    • Adoption Terms and Condition 
    • Cuddle Cat Rescue can make no warranty as to the temperament, physical condition, overall health, or psychological status of the adoptee. The adoptee is being adopted as is at the time of adoption. All warranties with regards to the adoptee, including any implied warranty of merchantability and fitness for a particular purpose, where they are applicable, are hereby specifically disclaimed. The rescue cannot make or offer a guarantee against any unforeseen health defects, hereditary problems, physical abnormalities, or medical illnesses that comprehensive and elective testing may identify if the rescue could afford extensive testing on every cat. However, UPON WRITTEN REQUEST ONLY, the adopter may ask the staff of Cuddle Cat Rescue to schedule a veterinary examination at owner cost prior to bringing the cat home if the adopter wishes to ensure the health of the adoptee before finalizing an adoption with Cuddle Cat Rescue. By not taking the rescue up on this offer for a pre-adoption health screen – the adopter fully understands the implications involved and assumes all responsibility for both the owned cat and any cat, dog, or person that will be sharing the same living space as the cat that is being adopted from Cuddle Cat Rescue.

      Adopter hereby releases Cuddle Cat Rescue from any and all liability for personal injury, property damage, legal fees, veterinary care, medical expenses for humans, or any other expense or liability incurred by the adopter as a result of adopting a cat from Cuddle Cat Rescue. Adopter agrees to indemnify Cuddle Cat Rescue from any and all such claims and to pay, without limitation, any costs related to such injury, damage, or liability which can include litigatio and attorney fees that are incurred by Cuddle Cat Rescue. If the adopter chooses to introduce their new cat to their personal pets or to any human residents before a 21-day quarantine, proper introduction, and a thorough veterinary exam then the adopter understands the medical risks for both the owned and new cats associated with failure to quarantine the cat along with a failure to introduce the cat properly to the household. Possible medical conditions include but are not limited to ringworm, feline leukemia, FIV, upper respiratory infection and parasites. Note that Cuddle Cat Rescue does test for feline leukemia but does not test for FIV. Additionally, cats who have tested negative for feline leukemia can possibly change status later in life due to several factors that are beyond the control of the rescue or any licensed veterinarian.

      Cuddle Cat Rescue will not and cannot be liable for any damages or costs incurred for treatment of the adopted cat or personal pets after an adoption has taken place for any reason including serious illness and disease. In the event that the adopter does not comply with the terms and conditions, or if the cat is neglected/abused including the rejection of any needed medical care, Cuddle Cat Rescue will hold the exclusive right to recover the cat upon demand. The cat will be surrendered to the rescue immediately upon verbal or written request. In addition, without waiving any of the adopter’s rights under this agreement – if the adopter does not surrender the cat to the rescue within 48 hours of this request, the adopter will owe the rescue a payment in the amount of $2500 plus attorney fees and damages needed to recover the cat. If at any time in the future that the adopter cannot continue to provide proper care or veterinary services for the cat they have adopted from Cuddle Cat Rescue then the adopter will not abandon, give away, transfer, auction, or sell the cat to any organization, individual, or nonprofit. The adopter must obtain written permission from Cuddle Cat Rescue to rehome a cat to another home or living environment. If a cat is rehomed personally after adoption, the person who is receiving the cat must pass the same standards and process that is expected for any applicant that is adopting from the rescue.

      Adopter agrees to provide all necessary medical care and behavioral support to the cat in a timely manner in respect to their quality of life. Cuddle Cat Rescue recommends setting up a veterinary client patient relationship within 24 hours of adoption so the veterinarian can examine the cat prior to any emergencies and to examine the cat before being introduced to household residents. This will also help identify any hidden issues if comprehensive testing is recommended based on the examination conducted by the licensed veterinarian. The adopter agrees to keep all vaccinations current and to ensure the cat receives preventative medication on schedule. Any problems, veterinary or otherwise, including serious illness requiring emergency care or surgery is the adopter’s responsibility. Adopter is responsible for all related costs and damages. All cats are given an examination, vaccinations, deworming, flea treatment and medical care while at the rescue by a trained veterinary technician with over 10 years of experience. The adopter is being provided with a healthy cat to the best of the rescue’s knowledge on adoption day. However, veterinary technicians are not qualified to diagnose disease or to prescribe medications so they are unable to perform any diagnostics.

      The adopter or adoption applicant understands that Cuddle Cat Rescue has the right to overturn or deny an adoption application for any reason and at any point in the adoption process without warning. Adopter or adoption applicant understands that this application and the contract is the property of Cuddle Cat Rescue who reserves the right to share this information with other agencies and organizations if doing so is deemed appropriate for safety. Cuddle Cat Rescue is not required by any law in the state of Missouri to share the reason for an application denial to the adopter or adoption applicant. If an adopter or applicant wishes to know the reason for an adoption denial, they must request it via legal counsel. If such engagement of legal counsel results in the loss of money or time for the rescue, then the adopter will be responsible for those expenses are deemed just and reasonable in the court of law.

