360 Volleyball Club Parent and Player Team Contract
2022-2023 Club Season
Please read this agreement (the “Agreement”) in its entirety. This agreement describes the responsibilities and obligations associated with an affiliation to 360 Volleyball Club as a parent and/or player. Completing and signing this agreement necessitates that you agree to the terms and conditions as described herein for the 2022-2023 360 Volleyball Club season.
The Participants:
360 Volleyball Club, hereafter referred to as “360”
I, * , am the parent or legal guardian of the Player ** , who was born on * and resides in * .
Membership Includes:
1. 360 shall provide volleyball instruction and supervision during USA Volleyball (USAV) sanctioned volleyball tournaments, in accordance with the governing policies and guidelines established by the USA Volleyball (USAV) and the North Texas Region (NTR) for the club volleyball season.
2. 360 shall provide instructional practices at times and durations specified by 360.
3. 360 shall provide a uniform package.
4. 360 shall pay all fees and registration expenses associated with team tournament play. Parents are responsible for player scorer certification fees and USA Volleyball or North Texas Region membership fees.
5. 360 shall provide training equipment, including but not limited to, volleyball nets, balls, and training aids.
6. 360 shall pay in season gym fees, coaches’ salaries, coaches’ travel accommodations as well as membership fees and/or certifications related to coach membership requirements.
Financial Agreement Schedule:
All Club dues and fees are due on the 1st of the month per your signed financial agreement. Payments are late on the 5th of the month. Members not current on club dues are subject to suspension. Coaches will be notified of players who are not allowed to participate in any club activities (practice, games, tournaments, etc.) due to delinquency. Failure to pay club dues in full per your signed financial agreement could result in further attempts to settle your account by an collection agency and/or small claims court.
Travel Team Fees:
Travel team fees are not included or associated with team club dues. These expenses are the sole responsibility of the parent/guardian. This includes hotel fees, airfare, uber/lyfte, food, etc. . . . Do not purchase airfare until you receive confirmation to do so from 360 Volleyball Administration. If traveling out of town, all team members will be required to stay at the team hotel. Hotels for qualifiers are assigned in accordance with the Stay to Play rules implemented by USA Volleyball. A block of rooms will be held by the hotel for 360 Volleyball parents to secure a group rate. The team is required to use the housing block to participate in the tournament. 360 Volleyball is not liable for any travel arrangements made outside of the housing block or any airline fees associated with flights including changes or cancellations.
Practice Players:
360 Teams may carry practice players.
Incidentals:
360 accepts NO liability for costs associated with travel, parking, meals, or incidental expenses incurred while participating in 360 activities, including but not limited to, practice sessions and/or tournament play.
Team Assignment:
360 reserves the right to move players between teams at the discretion of the Club Director.
Terms and Conditions:
• 360 reserves the right to determine practice times, days, and durations. 360 solely determines content of instructional practices and the extent to which each player participates during practice and tournament events.
• 360 reserves the right to control entry into the practice facility/arena. Players, parents and/or visitors must abide by all federal, state, and local health mandates and recommendations enforced by 360. Players, parents and/or visitors may be asked to leave the practice facility, arena or tournament venue for failure to comply.
• 360 may ask players, parents and/or visitors to leave the practice facility, arena or tournament venue at its discretion.
• 360 reserves the right to suspend and/or terminate a player’s membership for non-adherence to 360 policies. non-adherence to practice facility rules, or non-adherence to the terms and conditions of this Agreement, including without limitation for failure to pay club dues by the designated due dates.
• 360 reserves the right to utilize player images (photos, video) for promotional tools and recruiting efforts without compensation.
360 PLAYER REQUIREMENTS:
• Player must be in good, physical condition and does not have a health condition(s) that may be complicated by strenuous physical activities, such as training for and/or playing competitive volleyball.
• Player does NOT use illegal drugs, tobacco, or alcohol.
• Player has a positive attitude and personally desires to play club volleyball.
• Player agrees to obey all of the rules and regulations set forth by USA Volleyball and the North Texas Region along with 360 rules, policies and procedures including but not limited to the 360 Code of Conduct and agrees to conduct herself as an honorable member of 360.
360 PLAYER’S PARENT AND/OR GUARDIAN:
• Player’s Parent and/or Guardian can demonstrate legal guardianship of the player if requested by the Club or governing organizations.
• Player’s Parent and/or Guardian assume responsibility for payment of all costs, fees, and expenses associated with the Player’s participation and membership in the Club.
• Player’s Parent and/or Guardian understand that payments are due full per the signed Financial Agreement and registration fees and deposits are non-refundable without exception, regardless of the Player’s ability to participate in Club activities due to injury, termination and withdrawal for any reason including public health mandates or recommendations. If you become delinquent on payments due, you may at the sole discretion of 360, be subject to immediate suspension from your team or termination from the club without further notice.
• Player’s parent and/or Guardian understand that club insurance is available to purchase before the designated deadline from US Sports Club Insurance (outside vendor) to cover job loss, injuries, illness, death, mental illness, and relocation.
