1. General Terms
a. The Consignor signing this agreement is the owner or has full rights granted by the owner of the merchandise being submitted for consignment to sell said items by way of consignment, and has the legal right to enter into this Agreement.
b. The Company has the right to accept or decline any items submitted for consignment. Submission of consignment includes on-location pick-ups, drop-offs, or consign-by-mail.
c. The Consignor understands that consign-by-mail will default the account’s settings to donate declined items, as the Company does not return declined items by mail.
If the declined items were consigned by pick-up or drop-off the Consignor has the option to pick up the declined items. All decline item pick-ups must happen within 14 business days of the email receipt of your consignment report. Any items not picked up within or on the fourteenth (14th) business day will be relinquished to the Company.
d. All Consignors are given a consignor login to actively monitor if their items have sold. This will be prompted by email to the provided email address on this agreement form.
e. All information signified with red asterisks (*) means it requires information. Any form submitted without the required information will be voided.
f. The Company reserves the right to deny new consignors if representatives of the Company feel threatened by words or actions of an in-person, verbal, or written interactions with the Consignor.
g.The Company is responsible for maintaining the industry minimum to a maximum requirement of coverage for consigned merchandise, but insurance of each individual item’s exact worth and value to the Consignor is the sole responsibility of the Consignor, and the Company is not responsible for any lost, stolen, or damaged items caused by others not associated with the Company or natural wear and tear of each consigned items over their duration of being for sale.
h. Every item consigned under this Agreement has a maximum selling time of two (2) years. The selling time describes the duration of time each item has to sell before the Consignor can pick up their unsold items.
i. Each item consigned can be picked up after one (1) year minimum by the Consignor. This minimum does not apply to consign-by-mail, read on to learn more about consign-by-mail.
j. After the two (2) year term stated in 1h the consignor has thirty (30) calendar days to pick up their items before they are relinquished to the Company.
k. At any time the Company can decide to use consigned merchandise for marketing events such as; studio photoshoots, pop-up shop inventory, fashion shows, etc. all in effort to sell the Consignor’s merchandise.
l. It is free to consign with the Company.
2. Pricing & Processing Time
a. All pricing is at the discretion of the Company and will be evaluated within three (3) business days of the items’ retrieval or delivery for all consignment procedures: on-location pick-ups, drop-offs, or consign-by-mail.
b. Consigned items are priced by condition, age of the garment/accessory, style desirability at the time of consignment, and the original retail price.
c. The Company’s consignment programs are free, with the exception of the Consignor being responsible for purchasing the shipping label for consign-by-mail.
d. Once items are posted online the Company’s fees are added to the sale price. These fees are not included in the Consignor’s payout amount. These small fees paid by the customer purchasing the item(s) cover expenses the Company accrues to operate the business online.
e. There is a three (3) business day processing time after a consignment batch is received. After that, there is a seventy-two (72) hour period before publishing accepted items for sale online or in-store. If the Consignor no longer wishes to consign an accepted item(s) after the processing time the Consignor needs to inform the Company as soon as possible by email to nataliattired@gmail.com within the seventy-two (72) hour period before the item(s) are published for sale.
f. Any declined items that are opted in to donate will be donated within seven (7) business days to a charity of the Company’s choice.
3. Consign-by-mail
a. The Consignor understands if they are consigning by mail or cooperating in the ‘consign-by-mail’ program their declined items are automatically donated.
b. The consignor is responsible for the cost of their own shipping label to the Company.
c. All consign-by-mail shipments from the Consignor are to be sent to the Company’s showroom located in Denver, Colorado, USA. The address will be made available to the consignor once they have signed and submitted this form. The information is made available on the Company’s website.
d. The Consignor can send their consign-by-mail batch(es) at their leisure. The processing time stated in section 2e. is applicable after the batch(es) are received by the Company.
e. The Company is not responsible for any merchandise/items sent to them when under the care of the delivery service or courier. The Consignor can use their own discretion when picking a delivery service and packing their items for shipment. If items arrive damaged the Company is not responsible. Purchasing insurance for consign-by-mail packages is encouraged.
f. It is up to the Consignor to keep track of what items they have sent to consign-by-mail. The Company will share what items they are accepting for consignment, but will not list what items if any were declined and donated.
4. Pick-ups & Drop-offs
a. Pick-ups of consignment batches can be scheduled by emailing the Company at nataliattired@gmail.com or by phone if the Consignor has been given the Company’s contact phone number.
b. The Consignor does not need to be there in person when the Company conducts a pick-up. It will be preplanned between the Consignor and the Company where the items will be and the time of pick up. The Company’s representative picking up the batch will confirm the pick up by sending a picture via text message to the Consignor.
c. The Company is not responsible for what could happen to the items left for pick-up when unattended. The Consignor has a choice to stay with their items or leave the items in a safe but visible area for the Company’s representative to pick them up. Leaving the items unattended is not mandatory and the Consignor should use their discretion. If the items are not there by the time the Company’s representative arrives for pick-up they will make the Consignor aware right away.
d. Drop-offs are another way to consign with the Company. Just like pick-ups, drop-offs need to be scheduled, unless the Company has a storefront, in that case drops off can happen anytime during business hours, this information can be found on the Company's website. You can schedule drop-offs by email or phone. Refer to section 4a for the Company’s email.
5. Privacy Terms
a. The Company needs the Consignor's email, phone, and address in order for them to create an account. We do not use the Consignor’s information for any other purpose than to create an account, and communicate with them about their consigned items.
b. From time to time in this industry there may be investigations launched by law enforcement if a third party individual suspects items of theirs have been stolen. The Company by law has to comply with law enforcement if there is an open case involving items for sale by the Company.