      Adopter agrees to make a non-refundable donation to Cuddle Cat Rescue on the day of adoption. The donation helps the rescue cover spay/neuter and age-appropriate vaccinations that is performed by the rescue or will be performed by the rescue. All vaccinations not done at the time of the adoption are considered non-core vaccinations or are vaccinations that are not typically administered at the age of the cat or kitten being adopted out. The donation provided on adoption day is not refundable unless the cat does not work out in the first 14 days of adoption and is returned to the rescue. Any vaccinations following adoption is the responsibility of the owner – including rabies and FVRCP if needed. Feline leukemia vaccinations are not given at the cat rescue due to cost and practicality of the vaccine in a rescue or shelter environment.

      For purposes of this any contract or agreement between Cuddle Cat Rescue and anyone who participates at Cuddle Cat Rescue in any capacity including but not limited to volunteer, visitor, adopter, foster — “confidential information” shall mean all information or materials provided to the receiving party by Cuddle Cat Rescue directly or indirectly. Confidential information includes all information about people (e.g., donors, Cuddle Cat Rescue members, and prospective adopters), financial details, proprietary information, treatment protocols, information about the cats at the rescue, and other organizations. This also includes but is not limited only to donor names, contact information, donation amounts, prospective adopter names, contact information, and personal information collected. Confidential Information shall not be reproduced in any form except as required to accomplish the intent of any agreement or contract by an employee or representative of the rescue in good standing. Adopter or an applicant involved in the process of adoption from the rescue shall not, at any time, during or after contact with Cuddle Cat Rescue, divulge or furnish confidential or defamatory information about the rescue. The adopter or adoption applicant shall not furnish or make accessible information regarding adoption policy, the application process, or any other confidential information about improvements, plans, materials, devices, ideas, knowledge, and treatment protocols that are used for cats that are housed at the rescue through the adoption program. Any reproduction of confidential information by authorized representatives of the rescue shall remain the property of Cuddle Cat Rescue and shall contain any and all confidential or proprietary notices or legends which appear on the original, unless otherwise authorized. Discovery of information online or offline, including on social media and other outlets of information, in any form regarding or mentioning Cuddle Cat Rescue will be met with swift legal action if it is determined to be dangerous, malicious, or untrue. If litigation or arbitration is pursued, the adopter will be liable for all court costs and damages if the rescue is successful in proving that the adopter was more than likely involved in defamation, malice, or harassment in their activities by way of sufficient evidence.

      Upon verbal or written request by Cuddle Cat Rescue or any staff members who work at Cuddle Cat Rescue, the receiving party shall promptly provide Cuddle Cat Rescue with written certification that the receiving party has taken such action.

      Below are a few examples of confidential and proprietary information that should not be shared without express written permission by the rescue.

      * Donor, adopter, foster names and contact information

      * Volunteer names and contact information

      * Bank account information and balances

      * List of Cuddle Cat Rescue logins

      * Adoption/foster/volunteer internal business processes

      * Medical protocols and Program Of Vet Care documents

      If this is an unsterilized kitten then the adopter agrees to have this animal sterilized within one month of adoption or before six months of age depending on the situation. This rule also applies to adult cats that may be fostered out for any reason. Until the procedure is performed and proof of being altered is sent directly to the rescue, this cat is the sole property of Cuddle Cat Rescue. All decisions as to the wellbeing of the cat during this time is also at the discretion of Cuddle Cat Rescue. Adopter agrees to never declaw or allow the declawing of the adopted cat from Cuddle Cat Rescue now or at any time after adoption. Adopter understands that this is a painful and unnecessary mutilation of the cat. This procedure could result in chronic paw and back pain, inability to walk properly, neurological deficits and other physical ailments. Biting, urinating on the floor and aggression may result from declawing if it was badly botched or as the cat ages. Cuddle Cat Rescue will reclaim possession of any declawed cat and the adopter will be obligated to pay Cuddle Cat Rescue $2500 plus the cost of all veterinary work that is needed to restore the cat to normal health. The adopter agrees that they will be included on all no adoption lists for any nearby shelters/rescues.

