Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https:/www.jubileescholars.org website (the "Service") operated by Jubilee Scholars ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service (“Customer”) and Personnel (“Freelancers and Subcontractors”).
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Purchases
If you wish to purchase any service made available through the Service ("Purchase"), you may be sent an email for initiating a Project Request, Service ("Purchase") will receive an emailed payment invoice from our third-party Invoice system, Wave Accounting, after personnel completes the project at each milestone or for California (CA) resident - every two weeks, or be emailed an upfront payment invoice for a PMO Service ("Purchase") after project approval, or be emailed recurring payment invoices for PMO Service ("Purchase") at each project milestone, or be emailed a payment invoice at another agreed timeline, or be linked to a third-party website and be asked to supply certain information including, without limitation, your Name and payment information.
Payment invoices are emailed through Wave Accounting, in Customer’s chosen currency. Applicable processing fees and taxes may be added to the invoice.
Payment invoices emailed to Customer are to be paid prior to the release of any customer-owned tangible and intangible assets, after Personnel (“Freelancers and Subcontractors”) confirms project completion at milestones or for CA residents, every two-weeks. Personnel (“Freelancers and Subcontractors”) that fail to release the Customer’s assets after receiving Service ("Purchase") payment will be terminated, unless it is due to incidents beyond their control (eg. hurricane, tornado, blackout, and related incidents) then Jubilee Scholars will attempt to retrieve Customer’s assets directly from the Personnel (“Freelancers and Subcontractors”)..
Customer inquiries for Service ("Purchase") are reviewed within 5 business days. Initial and recurring payment invoices will be sent at the agreed upon milestones. Personnel (“Freelancers and Subcontractors”) performing the Service ("Purchase") may receive milestone payment from Jubilee Scholars within 7 business days, depending on their choice of banking. Customer may be suspended or disabled from being serviced for non-payment of recurring payment invoices at the sole discretion of Jubilee Scholars. Any accounts that are not collectable by Jubilee Scholars will be turned over to an outside collection agency. If your account is turned over for collection, you agree to pay Jubilee Scholars a "Collection Fee" of not less than $200, in addition to the unpaid recurring payments, and any fees that may be imposed by the outside collection agency or its legal representation.
If you wish to purchase any products of Jubilee Scholars or third-party products and services available through the Service ("Purchase"), links to third-party web sites or services will be provided to complete the Service ("Purchase") and to accept their separate terms and conditions and privacy policy.
Milestone Payments
Customer choosing to pay Personnel (“Freelancers and Subcontractors”) through Milestones are required to do so at the agreed Milestone(s), prior to receiving Customer’s project-based assets from Personnel (“Freelancers and Subcontractors”).
Two-weeks Payments
California (CA) considers milestone payments to be escrow activity, requiring an escrow account to service Customer and Personnel (“Freelancers and Subcontractors”) that are (CA) residents. Jubilee Scholars provides an alternative venue for (CA) residents: (CA) resident Customer have to pay Personnel (“Freelancers and Subcontractors”) in two-weeks increments, regardless of project completion or request for another non-milestone payment method. Personnel (“Freelancers and Subcontractors”) that are (CA) residents can accept two-weeks wages or request that Customer use another method for non-milestone payments.
Flexible Payments
Customer may request flexible payments because of Project Sponsor requirements, due to grant funding, or for being a California (CA) resident.
One-time Full Payment
Customer may make a one-time full payment for a Service ("Purchase") and Personnel (“Freelancers and Subcontractors”) must confirm completion of the project prior to wages being paid to Personnel (“Freelancers and Subcontractors”) for the project.
Taxes
Customers who purchase a Service are responsible for paying any taxes, including any goods and services or value added taxes, which may be applicable depending on the jurisdiction of the services provided.
There is a sales tax of 6.5% for projects that make or repair tangible goods.
Depending on your residency or location, you may be subject to certain ad valorem or other taxes (for example, GST in Australia), on certain fees that we charge. These taxes will be added to fees billed to you, if applicable.
You acknowledge that you must comply with your obligations under income tax provisions in your jurisdiction.
Jubilee Scholars may be required to charge GST to Australian Consumers on certain projects. You will be notified and asked to confirm on acceptance of such projects the appropriate GST treatment.
