WAIVER:
During participation in the Bay-CSS Family Reunion event organized by Bay Community Support Services, Inc. (“Bay-CSS”) taking place in and around Gilbert Run Park, I agree for myself and (if applicable) for the member of my family, to the following:
1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Bay-CSS or the employees, representatives or agents of Bay-CSS.
2. I recognize that there are certain risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Bay-CSS, Gilbert Run Park, the public agencies and Charles County for injury, loss or damage arising out of my or my family’s use of or presence upon the facilities of Gilbert Run Park, whether caused by the fault of myself, my family, Bay-CSS, Gilbert Run Park, the public agencies and Charles County or other third parties.
3. I agree to indemnify and defend Bay-CSS, Gilbert Run Park, the public agencies and Charles County against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use or presence in and around the facilities of Gilbert Run Park.
4. I agree to pay for all damages to the facilities of Gilbert Run Park caused by my or my family’s neglect, reckless or willful activities.
5. Any legal or equitable claim that may arise from participation in the above shall be resolved under Maryland law.
PHOTO RELEASE:
Photo/article will be used for: Promoting Bay-CSS events on the Bay-CSS website (www.baycss.org), internal Bay-CSS Employee Newsletters, Press Releases submitted to area newspapers, Email News Blasts distributed to Bay-CSS Contact List, radio and television commercials, future fundraising events, social media including but not limited to Facebook, Instagram, and Twitter, Bay-CSS Annual Report, flyers, posters and other print materials. I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SELECTING "YES" BELOW, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS, AND GIVE PERMISSION TO USE PHOTOS/ARTICLES GENERATED TO PUBLICIZE THE EVENT FOR THE PURPOSE DESCRIBED ABOVE.