      Zoonotic diseases are those that can be passed from a cat onto humans. Examples include tapeworm, roundworms, ringworm, and rabies. All volunteers and visitors to the rescue are impressed with safe handling techniques which are important elements of protection against disease. It is understood by all volunteers and visitors to the rescue that choose to work at Cuddle Cat Rescue that there are many animals arriving at the rescue that have had no previous veterinary care or may have been exposed to disease. While occurrence of disease or parasite transmission from felines to humans is rare, especially with good husbandry, Cuddle Cat Rescue cannot assume any financial, medical, or veterinary responsibility for any transmission that may occur to the volunteer, visitor, family, adopter, or companion animal. Anyone that is pregnant or has a compromised immune system should contact their physician before choosing to adopt a cat from Cuddle Cat Rescue or fostering for Cuddle Cat Rescue in order to ensure that the most updated information is shared and is being followed. Adopter approves the use of email, text message, phone call, voice mail, direct mail through the postal service, and other means of communication to engage in follow up care of the adopted care. Follow up care may include periodic checking by any of the aforementioned communication mediums to ensure that the cat or kitten is adjusting properly to their environment and that all adoption agreements are being adequately satisfied. Note that you may opt out of communications in writing to the rescue. Opting out of communication is excluded when any of the agreements or clauses in this contract is suspected of being broken in any way.

      Adopter approves the use of pre-adoption and post-adoption photographs of the adopted cat to be used on social media or other platforms as deemed appropriate to encourage adoption from Cuddle Cat Rescue. Note that no warning or preapproval is required for the rescue to use these photographs unless otherwise specified. The rescue will credit the adopter where appropriate for photographs if the adopter requests that the rescue do so.

      Adopter agrees to safely transport the cat in a carrier when driving. Adopter agrees to make an immediate and serious effort to find the cat if it becomes lost, by (a) filing lost reports with animal control authorities, animal shelters, local veterinarians and pet stores, (b) post lost cat signs (c) contact the rescue for additional support and advice. Furthermore, Adopter understands that if the loss was the result of negligence, then Cuddle Cat Rescue has the right to reclaim said cat. Adopter will also not euthanize their adopted cat unless the cat has a terminal disease or injury that can be proven with compelling evidence such as bloodwork and diagnostic imaging.

      Adopter agrees to the terms and conditions mentioned throughout this document. Adopter agrees that this document was not signed under duress. Adopter understands they have the option to not fill out the application or to leave the application rather than choosing to sign it. Adopter certifies that all submitted information is complete and correct to the best of their knowledge. Adopter certifies that they were 18 years old or older when signing or had a guardian sign for them. This information may be used to run a background check or to request veterinary records. Adopter realizes that any misrepresentation of the facts may result in losing the privilege of adopting an animal. Adopter understands that Cuddle Cat Rescue has the right to overturn or deny an adoption for any reason and at any point in the adoption process without warning. Adopter understands that this application and the contract is the property of Cuddle Cat Rescue who reserves the right to share this information with other agencies and organizations.

    • Volunteer and Visitor Disclaimers 
    • In the following terms and conditoins, volunteer(s) and visitor(s) will be cumulatively referred as volunteers for brevity. Volunteers that are involved with the rescue understand that their services while at the rescue visiting or volunteering are provided strictly in a volunteer capacity and not as a paid employee. Volunteers will agree to familiarize themselves with rescue policies and procedures while they are at the rescue. Furthermore, volunteers will agree to fully comply with all protocols and training videos that are provided by Cuddle Cat Rescue during their time at the rescue. Volunteer understands that policy and procedures are subject to change as deemed necessary. These changes will be communicated verbally, by text message, or by email message at least 24 hours before being enforced. The volunteer further understands that there will be no compensation, salary, stipen, or benefit to be expected from volunteering at the rescue in any capacity or role engaged in.

      Volunteer understands that Cuddle Cat Rescue handles a large number of cats on a day to day basis and that any participation while at the rescue may subject a volunteer to a hazardous situation or a situation that puts them at a high risk. The temperament of these cats are often unknown since many cats come from overcrowded animal shelters or from the streets. Volunteer agrees to hold harmless the rescue for any injuries up to and including death during the course of their volunteer related duties while at Cuddle Cat Rescue. While at the rescue – volunteer acknowledges and understands that as a volunteer at the rescue, they are not covered under Workers Compensation or any health plans in any capacity.

      Volunteer understands and agrees to assume all risks involved with their execution of duties at the rescue in a volunteer capacity. Such duties might include but are not limited to animal handling, custodial work, kennel technician tasks, office work and more as training and expansoin allows. Bending over, scooping food, cleaning up urine, cleaning up poop, handling scaredy cats, lifting/ transporting cats and disinfection are a few tasks that may be performed at the rescue. Volunteer understands it is their responsibility to ensure disease does not travel home to owned pets by ensuring good hygiene while visiting Cuddle Cat Rescue or while volunteering. Cuddle Cat Rescue cannot be held liable for owned pets becoming ill as a result of volunteering at the rescue. Visitors to the rescue and volunteers agree to be legally and financially responsible for their own acts and omissions. 

