• Welcome to the Kansas Expungement Assist Tool

  • This tool is being developed for use by Kansas Legal Services (KLS) to assist persons seeking expungement. Based on the information you provide about your case, this tool is able to generate the necessary forms for you to be able to seek expungement. The forms this tool uses are based on self-help forms developed by the Kansas Judicial Council for the public. This tool does not provide legal advice.

    Once you have completed the following questionnaire, you will receive an email with draft versions of all of the forms you will need to request an expungement. Please print out these forms and review them with an attorney before submitting them to the courts. Users are encouraged to contact Kansas Legal Services if they require assistance.

    This tool has four stages:

    1. Expungement Eligibility - to begin, you will answer questions that will tell you whether it may be possible for you to get your criminal record expunged
    2. Personal Information - here you will provide information about yourself that will be used to fill out the forms you will need to send to the court
    3. Case Information - here you will fill provide details about the case you are looking to have expunged so that the courts can find your information
    4. Financial Eligibility - finally, you will have the option to answer a series of questions about your household income and receive a set of forms that will allow you to apply to remove the $195 filing fee the courts normally require in order to consider your expungement request.

    Please Note: This application will help you prepare the forms necessary to request expungement of a single criminal case (though this single case may involve multiple charges). If you are seeking to expunge multiple cases, you will need to go through this tool once for each case.

    These forms and instructions follow those created by the Kansas Judicial Council. The Kansas Judicial Council instructions state: Caution: Use of forms without the assistance of attorney could harm your legal rights. You may want to have an attorney review your completed forms before you file them with the court. These are basic forms and may not cover every situation.

  • Kansas law does not allow a Kansas court to expunge a conviction from another state or the federal court.

  • Kansas law only allows the expungement of arrest records for one of the listed reasons. Please reach out to Kansas Legal Services with any questions you may have.

  • Kansas law does not allow expungement for the listed offenses. The law may change in the future. Please reach out to Kansas Legal Services with any questions you may have.

  • Kansas law does not allow a person with pending felony charges to receive an expungement. The law may change in the future. Please reach out to Kansas Legal Services with any questions you may have.

  • Kansas law does not allow a person who has been convicted of a felony in the last two years to receive an expungement. The present rule may change or with the passage of time, this may no longer be an issue.

  • Kansas law does not allow for expungements for persons on the drug offender registry. However, a recent law has made it easier for individuals with drug convictions to be removed from the Kansas offender registry. Now, a petitioner may file a joint application to be removed from the drug registry and to have their drug offenses expunged. Please answer the following questions to determine if you are eligible for removal.

  • Kansas law does not allow for individuals who are required to register because of an out-of-state conviction or adjudication to be removed from the Kansas drug registry so long as they are still required to register under the state where the conviction or adjudication occurred. Please seek legal assistance if you have further questions about your situation.

  • A recent law has made it easier for individuals with drug convictions to be removed from the Kansas offender registry. Now, a petitioner may file a joint application to be removed from the drug registry and to have their drug offenses expunged. Currently, this expungement tool does not assist individuals in preparing the required forms for this process. Until this functionality is added, individuals interested in learning more should refer to guidance released by Kansas Legal Services and the ACLU of Kansas. 

    You may still choose to proceed through the rest of this tool and receive your expungement request forms. The forms to request removal from the drug registry are available at the Kansas Judicial Council website.

  • At this time, we are not able to determine whether you may be eligible for expungement.

    Individuals are only eligible for expungement if a certain amount of time has passed since they completed their prison sentence, completed the terms of a diversion agreement, or were discharged from probation, a community correctional services program, parole, postrelease supervision, conditional release or a suspended sentence. This wait period varies depending on the specific crime that was committed, and in some cases may change depending on what year the crime occurred. This wait period is 3 years for most misdemeanors and 5 years for most felonies, though there are exceptions in both cases. 

    Without more complete information about your date of arrest and/or the date on which you completed the terms of your sentence or diversion agreement, we are unable to determine whether you have met this requirement.
