Waiver of Liability, Release, Hold Harmless Agreement and Inventory

The undersigned (collectively, “Camper”) recognize(s) that there are inherent risks involved in camping and camping activities and programs. Camper understands that he/she/they have a duty to exercise reasonable care for Camper’s own safety and the safety of those for whom Camper is responsible.

In consideration for being permitted, through Camp Easy Ride collectively operated by Mark Mendez (also known as the Camp Host) to utilize a pre set up tent system (the “Tent”) manufactured by Ozark Trails or similar, as well as the facilities, services,and programs of the Compound at which the Tent is located (the “Compound”, and collectively with Ozark and Camp Easy Ride, the “Released Parties”), the undersigned agrees as follows:

1. Release from Liability. Camper RELEASES, WAIVES, DISCHARGES, and COVENANTS NOT TO SUE the Released Parties or their directors, officers, agents, employees, and insurance carriers from any loss, damage, claim, or demand, whatsoever, including any such claims relating to injury or loss to the person or property of Camper or resulting in the death of Camper, whether caused by the negligence of any Released Party or otherwise while the Camper is in or upon the Compound and/or participating in any Compound activity.

2. Indemnification. Camper agrees to INDEMNIFY AND HOLD HARMLESS the Released Parties and their directors, officers, agents, employees, and insurance carriers from any loss, liability, damage, or cost they may incur due to the presence of Camper in or upon the Compound or in or around the Tent, including, but not limited to, any and all damages, loss, theft or destruction of any personal property or vehicle or any damages attributable in any way to any defect in design or manufacturer of the Tent.

3. Damages or Losses. Neither Released Parties nor their directors, officers, employees, agents, or insurers, shall be responsible to Camper for any loss, damage, or claim related to any actual or alleged defect in the Tent. Camper assumes all liability or responsibility for any acts of any third person, including other Campers, campers or guests of the Compound. Camper ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY LOSS OR DAMAGE.

4. Notification. Camper shall promptly notify Camp Host of any and all accidents involving the Tent or any damage caused to the Tent. Camper shall provide full details concerning the damage or accident. Camper shall forward to Camp Easy Ride or Camp Host a copy of every Demand, Notice, Summons, or other Process received in connection with any and all claims, suits, or other legal proceedings resulting from any accident or damage involving the Tent.

5. By signing this agreement and accepting the responsibility of the Tent (and collective items within) Camper agrees to immediately reimburse the Camp Host for any damaged or missing items as listed below within the Addendum (A) section, of which will be charged to the payment source on file or invoiced.

6. Entire Agreement. There are no oral agreements and this Agreement constitutes the entire agreement between the parties and shall be binding on their heirs, executors, administrators, and their legal representatives, successors and assigns.

7. Minors. Although each Camping event is a 21 or older event, each Camper executing this Agreement intends to be legally bound by this Agreement as well as to bind each and every minor attending with such Camper and takes full responsibility for said minor or guests.

8. Photography. Camper understands and agrees that any and all photography or videography is the property of Camp Easy Ride and may be used for print or online promotions.

Addendum (A)

Inventory List and replacement cost

Ozark Instant tent (or substitute) - $300 each / Ozark tent rainfly - $50

Queen air mattress - $100 each / Queen linen and comforter set - $50 each

Pillows (2) - $5 each / Glamour blanket - $40 each

Folding side table - $20 each / Bed side fan - $30 each

Vanity Mirror - $10 each / Interior rug - $40 each

Folding Camp chairs (2) - $20 each / Exterior rug - $40 each

Extension cord with outlet extender - $20 / Security combination lock - $10

I have read and do hereby agree to the terms and conditions listed above. I understand that my participation at any Camp Easy Ride venue, is contingent upon agreeing to these terms and conditions.*