      Volunteer fully understands that the cat rescue expects high standards of moral and ethical treatment of animals under their care. Volunteer agrees to adhere strictly to these standards in a voluntary capacity at the rescue. Furthermore, volunteer agrees that a failure to comply with any of the obligations outlined for any reason whatsoever while performing volunteer services at the rescue may result in swift termination or feedback in regards to quality of work. Volunteer understands that while there may be a warning – the severity of the infraction will be looked at before any feedback or a decision is made in regards to training or termination.

      Volunteer understands that public relations are an important part of a volunteer's activities while at Cuddle Cat Rescue. On behalf of the rescue – volunteer hereby authorizes the rescue to use any photograph or video of you in its possession for public relations purposes without any advance notice. Volunteer will not represent the rescue outside of their volunteer without express written permission, especially to any news stations or media companies. The rescue will use reasonable efforts to give advance notice of such use of photographs, written statements, videos, or other forms of media, but notification is not required or a condition that must be met for proper use. Volunteer agrees that if they use their own vehicle for transportation purposes in their capacity of volunteering at Cuddle Cat Rescue for veterinary visits or for transporting to an adoption event, especially when the task is to move animals from one point to the next, that any damages or claims arising from transportation or of the animal’s presence in the vehicle will not be the responsibility of Cuddle Cat Rescue at any point in time.

      Volunteer understands that all rescue animals on the property belong to Cuddle Cat Rescue. No cats owned by the rescue shall be sold, given away, transferred, or adopted out without express written approval from authorized personnel or from the rescue director. Volunteer will keep all Cuddle Cat Rescue information in strict confidence at all times and not create a third-party website or social media page that mimics any portion of Cuddle Cat Rescue or its likeness. Volunteer will fulfill all duties listed or given to them by the supervisor in a timely manner. Volunteer completely and fully releases Cuddle Cat Rescue, its officers, other volunteers, and board members (released parties) from any and all claims that volunteer may have, or which may hereafter accuse a volunteer against released parties.

      Volunteer hereby acknowledges that he/she is at least 18 years of age. If the volunteer is under the age of 18, the signature of the parent or guardian of the volunteer shall be accepted and that signature, electronic or in writing, shall bind the volunteer and his/her parent or guardian to all terms of conditions and liability waivers. Volunteer may only volunteer or visit the rescue with a guardian if they are of at least 16 years of age due to the liabilty insurance Cuddle Cat Rescue has enrolled in. The volunteer hereby acknowledges that the signature of their parent or guardian is the true and actual signature thereof and the volunteer understands the terms and conditions and signs it of his/her free will that volunteer intends to be bound by the terms and conditions set forth along with all liability waivers.

Anyone that is pregnant or has a compromised immune system should contact their physician before enrolling into a volunteer role in any capacity at Cuddle Cat Rescue for their own safety.

      Cuddle Cat Rescue and board members of the rescue hold the right to ask any volunteer at the rescue or communicating with the rescue to cease communication if there is evidence to suggest that there is a risk to the health or safety of any person or animal within the rescue. Adequate evidence may include but is not limited to a failed background check, previous evidence of appearing as a threat to themselves or others, appearing on the no adopt list for the rescue or another animal care facility, or being engaged in the illegal manufacturing and distribution of illegal substances. Cuddle Cat Rescue is not expected or required to provide a reason for actions sanctioned if releasing that information could lead to further harm to any staff members. Finally – all expectations and principles are provided in the training that is held at Cuddle Cat Rescue prior to volunteering. 

      For purposes of this any contract or agreement between Cuddle Cat Rescue and anyone who participates at Cuddle Cat Rescue in any capacity including but not limited to volunteers, visitors, adopters, fosters — “confidential information” shall mean all information or materials provided to the receiving party by Cuddle Cat Rescue. This information includes but is not limited to standardized applications and the process of adopting, fostering, or volunteering.

      Any reproduction of confidential information shall remain the property of Cuddle Cat Rescue and shall contain any and all confidential or proprietary notices or legends which appear on the original, unless otherwise authorized. Voluntees shall not, at an time, during or after their role at Cuddle Cat Rescue, divulge or furnish information about the rescue. The volunteer shall not furnish or make accessible information regarding policy, the any application process, or any other confidential or defamatory information about improvements, plans, materials, devices, ideas, knowledge, and treatment protocols that may be used at the rescue. Discovery of information online in any form regarding or mentioning Cuddle Cat Rescue will be met with swift legal action if it is determined to be dangerous, malicious, or untrue. If any case must go to court or before a judge, the volunteer will owe the rescue a payment in the amount of $2500 plus reasonable attorney fees & damages.

