liability which can include litigatio and attorney fees that are incurred by Cuddle Cat Rescue. If the adopter chooses to introduce their new cat to their personal pets or to any human residents before a 21-day quarantine, proper introduction, and a thorough veterinary exam then the adopter understands the medical risks for both the owned and new cats associated with failure to quarantine the cat along with a failure to introduce the cat properly to the household. Possible medical conditions include but are not limited to ringworm, feline leukemia, FIV, upper respiratory infection and parasites. Note that Cuddle Cat Rescue does test for feline leukemia but does not test for FIV. Additionally, cats who have tested negative for feline leukemia can possibly change status later in life due to several factors that are beyond the control of the rescue or any licensed veterinarian.
Cuddle Cat Rescue will not and cannot be liable for any damages or costs incurred for treatment of the adopted cat or personal pets after an adoption has taken place for any reason including serious illness and disease. In the event that the adopter does not comply with the terms and conditions, or if the cat is neglected/abused including the rejection of any needed medical care, Cuddle Cat Rescue will hold the exclusive right to recover the cat upon demand. The cat will be surrendered to the rescue immediately upon verbal or written request. In addition, without waiving any of the adopter’s rights under this agreement – if the adopter does not surrender the cat to the rescue within 48 hours of this request, the adopter will owe the rescue a payment in the amount of $2500 plus attorney fees and damages needed to recover the cat. If at any time in the future that the adopter cannot continue to provide proper care or veterinary services for the cat they have adopted from Cuddle Cat Rescue then the adopter will not abandon, give away, transfer, auction, or sell the cat to any organization, individual, or nonprofit. The adopter must obtain written permission from Cuddle Cat Rescue to rehome a cat to another home or living environment. If a cat is rehomed personally after adoption, the person who is receiving the cat must pass the same standards and process that is expected for any applicant that is adopting from the rescue.
Adopter agrees to provide all necessary medical care and behavioral support to the cat in a timely manner in respect to their quality of life. Cuddle Cat Rescue recommends setting up a veterinary client patient relationship within 24 hours of adoption so the veterinarian can examine the cat prior to any emergencies and to examine the cat before being introduced to household residents. This will also help identify any hidden issues if comprehensive testing is recommended based on the examination conducted by the licensed veterinarian. The adopter agrees to keep all vaccinations current and to ensure the cat receives preventative medication on schedule. Any problems, veterinary or otherwise, including serious illness requiring emergency care or surgery is the adopter’s responsibility. Adopter is responsible for all related costs and damages. All cats are given an examination, vaccinations, deworming, flea treatment and medical care while at the rescue by a trained veterinary technician with over 10 years of experience. The adopter is being provided with a healthy cat to the best of the rescue’s knowledge on adoption day. However, veterinary technicians are not qualified to diagnose disease or to prescribe medications so they are unable to perform any diagnostics.
The adopter or adoption applicant understands that Cuddle Cat Rescue has the right to overturn or deny an adoption application for any reason and at any point in the adoption process without warning. Adopter or adoption applicant understands that this application and the contract is the property of Cuddle Cat Rescue who reserves the right to share this information with other agencies and organizations if doing so is deemed appropriate for safety. Cuddle Cat Rescue is not required by any law in the state of Missouri to share the reason for an application denial to the adopter or adoption applicant. If an adopter or applicant wishes to know the reason for an adoption denial, they must request it via legal counsel. If such engagement of legal counsel results in the loss of money or time for the rescue, then the adopter will be responsible for those expenses are deemed just and reasonable in the court of law.
Adopter agrees to make a non-refundable donation to Cuddle Cat Rescue on the day of adoption. The donation helps the rescue cover spay/neuter and age-appropriate vaccinations that is performed by the rescue or will be performed by the rescue. All vaccinations not done at the time of the adoption are considered non-core vaccinations or are vaccinations that are not typically administered at the age of the cat or kitten being adopted out. The donation provided on adoption day is not refundable unless the cat does not work out in the first 14 days of adoption and is returned to the rescue. Any vaccinations following adoption is the responsibility of the owner – including rabies and FVRCP if needed. Feline leukemia vaccinations are not given at the cat rescue due to cost and practicality of the vaccine in a rescue or shelter environment.
For purposes of this any contract or agreement between Cuddle Cat Rescue and anyone who participates at Cuddle Cat Rescue in any capacity including but not limited to volunteer, visitor, adopter, foster — “confidential information” shall mean all information or materials provided to the receiving party by Cuddle Cat Rescue directly or indirectly. Confidential information includes all information about people (e.g., donors, Cuddle Cat Rescue members, and prospective adopters), financial details, proprietary information, treatment protocols, information about the cats at the rescue, and other organizations. This also includes but is not limited only to donor names, contact information, donation amounts, prospective adopter names, contact information, and personal information collected. Confidential Information shall not be reproduced in any form except as required to accomplish the intent of any agreement or contract by an employee or representative of the rescue in good standing. Adopter or an applicant involved in the process of adoption from the rescue shall not, at any time, during or after contact with Cuddle Cat Rescue, divulge or furnish confidential or defamatory information about the rescue. The adopter or adoption applicant shall not furnish or make accessible information regarding adoption policy, the application process, or any other confidential information about improvements, plans, materials, devices, ideas, knowledge, and treatment protocols that are used for cats that are housed at the rescue through the adoption program. Any reproduction of confidential information by authorized representatives of the rescue shall remain the property of Cuddle Cat Rescue and shall contain any and all confidential or proprietary notices or legends which appear on the original, unless otherwise authorized. Discovery of information online or offline, including on social media and other outlets of information, in any form regarding or mentioning Cuddle Cat Rescue will be met with swift legal action if it is determined to be dangerous, malicious, or untrue. If litigation or arbitration is pursued, the adopter will be liable for all court costs and damages if the rescue is successful in proving that the adopter was more than likely involved in defamation, malice, or harassment in their activities by way of sufficient evidence.