Prohibited Projects
Our Service contains links to online request forms for services rendered to the Customer, which include but are not limited to Project Request and PMO Project Request. We prohibit projects that are illegal, inappropriate, potentially dangerous, unethical, or promotes harmful behaviors:
- Gambling
- Alcoholic beverages
- Pornography and related paraphernalia
- Smoking and related paraphernalia
- Offensive material (e.g., hate speech, encouraging violence against others, etc).
- Illegal drugs and related paraphernalia
- Intellectual property rights Infringement
- Weapons and related paraphernalia
- Detrimental experimentation
- Student’s graded project
- Cybercrimes and related activities
- Spamming
- Cloning
- Money laundering
- Sex trafficking
- Drug trafficking
If your project involves something illegal, inappropriate, potentially dangerous, unethical, or promotes harmful behaviors and it is not on this list, do not submit your project request. If you are unsure if your project involves something illegal, inappropriate, potentially dangerous, unethical, or promotes harmful behaviors, contact Jubilee Scholars before submitting your project request.
Links To Other Web Sites
Our Service contains links to third-party web sites or services that are not owned or controlled by Jubilee Scholars.
Jubilee Scholars has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Jubilee Scholars shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Refund Policy
All services rendered by Jubilee Scholars and its Personnel (“Freelancers and Subcontractors”) are provided on a non-refundable basis. If Personnel (“Freelancers and Subcontractors”) fail to complete a project, then a refund is invoiced to Customer.
Service Cancellation
Requests to cancel services may be made by notifying our Main Office by phone or email. All requests for service cancellation must be made a minimum of 3 days prior to the renewal date of the service being canceled. Failure to provide notice at least 3 days prior to the renewal date will result in a full bill prior to cancellation. No prorated or partial refunds will be made. All outstanding invoices must be paid in full prior to requesting cancellation, and all unpaid charges must be satisfied prior to the release of any customer-owned tangible and intangible assets.
Billing Errors
Customer acknowledges that Jubilee Scholars will make its best effort to ensure that all invoices are correctly issued. However, should Customer note any possible errors, Customer agrees to notify our Main Office within 3 days of the issuance of the errant invoice. After 3 days, all invoices will be assumed to be correct, and no further billing adjustments will be made.
Work Hours
Jubilee Scholars is a remote company and the office hours are Monday to Friday, 9am - 6pm ET. Custumer must leave a message to receive a callback during those hours on business days. Jubilee Scholars observes all federal holidays in the United States (U.S). Personnel (“Freelancers and Subcontractors”) are not required to work on (U.S.) federal holidays and are also not required to work on weekends, which are non-business days. Working on non-business days is optional. Jubilee Scholars is responsible for tracking Personnel (“Freelancers and Subcontractors”) flexible work hours.
Insurance
Jubilee Scholars will, and will cause each of its Personnel (“Freelancers and Subcontractors”) to, maintain, with financially sound and reputable insurers, insurance with respect to their respective properties and businesses against such casualties and contingencies, of such types, on such terms and in such amounts (including co-insurance and self-insurance, if adequate reserves are maintained with respect thereto) as is customary in the case of entities of established reputations engaged in the same or a similar business and similarly situated.
Indemnification and Hold Harmless
Customer agree to indemnify and hold Jubilee Scholars harmless from any and all claims, actions, suits, charges and judgments whatsoever that arise out of Jubilee Scholars’ performance or nonperformance of the services or subject matter called for in this Agreement.
Under no circumstances shall Jubilee Scholars be held liable for damages resulting from any interruption of service for an amount greater than the amount of the charges payable by the Customer for services during the period damages occurred. Customer also acknowledge that in no case will Jubilee Scholars be liable for damages as a result of its own negligence in excess of the charges payable by the Customer for services during the period damages occurred. Customer acknowledge that they make use of Jubilee Scholars' services at their own risk.
Referral Fee
Subject to the terms and conditions of this Agreement and coinciding with the Referral Program terms and conditions, a referral fee may be given for each qualified lead, on the following conditions explained in the attached “Referral Program Terms and Conditions.”