      Upon the earlier of the rescue’s request or the completion of the receiving party’s authorized use, the receiving party shall  promptly return all confidential information and copies thereof (in whole or in part) in receiving party’s possession and discontinue all further use or dissemination of the confidential information. Upon request by Cuddle Cat Rescue, the receiving party shall promptly provide Cuddle Cat Rescue with written certification that the receiving party has taken such action.

      Below are a few examples of confidential and proprietary information that may be brought to legal counsel if inappropriately shared.

      • Adoption/foster/volunteer internal business processes 

      • Medical protocols and Program Of Vet Care documents

      Volunteers at Cuddle Cat Rescue recognize and agree that nothing contained in this agreement shall be construed as granting any property rights, by license or otherwise, to any confidential information disclosed pursuant to this agreement, or to any invention or any patent, copyright, trademark, or other intellectual property right that has issued or that may issue. All people that participate at the rescue in any capacity as a volunteer, donor or adopter agree that they shall not, directly or indirectly, make or ratify any defamatory comments or remarks (in writing or orally), about Cuddle Cat Rescue or their respective products or services. Cuddle Cat Rescue will not and shall direct its current officers and directors to not, directly or indirectly, make or ratify any defamatory comments or remarks (in writing or orally), about Cuddle Cat Rescue. For the avoidance of doubt, it shall not be a violation of the terms and conditions for any person to make truthful statements when required by court order or as otherwise required by law, including all applicable Governmental Agencies when appropriate. 

    • Foster Parent Disclaimers 
    • Foster understands that they will provide temporary shelter and care for a cat who currently has nowhere else to live while waiting for a new home. Cuddle Cat Rescue will continue to look for a permanent home for the cat but fostering keeps the cat safe, and provides comfort and security, until he/she can be adopted. Foster understands that he/she will not be compensated for this service, other than being provided the essential items and veterinary care needed while the cat is in foster care. Foster agrees not to transfer custody of the cat to anyone other than a representative of Cuddle Cat Rescue, and agrees to return the cat to Cuddle Cat Rescue upon request immediately. Foster agrees to notify Cuddle Cat Rescue without delay if the foster can no longer care for or keep the cat. Foster agrees to give Cuddle Cat Rescue a reasonable amount of time to place the cat into a different approved foster home. The Foster parent must notify Cuddle Cat Rescue of any behavioral or medical problems upon return of the cat

      Foster understands and agrees that this cat is the property of Cuddle Cat Rescue. The foster does not have any ownership of the cat and all such rights remain fully and forever with Cuddle Cat Rescue. In the case of a foster to adopt situation, the cat remains the property of Cuddle Cat Rescue until the cat is altered and an adoption finalization form is signed and approved by Cuddle Cat Rescue. The cat shall not be sold, given to, placed in the care of, offered or delivered for adoption to another person, organization or any other entity including, but not limited to, a family member, friend, rescue facility, research facility, or shelter. A cat must be returned to the rescue if, for any reason, the foster can no longer care for the cat. Violation of this agreement will result in travel costs, court costs and attorney fees payable by the foster if legal action or travel is necessary for Cuddle Cat Rescue to recover the cat. Foster understands that every cat has intrinsic value and is not replaceable, so if the foster cat is euthanized, lost or otherwise unable to be returned to the rescue due to the negligence or intent of the foster parent to circumvent Cuddle Cat Rescue’s ownership or possession of the cat it is agreed that the foster will be in breach of this agreement and is subject to pay liquidated damages to the rescue in the amount of $2,500.00 including attorney fees. 
       
      All veterinary visit requests must be made by Cuddle Cat Rescue; no other individual is authorized to decide upon veterinary care or assessment of behavior. Foster agrees to abide by the decision of Cuddle Cat Rescue in regards to authorizing any medical care recommended, including the denial of such authorization. Should the foster not get a reply to within 24 hours, he/she is directed to contact the rescue again as communication can be affected by forces not under rescue's control. All veterinary records and bills submitted for reimbursement must be in the name of the rescue and reflect the name of the cat as stated in this document. Bills that do not reflect both items cannot be reimbursed. Foster should take a copy of this contract to the veterinarian to ensure that all records are in the rescue's name. In the event of a life or death emergency, the cat is to be immediately treated and the rescue is to be notified as soon as possible or within 24 hours. If the attending veterinarian feels the condition of or injuries sustained to said cat are not conducive to reasonable recovery or quality of life for the cat within a reasonable time frame or reasonable cost, then the cat is to be humanely euthanized. Foster understands and agrees that any unauthorized veterinary care expenses will not be reimbursed and the foster will be responsible for charges for the cat that was treated by the veterinarian. 