Upon verbal or written request by Cuddle Cat Rescue or any staff members who work at Cuddle Cat Rescue, the receiving party shall promptly provide Cuddle Cat Rescue with written certification that the receiving party has taken such action.
Below are a few examples of confidential and proprietary information that should not be shared without express written permission by the rescue.

* Volunteer names and contact information
* Bank account information and balances
* List of Cuddle Cat Rescue logins
* Adoption/foster/volunteer internal business processes
* Medical protocols and Program Of Vet Care documents
If this is an unsterilized kitten then the adopter agrees to have this animal sterilized within one month of adoption or before six months of age depending on the situation. This rule also applies to adult cats that may be fostered out for any reason. Until the procedure is performed and proof of being altered is sent directly to the rescue, this cat is the sole property of Cuddle Cat Rescue. All decisions as to the wellbeing of the cat during this time is also at the discretion of Cuddle Cat Rescue. Adopter agrees to never declaw or allow the declawing of the adopted cat from Cuddle Cat Rescue now or at any time after adoption. Adopter understands that this is a painful and unnecessary mutilation of the cat. This procedure could result in chronic paw and back pain, inability to walk properly, neurological deficits and other physical ailments. Biting, urinating on the floor and aggression may result from declawing if it was badly botched or as the cat ages. Cuddle Cat Rescue will reclaim possession of any declawed cat and the adopter will be obligated to pay Cuddle Cat Rescue $2500 plus the cost of all veterinary work that is needed to restore the cat to normal health. The adopter agrees that they will be included on all no adoption lists for any nearby shelters/rescues.
Zoonotic diseases are those that can be passed from a cat onto humans. Examples include tapeworm, roundworms, ringworm, and rabies. All volunteers and visitors to the rescue are impressed with safe handling techniques which are important elements of protection against disease. It is understood by all volunteers and visitors to the rescue that choose to work at Cuddle Cat Rescue that there are many animals arriving at the rescue that have had no previous veterinary care or may have been exposed to disease. While occurrence of disease or parasite transmission from felines to humans is rare, especially with good husbandry, Cuddle Cat Rescue cannot assume any financial, medical, or veterinary responsibility for any transmission that may occur to the volunteer, visitor, family, adopter, or companion animal. Anyone that is pregnant or has a compromised immune system should contact their physician before choosing to adopt a cat from Cuddle Cat Rescue or fostering for Cuddle Cat Rescue in order to ensure that the most updated information is shared and is being followed. Adopter approves the use of email, text message, phone call, voice mail, direct mail through the postal service, and other means of communication to engage in follow up care of the adopted care. Follow up care may include periodic checking by any of the aforementioned communication mediums to ensure that the cat or kitten is adjusting properly to their environment and that all adoption agreements are being adequately satisfied. Note that you may opt out of communications in writing to the rescue. Opting out of communication is excluded when any of the agreements or clauses in this contract is suspected of being broken in any way.
Adopter approves the use of pre-adoption and post-adoption photographs of the adopted cat to be used on social media or other platforms as deemed appropriate to encourage adoption from Cuddle Cat Rescue. Note that no warning or preapproval is required for the rescue to use these photographs unless otherwise specified. The rescue will credit the adopter where appropriate for photographs if the adopter requests that the rescue do so.
Adopter agrees to safely transport the cat in a carrier when driving. Adopter agrees to make an immediate and serious effort to find the cat if it becomes lost, by (a) filing lost reports with animal control authorities, animal shelters, local veterinarians and pet stores, (b) post lost cat signs (c) contact the rescue for additional support and advice. Furthermore, Adopter understands that if the loss was the result of negligence, then Cuddle Cat Rescue has the right to reclaim said cat. Adopter will also not euthanize their adopted cat unless the cat has a terminal disease or injury that can be proven with compelling evidence such as bloodwork and diagnostic imaging.
Adopter agrees to the terms and conditions mentioned throughout this document. Adopter agrees that this document was not signed under duress. Adopter understands they have the option to not fill out the application or to leave the application rather than choosing to sign it. Adopter certifies that all submitted information is complete and correct to the best of their knowledge. Adopter certifies that they were 18 years old or older when signing or had a guardian sign for them. This information may be used to run a background check or to request veterinary records. Adopter realizes that any misrepresentation of the facts may result in losing the privilege of adopting an animal. Adopter understands that Cuddle Cat Rescue has the right to overturn or deny an adoption for any reason and at any point in the adoption process without warning. Adopter understands that this application and the contract is the property of Cuddle Cat Rescue who reserves the right to share this information with other agencies and organizations.