Reviews
Customer reviews submitted on the “Contact Us” form belong solely to us and may be used for advertisement purposes. Customer reviews on third-party websites are subject to third-party regulations.
Customer and Personnel Interaction
Customer and Personnel (“Freelancers and Subcontractors”) communication must be conducted through an internal email, phone, SMS message, chat bot, audio and or video conference, audio and video chat functionality, or in-person as requested and may be done so through third-party vendors.
Customer and Personnel (“Freelancers and Subcontractors”) interactions are not to include the promotion of Prohibited Projects or be in violation of our Christian Business Ethics. Personnel (“Freelancers and Subcontractors”) are required to sign a Non-Disclosure Agreement (NDA) and Intellectual Property Agreement (IP); excluding Intellectual Property Agreement (IP) for internal Contributors that are Personnel (“Freelancers and Subcontractors”) for Jubilee Scholars. Personnel (“Freelancers and Subcontractors”) are required to sign a Drug Free Workplace Affidavit that includes remaining drug-free while employed with Jubilee Scholars and Customer may report suspected users for investigation and possible termination.
Customer may request a Non-Disclosure Agreement (NDA), Intellectual Property Agreement (IP), or Federal background check required for Personnel (“Freelancers and Subcontractors”) to perform a project.
Customer and Personnel interactions that included harassment, discrimination, and unlawful activites will not be tolerated. Customer displaying any of the behaviors are subject to service termination, with no refund. Personnel (“Freelancers and Subcontractors”) displaying any of the behaviors are subject to termination.
Legal Disputes
This Agreement will be governed in all respects by the laws of Florida. We encourage Customer to try and resolve disputes using certified mediation (such as Customer Service, though phone or online channels). If a dispute cannot be resolved between Customer and Personnel (“Freelancers and Subcontractors”), then the use of Alternative Dispute Resolution ("ADR") is suggested.
No Waiver
Our failure to act with respect to an anticipated or actual breach by Customer or Personnel (“Freelancers and Subcontractors”) does not waive our right to act with respect to subsequent or similar breaches. Nothing in this section shall exclude or restrict Customer or Personnel (“Freelancers and Subcontractors”) liability arising out of fraud or fraudulent misrepresentation.
Christian Business Ethics
Jubilee Scholars does not require Personnel (“Freelancers and Subcontractors”) to be a Christian. However, Jubilee Scholars does require Personnel (“Freelancers and Subcontractors”) to agree to its Christian Business Ethics of: honesty, integrity, treat others with respect, regardless; provide quality work, be fair, refuse bribes, do not extort, do not embezzle, and do not partake in other corrupt business practices.
Travel
Customer with Service (“Purchase”) requiring Personnel (“Freelancers and Subcontractors”) to travel will be assessed an additional Travel fee, if Personnel (“Freelancers and Subcontractors”) have to travel more that fifty miles from their current residence, using a vehicle to travel to the project site and were not offered adequate wages for traveling.
Customer requiring Personnel (“Freelancers and Subcontractors”) to travel to multiple sites for the project, will be assessed an additional Travel fee, if adequate wages are not offered for multiple travel using a vehicle to complete a project.
Jubilee Scholars determines if Personnel (“Freelancers and Subcontractors”) wages are adequate for using vehicles for project-related travel, using the Internal Revenue Service (IRS) standard of 58.5 cents USD per mile driven for business use and will inform Customer of the additional Travel fee.
Customer and Personnel (“Freelancers and Subcontractors”) may work together to arrange alternative means of Travel for projects. Customer is advised to include an adequate Travel Fee in the Service ("Purchase") offer.
Violation of Terms
Should Customer violate any of these terms, Jubilee Scholars will attempt to contact the customer by email or telephone before taking any action where avoidable. However, Jubilee Scholars will pursue whatever action is necessary to serve its best interest in these cases, even if that should necessitate the suspension or termination of Customer's services without any type of notification.
General
Jubilee Scholars is a remote company with a virtual office located at 15050 Elderberry Ln., Ste.6, Fort Myers, FL 33907.
This Agreement contains the entire understanding and agreement between Customer and Personnel (“Freelancers and Subcontractors”).
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