      The foster cat will be treated as a family member with loving care and affection. 

      The cat will be cared for humanely and handled with respect. Humane handling follows LIMA which is least invasive, minimally aversive. Less is more. Foster will provide appropriate and humane behavior modification for behavioral problems including, but not limited to litterbox accidents and urine marking, chewing, clawing, digging, aggression, and biting. The rescue must be contacted if the cat exhibits behavioral problems that are beyond the foster parent  to reasonably manage. Physical discipline or punishment is never used for training. Finally, no one should encourage the cat to behave in an aggressive manner for the purpose of protection or fighting. The cat will be provided and afforded affection, stimulation through play and training, socialization, and regular exercise appropriate to his/her health or physical condition. The foster cat will be provided with clean and comfortable bedding while in foster care. The bedding must be changed when visibly soiled from waste or debris. Foster will advise Cuddle Cat Rescue if the cat is in need of any level of care that the primary veterinarian cannot handle such as grooming or removal of mats. All fostered cats and kittens will never be left without proper care for more than 24 hours of time unless a pet sitter is hired to take care of their routine and daily needs. All cats need good quality cat food provided by the rescue and fresh water daily. Medications should and must be given as directed.

      Cuddle Cat Rescue shall not be responsible for any bodily injuries or property damage and/or damage to other animals caused by the foster cat or by the actions of the foster. The foster hereby specifically assumes sole responsibility for, and agrees to indemnify and hold Cuddle Cat Rescue harmless from any and all loss and expenses (including legal fees or attorney fees) by reason of liability imposed by law upon the rescue or any of its officers, directors, members, employees, representatives, agents, or assigns because of bodily injuries or death to any person or persons including the foster parent or those in foster’s household, or any damage to property and/or animals arising out of or in consequence of the placement of of the cat into foster care however such injuries, death or damage to property and/or animals may be caused or arise, whether or not the same may have been caused, or may be alleged to have been accused, by negligence of the aforementioned parties or any of their directors, members, employees, representatives, agents, or assigns or any other person.

      If the foster chooses to introduce the new cats to their personal pets or individuals within the home before a 21 day quarantine period and standard introduction, foster understands the medical and financial risks for both the owned and new cats associated with that introduction decision. Possible medical conditions may include, but are not limited to, ringworm, feline leukemia, FIV, distemper, feline upper respiratory infection, feline immunodeficiency virus, and parasites. Cuddle Cat Rescue cannot be responsible for all incurred costs/damages.

      The foster will use best judgment and take all necessary precautions to protect themselves when providing daily care and training for the foster cat until the foster has had sufficient time to become familiar with his/her personality and behavior patterns. Foster agrees that they will use best judgment and take all necessary precautions when first introducing the cat to other members of my household and other family pets, as well as with new people and new situations until the cat has become fully adjusted to their environment and living conditions. 

      Foster will closely supervise all interaction with children and toddlers as suggested by Cuddle Cat Rescue. Cuddle Cat Rescue's cats are typically affectionate and friendly, and Cuddle Cat Rescue will not knowingly place a rescue cat known to be of an unsound temperament or health. However, no one can predict how any cat will react in a given situation, especially without complete knowledge of its life experiences. Therefore, the foster is strongly urged to exercise prudence and caution in introducing any new cat into a new situation (for example groomer, vet, and meeting other animals) until that cat has become fully adjusted to its new environment and the foster has had an opportunity to become familiar with the cat’s unique personality. Foster accept all responsibility and liability for all introductions during the time of which they are taking care of the cat.

      Cuddle Cat Rescue will not be held liable for any damage or loss resulting from counseling advice supplied to the foster. The cat’s known background and medical history have been discussed in full unless otherwise expressed. Foster understand that Cuddle Cat Rescue has made no definitive representation concerning the health, condition, training, behavior, or temperament of the cat as the health and behavior of any cat can quickly change.

      Cuddle Cat Rescue’s microchip will have contact information (address, phone number, or email address) of Cuddle Cat Rescue. Foster agrees not to remove or alter Cuddle Cat Rescue’s contact information from the foster cat’s microchip. In the event the microchip stops working (backs out after implantation, microchip cannot be found with a microchip scanner) foster agrees to notify the rescue without delay so the microchip can be replaced promptly.