• Player’s Parent and/or Guardian acknowledge that playing volleyball can result in serious injury and the Player’s Parent and/or Guardian assume all liability for Player injuries resulting from participating in any Club activities.
• Player’s Parent and/or Guardian vow to abide by all 360 Volleyball’s rules and regulations including but not limited to the 360 Code of Conduct and the Spectators Code of Conduct. The Player’s Parent and/or Guardian assume all responsibility for accompanying visitors and guests’ to adherence of the same code of conduct.
• Voluntary termination of membership by a Player’s Parent and/or Guardian SHALL NOT reduce or suspend your obligation to pay all dues and other indebtedness incurred as the result of signing this Agreement and the player Financial Agreement, including without limitation prepayment for tournaments, gym rentals, and other reasonable expenses.
• If a Player’s Parent and/or Guardian is terminated from employment (voluntary or involuntary), the Player’s Parent and/or Guardian will remain liable for all dues and other indebtedness incurred as the result of signing this Agreement.
• The Player’s Parent and/or Guardian has read, understands, and freely agrees with the stipulations, fees, terms and conditions of this agreement.
• The Player’s Parent and/or Guardian is capable of legally entering into a contract, in accordance with the laws of the State of Texas and freely does so by completing and signing this membership agreement, a legally binding contract.
360 VOLLEYBALL CLUB RULES AND REGULATIONS:
The following rules and regulations must be adhered by from all 360 Volleyball members regardless of age level. These rules are in addition to all rules set forth by USA Volleyball and the North Texas Region.
1. Practices are mandatory. If a Player must miss a session, the Player and /or Player’s Parent and/or Guardian is responsible for notifying your coach as soon as possible with a minimum of 24 hrs. prior to practice. However, missed practice time may result in a loss of playing time. Playing time is never guaranteed.
2. Tournaments are mandatory. If a Player must miss a tournament, the Player and /or Player’s Parent and/or Guardian should notify your coach as soon as possible prior to that tournament. Missing a tournament day could affect future playing time. Playing time is never guaranteed.
3. Players should arrive at least 15 minutes prior to practice to ensure they are ready once practice begins. An earlier arrival time may be deemed necessary by your coach. Confirm arrival expectations with your coach.
4. All players are to arrive a minimum of 1 hour before games. Confirm your arrival expectations with your coach. It is the players’ and parents’ responsibility to know this policy and adhere to it. Arriving late to a tournament may affect playing time.
5. Player’s Parent and/or Guardian or guest are prohibited from participating in any club practices, unless the Director's approval has been given.
6. Tournament Must- Haves: Always bring both uniform jerseys to each tournament, hair must be neat and pulled back, wear knee pads and designated socks. Cover-up shorts are required to be worn when not in game play. 360 will have cover-up shorts available onsite at the annual 360 tournaments as well as in the online store.
7. Players should bring their own water and hand sanitizer to all 360 activities including lessons, clinics, camps, practices, and tournaments.
8. Club members and their parents should conduct themselves in a manner that is not only becoming to themselves but as representatives of 360. The way we talk, the way we dress, the way we play – all affect the way people view our club. Strive to present the most positive image possible when at tournaments and at practice. Any inappropriate behavior will be handled on a case by case basis, with suspension from the club as an option if actions warrant but does not waive your financial obligation.
9. 360 Volleyball Club has a no-tolerance policy regarding illegal drugs, tobacco and alcohol for its members.
10. All Players must remain at the tournament until dismissed by the coach. This includes when a team must ref the final match of the day. ALL players must remain at the facility/gym until the assignment is complete. Failure to do so could result in a player suspension.
11. All jewelry is to be removed prior to practice or tournaments.
12. No cell phone or tablet usage by a player during practices, training or at tournaments.
13. If a player is injured, the player is still expected to atPend practices and tournaments to hear the instruction and direction being given by the coach. If mobility from the injury prevents practice participation, this must be discussed with the coach prior to the day of practice.
14. No playing time discussions during tournaments. 360 Volleyball has a 24-hour cooling off period to which you must adhere. Parents should not approach coaches at tournaments regarding playing time. Parents should also refrain from sending texts or emails regarding playing time during tournaments. Parents should make an appointment to speak with their coach no sooner than 24 hours after the event’s conclusion. Parents who violate this rule will be asked to leave and will not participate for the remainder of the tournament and are also subject to suspension or expulsion.
Playing time is at the complete discretion of the coach, and is based on several factors including, but not limited to performance in practice and games. Opportunities are always given at practice, which is where most of the athletes’ learning takes place. Coaches will be required to make all efforts to distribute playing time equitably (this does not mean equally). Please discuss the playing time policy with your child prior to season. 360 PARENT/PLAYER/SPECTATOR CODE OF CONDUCT
Youth sports programs play an important role in promoting the physical, social, and emotional development of children. It is therefore essential for parents to encourage youth athletes to embrace the values of good sportsmanship. Moreover, adults involved in youth sports events should be models of good sportsmanship and should lead by example by demonstrating respect and self-control.
