Release of Liability, Waiver of Claims and Assumption of Risks

WARNING: BY SIGNING THIS AGREEMENT, YOU WILLGIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TO RECOVER COMPENSATION FOR ANY ACCIDENT, INJURY, LOSS OR DEATH TO YOURSELF/ OR THE MINOR, OR ANY DAMAGE/LOSS TO YOUR/ OR THE MINOR'S PROPERTY ARISING OUT OF YOUR/ OR THE MINOR'S PRESENCE AT BALANCING ACTS, OR OF ANY ACTIVITY AND PROGRAMS ASSOCIATED WITH BALANCING ACTS.

Initials of participant OR parent if under 18 are required: TO: BALANCING ACTS its affiliates and related companies, directors, officers, employees, agents, guides, independent contractors, subcontractors, assigns and representatives (collectively referred to as the "Guide") AND Her Majesty the Queen in Right of the Provinces of Alberta, British Columbia and Canada (all of whom, including the Guide, are hereinafter referred to as "the RELEASEES")

In this Release Agreement, the term "programs" shall include, but are not limited to, mountaineering, rock climbing. bouldering, ice climbing. water ice climbing. mixed climbing. hiking, waterfall ice climbing, glacier travel, sport climbing, trekking. high altitude climbing. travel, team building initiatives and exercise, canocing, kayaking and general physical exercise both outdoors and indoors. In this Release Agreement, the term "activity" shall include shall include, but are not limited to, mountaineering, rock climbing. bouldering, ice climbing. water ice climbing, mixed climbing, hiking, waterfall ice climbing. glacier travel, sport climbing. trekking. high altitude climbing. travel, team building initiatives and exercise, canocing. kayaking and general physical exercise both outdeors and indoors, nature study, snow sports, touring and all activities, services and use of facilities either provided by or arranged for by the Guide including orientation and instructional sessions or classes, transpertation, accommodation, food and beverage, water supply. rescue and first aid services, and all travel by or movement around vehicle, helicopters, other aircraft and pack animals, all-terrain vehicles, watercraft and other vehicles

Participants under 18 years of age require the witnessing and signature of a Parent or legal guardian to this document before being allowed to join and/or participate in any programs or activity hosted by the Guide

Iunderstand that it is my personal responsibility to consult with my physician prior to my participation in any programs or activity hosted by the Guide. Ialso understand that if at any time during any fitness programs, or when receiving any instruction, if I feel discomfort or strain it is my responsibility to cease the activity or program and consult with my physician.I understand that the Guide reserves the right to refuse admission to anyone that the Guide think may pose a health risk to themselves or to others. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any fitness program at or activity with the Guide.

ACKNOWLEDGMENT OF RISKS: IACKNOWLEDGE THAT THE FOLLOWING DESCRIBES SOME, BUT NOT ALL THE RISKS OF THE ACTIVITY OR PROGRAM:

1.Mountainous and steep terrain where a fall, whether roped or unroped my cause injury or death; 2. Falling rock, ice or other objects, which may cause injury or death; 3. Violent and Unpredictable weather which may cause injury due to extreme heat or cold, and which may prevent travel to, from, or within an area; 4. Unfamiliar country where I may get lost, off route or be separated from the rest of the party, including the Guide; 5. Wild and/or poisonous plants, animals, or insects which are unpredictable in nature and may affect, or attack me; 6. Avalanches which are highly dangerous and may be triggered by the activities of other people or by natural forces; 7. Remoteness of location with poor communication and inability to get rescue or medical assistance quickly or easily; 8. Illness which can be caused, among other things, by altitude, food, untreated water, plants and animals, or the difficulty of maintaining hygiene on trips; 9. Transport by public or private motor vehicle, helicopter and light fixed wing aircraft or through the use of animals; 10. Injuries sustained in physical activity indoors and outdoors including but not limited to scrapes, bruises, sprains and fractures. 11. Negligence on the part of the Releasees, including failure by the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of wilderness activities.

I understand the description of these risks is not complete and that other unknown or unanticipated risks may result in injury, illness, or death. I understand that no amount of care, caution, instruction or expertise can eliminate the inherent dangers associated with these activities or programs.