      Foster will not have or consent to any cosmetic surgery performed on the cat that will alter or change his/her appearance in any way, shape or form (i.e. ear cropping, tail docking, etc). Foster will never breed the foster cat if he/she has not been spayed or neutered due to age or for health reasons. Foster will comply with all of the terms and conditions of the spay/neuter agreement. Foster will not euthanize the cat without the approval/authorization of Cuddle Cat Rescue unless it is an emergency and recommended by a veterinarian. Foster will notify the rescue immediately upon the death of the cat, and prior to the disposal of the body.

      Foster will advise Cuddle Cat Rescue immediately if the foster plans to change their address and/or phone number. Foster will request written or verbal permission from Cuddle Cat Rescue to transfer the cat to the new address. Foster will advise Cuddle Cat Rescue regularly as to the condition and adjustment of the cat. Foster will allow a Cuddle Cat Rescue representative to visit their home to check on the health and welfare of the cat and for the purpose of determining compliance with the terms and conditions of this agreement if deemed necessary or if there is sufficient reason to believe they are not being taken care of properly.

    • Surrender Disclaimers 
    • Relinquisher certifies that by turning in a cat to Cuddle Cat Rescue that they are the sole owner of the cat and that no other guardian of this cat exists to the best of their knowledge. Relinquisher understands that this cat will become the responsibility of Cuddle Cat Rescue and that you they will have no further rights to the ownership or information about this cat. Reqlinisher is not allowed to reclaim this cat in the future without filling out an application.

      All decisions regarding any cat surrendered, turned in, given to or taken back by Cuddle Cat Rescue will be made solely by Cuddle Cat Rescue with no feedback or opinion from the reqlinisher unless otherwise expressly asked for by the rescue or rescue representatives. 

      The relinquisher turning in the cat or cats to the rescue will have absolutely zero rights regarding the adoption of the cat or disposition status of the cat turned into the rescue. This takes effect the instant that the surrender paperwork is signed and processed into the system. The relinquisher guarantees to Cuddle Cat Rescue that this cat’s bite history and medical history is accurate and as indicated on the surrender form. Unless otherwise expressed verbally or in writing, the cat being turned in has not bitten anyone in the last 10 days. 

      If the cat is not yet current on vaccinations, not feline leukemia tested, and is not yet spayed or neutered then the reqlinisher agrees to donate money to help cover a portion of their care. The average cost of care for one cat at the rescue is upwards of $100 to $150. Relinquisher understands this contract and policies described within. Relinquisher agrees to every term and condition on this list. Cuddle Cat Rescue, its offers, board members, agents, and volunteers will be held harmless for any loss of, damage to, or injury to persons, animals, or property arising from or relating to the placement or any cat that is turned into the rescue.

      Relinquisher understands that it can take a long time from requesting entry into the rescue from when reqlinisher first reaches out due to space and cost restraints. Relinquisher agrees to help continue providing care for the cat and will find a home for the cat while the rescue retains your name and information on a waiting list that is managed by Cuddle Cat Rescue. The rescue also asks that if this is a behavioral case that you consider suggestions on behavior modification so that you may be able to keep the cat in your own home. Know that even with being on a waiting list that there is no guarantee of placement. A refusal of entry may be deemed appropriate if the intake examination reveals undesired information about health or behavior presentation that could introduce risk to rescue employees and volunteers.

      By surrendering any cat to the rescue and by signing a surrender statement – relinquisher grant unrestricted access to all medical records and examination records performed by any medical professional or pseudo professionals in the field of animal care. We may ask for this information prior to admittance so that we can provide tailored cat to what they need Photographs and videos may be requested and used to find the cat a home.

    • Non-Disclosure Disclaimers 
    • For purposes of this any contract or agreement between Cuddle Cat Rescue and anyone who participates at Cuddle Cat Rescue “confidential information” shall mean all information or materials provided to the receiving party by Cuddle Cat Rescue. Confidential information includes all information about people (e.g., donors, Cuddle Cat Rescue members, and prospective adopters), financial details, proprietary information, and other organizations. This includes donor names, contact information, donation amounts, prospective adopter names, contact information, and personal information collected. Confidential Information shall not be reproduced in any form except as required to accomplish the intent of any agreement or contract. This information includes but is not limited to standardized applications and the process of adopting, fostering, or volunteering. Any reproduction of confidential information shall remain the property of Cuddle Cat Rescue and shall contain any and all confidential or proprietary notices or legends which appear on the original, unless otherwise authorized.

      Upon the earlier of the rescue’s request or the completion of the receiving party’s authorized use, the receiving party shall  promptly return all confidential information and copies thereof (in whole or in part) in receiving party’s possession and discontinue all further use or dissemination of the confidential information. Upon request by Cuddle Cat Rescue, the receiving party shall promptly provide Cuddle Cat Rescue with written certification that the receiving party has taken such action.

