CLIENT AGREEMENT AND LIABILITY DISCLAIMER
This Agreement is entered into between Ox Strong Health Ltd ("the Company") and the undersigned individual ("the Client"). By participating in any training sessions, plans, or programmes provided by the Company, the Client acknowledges and agrees to the terms set out below. This Agreement applies to all services, including online training plans, remote personal training, and face-to-face sessions conducted by trainers representing the Company, including but not limited to Nathan Oxford.
Purpose of the Programme
The purpose of the exercise programme is to assist the Client in achieving their health and fitness goals through structured, tailored plans. Programmes are based on the Client’s fitness level, health status, and personal objectives and will include activities agreed upon between the Client and the Company.
Participation may involve physical exertion, including an increased heart rate, muscle fatigue, and sensations of heat or discomfort. The intensity of activities will be adjusted according to the Client’s individual capabilities and goals to ensure safe progression.
Scope of Services
This Agreement applies to:
- Online Training Plans: Customised exercise programmes designed by Ox Strong Health Ltd for the Client to follow independently.
- Remote Personal Training: Virtual coaching via video calls, messaging platforms, or pre-recorded content, including guidance, motivation, and progress reviews.
- Face-to-Face Personal Training: In-person sessions conducted by Nathan Oxford or other trainers on behalf of the Company.
Types of Fitness Activities:Aerobic exercises such as treadmill workouts, cycling, rowing, agility drills, and circuit training.
Strength and endurance training using free weights, kettlebells, resistance bands, and other equipment.
Core stability, mobility, and flexibility exercises.
Fitness assessments and body composition tracking to monitor progress.
All instructions and demonstrations will be provided by the Company through appropriate means (in person or remotely). The Client is encouraged to ask questions at any time for clarification.
Acknowledgement of Risks
The Client acknowledges that participation in any physical exercise programme involves inherent risks, including but not limited to:
Minor Injuries: Soreness, strains, sprains, or bruising.
Serious Injuries: Torn ligaments, muscle tears, herniated discs, or cardiovascular issues such as heart attacks or strokes.
Catastrophic Injuries: Rare but severe events, such as paralysis or death.
The Company and its trainers, including Nathan Oxford, will take all reasonable precautions to minimise these risks. However, the Client accepts full responsibility for their participation and acknowledges that the Company cannot guarantee complete safety.
Medical Considerations
The Client confirms that they are in good physical and mental health and have no condition or impairment that would prevent their safe participation in the programme.
The Client agrees to disclose any medical conditions, injuries, or medications that may affect their ability to engage safely in the programme.
If medical clearance is required (e.g., for injuries, conditions, or contraindications), the Client agrees to provide written confirmation from a qualified healthcare professional.
The Client acknowledges that the programme is not medically supervised. Any exercise modifications required for health reasons will only be made based on information provided by the Client.
Client Responsibilities
The Client agrees to:
Follow all instructions and advice provided by the Company and its trainers.
Cease any activity immediately if it causes pain, discomfort, or unusual symptoms, and notify the Company.
Use their discretion in adjusting weights, resistance, or intensity to maintain comfort and avoid injury.
Actively participate in maintaining their safety during exercise sessions.
Data Protection and Privacy
The Company complies with the UK General Data Protection Regulation (GDPR). The Client's personal data, including health information, will be stored securely and used solely for the purpose of designing and delivering the exercise programme.
The Client consents to being added to the Company’s mailing list for updates and programme-related communication. The Client may opt out at any time.
The Client’s information will not be shared with third parties without their explicit consent, except where required by law.
Touch and Physical Contact (Face-to-Face Sessions)
The Client consents to reasonable physical contact during in-person sessions conducted by Nathan Oxford or other trainers representing the Company. Physical contact will only occur to correct form, posture, or alignment and will be conducted respectfully and professionally.
Limitation of Liability
The Client agrees to release and discharge Ox Strong Health Ltd, its directors, employees, and representatives (including Nathan Oxford) from all claims, damages, or causes of action arising from their participation in the programme. This includes injuries, illnesses, or adverse outcomes resulting from the programme, except in cases of gross negligence or wilful misconduct by the Company.
The Client acknowledges that the Company is not responsible for any injuries or incidents occurring:
As a result of failing to follow provided instructions.
During unsupervised activities performed independently by the Client.
Due to undisclosed medical conditions or impairments.
Programme Objectives and Guarantees
The Client understands that the programme is tailored to meet their specific fitness objectives. However, the Company makes no guarantees regarding the achievement of these goals, as outcomes depend on factors such as the Client’s adherence to the programme, effort, and consistency.
Jurisdiction
This Agreement is governed by the laws of England and Wales, and any disputes shall be resolved exclusively in the courts of England and Wales.
Acknowledgements
By signing this Agreement, the Client confirms that they:
Have read and understood the terms of this Agreement.
Understand the inherent risks associated with exercise programmes and voluntarily assume those risks.
Have had the opportunity to ask questions and receive satisfactory answers.
Are in good physical condition and have disclosed all relevant medical information.
Understand they can withdraw from the programme or any activity at any time.
Parent / guardian - additional information
In signing this form, I the parent/guardian of the aforementioned child, affirm that I have read thisform in its entirety and I have answered the questions accurately and to the best of my knowledge. I understand that my child is responsible for monitoring him or herself throughout any activity, and should any unusual symptoms occur, would cease participation and inform the instructor.
In the event that medical clearance must be obtained prior to my child’s participation in an exercise session, I agree to contact the GP and obtain written
permission prior to the commencement of the exercise activity, and that this permission be given to the instructor. I understand that if my child fails to behave in a manner that is polite and social, he or she could be suspended from the course.
