Terms of Adoption:
1. I/We will not sell, give away or transfer in any way this pet to any other person or entity for the lifetime of the animal. In the event I/we can no longer keep this pet, I/we must return it to P.A.L.S. I will also instruct others that, in the unfortunate circumstance that I/we cannot make this decision for myself/ourselves, they will do so on my behalf. While P.A.L.S. will endeavor to take the pet back within 48 hours, I/we agree to be responsible for its humane upkeep for up to 2 weeks in the event P.A.L.S. is unable to take it immediately.
2. I/We agree to notify P.A.L.S. of any change of address for the lifetime of the animal so that P.A.L.S. knows where the animal is located at all times by email or mail to P.A.L.S., P.O. Box 201, Broomall, PA 19008.
3. I/We will permit the pet to live indoors. If a cat it will be 100% indoors unless on a leash or in a fully enclosed facility (top fenced kennel) and will be indoors at night and in inclement weather.
4. I/We agree that if I am adopting a cat or a kitten, all cats living in or visiting my/our house will be indoor only cats and that they will have tested negative for Feline Leukemia Virus. I will not permit contact by any cat living in my house, including but not limited to the adopted cat, with any cat not meeting the above standards either at my house or any other place.
5. I/We agree to provide a quality diet, fresh water at all times, and proper vet care, including at least one annual wellness exam and prompt veterinary care in the event of illness or injury. I/we agree to provide routine vaccinations and keep them current. For cats this includes FVRCP and rabies. The only exception to the vaccine agreement is if, upon the advice of a veterinarian, my pet is not a candidate for vaccinations.. Appropriate vet care includes a dental exam and dental care.
6. If the pet is not spayed or neutered at the time of adoption, I/we agree to spay (females) at or about 5 months of age and to neuter (males) before 6 months of age. I/we understand that vet care and pet ownership are expensive. I/we agree that I/we have financial means to provide proper veterinary care, including spay/neuter, annual exams and dental care.
7. I/We understand that P.A.L.S animals cannot be declawed under any circumstances. I/we specifically agree that declawing is cruel and will not be done to my/our pet. I/we agree never to de-claw it. I/We understand the penalty for doing so is the return of the pet plus $1000 penalty.
8. I/We understand that this pet appears to be in good health and free of disease except as disclosed, but is susceptible to illness. I/we understand that this animal could have undetected and/or latent health issues, including ringworm. I/we understand and agree to promptly report to P.A.L.S. any illness or infirmity of the pet within one (1) week immediately following the adoption. P.A.L.S., at its sole discretion, may assess and arrange an initial consultation for the animal if necessary with the veterinarian of its choice. Following consultation with a P.A.L.S. veterinarian, P.A.L.S. at its sole discretion may agree to treat the animal, on a case by case basis. In certain cases, and at its sole discretion, P.A.L.S. may be willing to take the animal back. P.A.L.S. will not pay for assessment, diagnosis or treatment of any other animals. Under no circumstances shall P.A.L.S. pay for treatment or diagnosis by any other person, including veterinarians not engaged by P.A.L.S. for this case . P.A.L.S. will not pay for human treatment, including ringworm.
9. I/We agree to euthanize only for humane reasons and when there is no other humane choice.
10. There will be a six (6) month trial period. During this time and as a part of this Adoption Agreement, I/we agree to immediately cooperate with routine phone follow ups by a P.A.L.S. representative, agree to allow a P.A.L.S. representative to inspect the living environment of this adopted pet at P.A.L.S. sole and absolute discretion within, check on its general health and/or verify that it has been surgically sterilized in compliance with this Adoption Agreement. If such an inspection takes place it will be at a mutually agreeable time within 72 hours of the request, which may be made via email, mail or phone. If, however, P.A.L.S., in its sole discretion, at any time deems the care to be inadequate or any part of this contract to have been breached, I/we agree to promptly surrender the pet and understand that the adoption donation is forfeited. I/we agree to a $1,000 penalty, payable to P.A.L.S. should any aspect of this contract be violated. The undersigned adopter(s) irrevocably authorizes any P.A.L.S. officer or their designated representative to appear in any court of competent jurisdiction and confess a judgment without process in favor of the Pet Adoption and Lifecare Society for such amount as may now appear due including attorney’s fees and other collection costs and to consent to immediate execution upon such judgment.
11. I/We know and understand and agree that P.A.L.S. and its officers, directors, volunteers, associates, members and/or affiliates will not be responsible for any bodily or mental injuries or illness or death to any person or property damage arising out of or in consequence of this placement, caused by the adopted pet or by my/our (the adopters) actions. I/We hereby assume sole responsibility for this pet, and agree to hold P.A.L.S., and all of its directors, officers, volunteers, associates, members and/or affiliates and professionals engaged by PALS for the animals harmless from any and all claims and or loss and expenses (including legal and medical fees) by reason of any and all liability imposed by law.
12. I/We have agreed to make a non-refundable donation of ${donationAmount}. My/Our signature below indicates that I/we have read this contract carefully, understand its terms and agree to all of the above-stated conditions. I/We also agree to give a deposit in the amount of ${spayneuterDeposit}, in addition to the adoption donation, for any non-neutered or non-spayed animal. The deposit will be refunded upon submission of a spay/neuter certificate that the adopted animal has been spayed or neutered. The surgical sterilization cost is my/our full responsibility.
13. This agreement and contract are valid and binding upon any spouse, associates, heirs or powers of attorney.
14. I/We agree that any legal dispute to this contract will be resolved in the Delaware County, Pa. Jurisdiction unless mutually agreed that another venue will suffice. I/We agree to be liable for all PALS attorney fees and court/filing costs should a dispute arise and the outcome be unfavorable to me/us.
15. This contract is fully severable such that if any provision of this contract is found and determined to be invalid or otherwise ineffective by a court of competent jurisdiction, all remaining provisions and conditions of the contract shall remain in full force and effect.
16. By signing this agreement I acknowledge that I have read and understand all of its provisions.