      Participants at Cuddle Cat Rescue recognize and agrees that nothing contained in this agreement shall be construed as granting any property rights, by license or otherwise, to any confidential information disclosed pursuant to this agreement, or to any invention or any patent, copyright, trademark, or other intellectual property right that has issued or that may issue. All people that participate at the rescue in any capacity as a volunteer, donor or adopter agree that they shall not, directly or indirectly, make or ratify any defamatory comments or remarks (in writing or orally), about Cuddle Cat Rescue or their respective products or services. Cuddle Cat Rescue will not and shall direct its current officers and directors to not, directly or indirectly, make or ratify any defamatory comments or remarks (in writing or orally), about Cuddle Cat Rescue. For the avoidance of doubt, it shall not be a violation of the terms and conditions for any person to make truthful statements when required by court order or as otherwise required by law, including all applicable Governmental Agencies when appropriate.

    • Zoonotic Disease Disclaimer 
    • Free-roaming cat populations have been identified as a potential public health threat and are a source for several zoonotic diseases including rabies, toxoplasmosis, cutaneous larval migrans because of various nematode parasites, plague, tularemia and murine typhus. Several of these diseases are reported to cause mortality in humans and can cause other important health issues including abortion, blindness, pruritic skin rashes and other various symptoms. Domestic cats are a potential source of numerous infectious disease agents; however, many of these diseases are controlled in cats belonging to responsible owners through routine veterinary care, proper vaccination regimens and parasite chemotherapy. 

      Cuddle Cat Rescue treats every single cat that comes into the rescue with several dewormers aimed at preventing zoonotic infections. Age appropriate vaccinations and routine examinations are given too. While rare, Cuddle Cat Rescue assumes a strong stance against ensuring no breakthrough infections occur. However, Cuddle Cat rescue cannot be held liable for any zoonotic infections caused by any direct or indirect contact with rescue cats.

      Preventing Zoonotic Infections At Cuddle Cat Rescue: 

      Follow hand washing protocols by the center of disease control Follow rescue protocols for disinfection and termination of diseases  Watch all literature provided and educational training videos  Use gloves to clean if pregnant or immunocompromised upon request  Avoid socialization and interaction with feral cats if immunocompromised. Talk with your own physician about best disease prevention protocols before making the decision to come to the rescue in person if at all possible.

    • Cuddle Cat Rescue reserves the right to change the terms, conditions, and notices under which the Cuddle Cat Rescue services are offered, including but not limited to the charges associated with the use of the Cuddle Cat Rescue Web Site.

      Cuddle Cat Rescue websites, social media platforms, and other mediums for comunication may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

      By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

      Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

If you are donating to support a particular fund raising effort and the funds raised exceed the goal of the particular fund raising effort, the excess funds will be deposited into the general operating fund for use in helping all animals in the care of Cuddle Cat Rescue as Cuddle Cat Rescue deems appropriate. All monies donated go to the vetting, medicine, spay / neuter, food, litter, operations and supplies necessary to care for the animals and administrate Cuddle Cat Rescue as a 501(c)3. Charitable organization and contributions are tax-deductible for income, gift, and estate taxes.

      Cuddle Cat Rescue takes the following steps to ensure that personal information remains secure:

      A donor’s personal information is retained in a secure database that is separate from the volunteer database. This database is only available to a limited number of individuals on a need-to-know basis. Although the database may contain personal information such as name, address, and donation history, credit card and/or banking information is not retained.

      Online donations are made through secure forms; this organization uses secure servers and encryption to protect financial and other personal information during transmission of donations directly to Cuddle Cat Rescue's bank account(s). Reports from these services are available to obtain address information and donation amounts; Cuddle Cat Rescue would never receive credit card or bank account information.  

      Individuals receive e-mail newsletters (e-news) from Cuddle Cat Rescueif they expressly sign up for e-news on the Cuddle Cat Rescue website, if they donate to the organization, or if they adopt a cat/kitten. The information that is gathered from subscribers to our e-news lists (including e-mail addresses) is not shared with other non-Cuddle Cat Rescue affiliated organizations or companies. From time to time, Cuddle Cat Rescue may send out e-mail messages that might include information about like-minded organizations and companies, but Cuddle Cat Rescue does not provide them with access to personal information.

      In order to provide better and more relevant information, information may be compiled about e-mail response and website usage. This information helps the organization better understand site usage patterns and also what types of content and information may help improve the user experience on Cuddle Cat Rescue's website. All e-mail messages sent to e-mail newsletter subscribers contain a link to unsubscribe or to modify a profile. An individual may subscribe or unsubscribe to any e-news or e-mail communication from Cuddle Cat Rescue at any time. If an individual chooses to unsubscribe, only the individual can re-activate the subscription.