In Consideration of the Guide accepting my application and participation in the programs and activity,

, hereby acknowledge and agree to the following: In consideration of the use of and participation in programs and activities hosted by the Releasees, 1 hereby release, waive, and discharge the Releasees from any and all liability, actions, causes of action, suits, debts, statutory obligations, sums of money, claims and demands of every nature and kind whatsoever, at law or in equity, which I/ or the Minor ever had, now have, or which 1/ or the Minor may at any future time have against the Releasees, or any one or some of them, arising out of or in any way connected with my/ or the Minor's participation in any activityor program at the BALANCING ACTS, including claims that allege negligent acts or omissions of the Releasees, or claims arising from any statute, including, without limitation, the Occupiers' Liability Act. R.S.A. 2000. c. O-4 (collectively, the "Claims"

I agree to indemnify and/or totally compensate the Releasees from and against all Claims arising as a result of myor the Minor's participating in any activity or program hosted or organized by the Releasees. I agree to pay for all legal fees that are incurred as a result of any Claims made by me or on my behalf, or on the Minor's behalf, or thatare otherwise related to or caused by my or the Minor's actions or inactions.

I understand that by signing this Release Agreement, I am giving up the right to sue or make any Claim against the Releasees on my behalf or on behalf of the Minor, and that this Agreement shall be binding on the heirs, executors. administrators, assigns, and personal representatives of myself or the Minor.

If any portion of this Agreement is held invalid, I agree that the remainder of the Agreement shall remain in full legal force and effect.

I appreciate that this Release Agreement applies whether the Releasees are at fault or not and it limits the liability of all of the Releasees, notwithstanding that not all of the Releasees are formal parties to this Agreement. I understand that each of the Releasees, in securing execution of this Agreement by myself or by myself on behalf of the Minor, is acting as agent or trustee on behalf of or for the benefit of the Releasees, who shall to this extent be or be deemed to be parties to this Release Agreement.

I understand and hereby acknowledge the risks, dangers and hazards associated with the programs and activity and in consideration of my application and participation hereof, I freely accept and fully assume personally all such risks, dangers and hazards, and the possibility of personal injury. death. property damage and loss resulting therefrom.

With respect to non-scheduled or emergency evacuation, rescue, or first aid, I understand and acknowledge and freely accept and fully assume personally all expenses, costs, claims or payments related in ay way with scheduled/non-scheduled or emergency evacuation, rescue and/or First Aid and hereby acknowledge that these will not be the responsibility of the Releasees.

In consideration of the Guide accepting my application and participation in the programs and activity, I HEREBY

1. To hold harmless and indemnify the Releasees from any and all claims whatsoever that I have or may have in the future against the Releasees from any and all liability for any loss, damage, expense, or injury including death that I may suffer, or that my next of kin may suffer as a result of my participation in the programs or activity due to any cause whatsoever, including negligence, breach of contract, or any breach of any statutory or other duty of care, including any duty of care owed under any applicable occupier's Liability Legislation om the part of the Releasees, and also including the failure on the part of the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards Referred to Above; 2. I am not relying om any oral or written statements made by the Guide, whether in brochures, advertisements, written materials or in any individual conversations to lead me to become involved in the programs or activity on any basis other than my assumption of the risks involved; 3. I accept all of the risks and the possibility of death, personal injury, property damage and loss resulting from my involvement with the programs or activity that I am taking with the Guide; 4. I confirm that I have read over this agreement before signing it, that I understand it, and that it will be binding not only oj me but also on my heirs, my next of kin, my executors, administrators and assigns; 5. I confirm that I am eighteen years of age or older (younger participants must have a parent or guardian sign the release); 6. hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of Alberta and I agree that no other courts can exercise jurisdiction of this Release Agreement and any matters referred to herein; 7.I hereby hold harmless and hereby indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in the programs or activity.

Ihave read and understood this Agreement and am executing this Agreement freely and voluntarily without any compulsion on the part of the Releasees. I understand that this Agreement contains a promise not to sue the Releasees and provides for a release and indemnity for all Claims.