I therefore pledge to be responsible for my words and actions while attending any 360 sports event as a player, parent, or guest of 360 Volleyball Club and shall conform my behavior.
The principals below are to be upheld by 360 parents, players, and guests regarding all coaches, parents, players, participants, officials, and other attendees at sporting events:
1. I will abide by the official rules of USA Volleyball.
2. I will display good sportsmanship at all times.
3. I will educate myself on the unique rules of each tournament facility and abide by them.
4. I will generate goodwill by being polite and respectful to those around me at each event.
5. I will acknowledge that the spectator seating around the courts is for the primary use of those watching the match in progress.
6. I will acknowledge that spectators may rightfully choose to remain in a seat for an entire match without switching sides of the court when the teams switch.
7. I will not harass or intimidate the officials, including line judges and scorers.
8. I will not participate in any game or game-like activities unless I have a current membership with USA Volleyball.
9. I will not bring and/or carry any firearms at any USA Volleyball event.
10. I will not use tobacco products or illegal drugs on the premises.
11. I will not bring, purchase, or consume alcohol at any Youth/ Junior volleyball event.
12. I will immediately notify the Event Director and/or Program Administrator in the event that I witness any illegal activity.
13. I will not engage in verbal or physical threats or abuse.
14. I will not engage in gossip about players, coaches or their families.
15. I will not use social media outlets such as Facebook, Twitter, etc. to post comments that are
negative in nature towards anyone associated with 360.
16. I will not coach any team from the sidelines at practices or tournaments and will defer those duties to the team’s coach.
17. I will not engage in any behavior that would endanger the health, safety or well-being of others or encourage such behavior.
18. I will not engage in the use of profanity.
19. I will treat everyone with respect regardless of race, creed, color, national origin, sex, sexual orientation, or ability.
I hereby agree that if I fail to follow to above rules of engagement while attending any 360 event (which includes practices) I will be subject to disciplinary action, including but not limited to the following in any order or combination:
· Verbal warning issued by 360 Volleyball Club or representative of USAV.
· Written warning issued by 360 Volleyball Club or representative of USAV.
· Suspension or immediate ejection from a youth sports event issued by 360 Volleyball Club or representative of USAV.
· Suspension from multiple youth sports events issued 360 Volleyball Club or representative of USAV.
· Season suspension issued by 360 Volleyball Club or representative of USAV.
· I also understand and agree that I am equally responsible and will be subject to the same disciplinary action for conduct from my attending family members and/or guests that have not signed this Code of Conduct.
· I understand and agree that if 360 Volleyball Club is issued a fine due to my behavior or the behavior of my family members or guests at an event, I assume financial responsibility for any fines imposed.
RELEASE AND WAIVER:
I give my permission for the above-named player to participate in activities with 360 Volleyball Club. I understand that volleyball is a limited contact sport that involves jumping, running, and ball handling in a confined playing area and injuries may occur. I acknowledge that even with the best coaching, the use of the most advanced protective equipment, and strict observance of the rules, injuries are still possible. I hereby authorize 360 staff to act for me according to their best judgment in any emergency situation requiring medical attention and I hereby waive and release 360 Volleyball Club and director’s, Board Members, and staff from any and all liability stemming from any injuries or illnesses incurred while participating in club activities. I understand, agree, and acknowledge that some activities may be of hazardous nature and/or include physical and/or strenuous exercise or activity. If any injury is sustained and requires hospitalization, I understand that I or my medical insurance company is solely responsible for any and all bills and claims that may be filed as a result of the injury. With full understanding of these facts, I state that to the best of my knowledge, the player named above has no medical, physical, mental, or emotional health conditions that would hinder or prevent her participation in 360 Volleyball Club activities.
MISCELLANEOUS
The rules and regulations included in this Agreement are NOT inclusive. Amendments to 360 rules and regulations may be made from time to time as necessary. On all questions regarding the interpretation of and application of 360 rules and regulations, the decision of the Directors of 360 shall be final.
I, the Player and/or the Player’s parent or legal guardian, have read, understand, and freely accept this agreement as written and indicate so by my signature below.
By signing this document, I acknowledge that I have read in full, understand and agree to abide by the statements in this membership agreement which include Membership Fee and Payment Schedule, Terms and Conditions, 360 Volleyball Club Rules and Regulations, Parent and Player Code of Conduct and Release and Waiver. I hereby voluntarily release, forever discharge the community, the corporation, its officers, directors, employees, volunteer and agents from any and all claims, demands, or causes of action, which are connected with my child's participation in the programs or the use of the equipment and facilities. I agree to pay for any and all medical expenses incurred and give permission to the doctor or health care professional to provide medical care if necessary. The information I've given in this form is complete and accurate. By signing this form, I confirm that I understand and agree to the content in the 360 Volleyball Club Parent and Player Team Contract Consent and Release Form. I warrant that I possess all the rights, powers, and privileges of a parent or legal guardian necessary to execute this document with binding legal effect.
