Admission Agreement

Daycare is a cage-free service designed for social dogs to play and have fun. Safety is our primary goal, therefore, daycare is not for every dog. It is not a place for aggressive dogs to learn how to be social. Owner Drop off and Pick up times are between 7:30am and 4:30pm.

To be accepted into our daycare program, each potential daycare guest must:

1. Complete this Daycare Application Agreement

2. Meet our vaccination and temperament standards (assessed on a regular and ongoing basis)

3. Preferably be spayed or neutered (Please see Section 2 of Marley & Bear’s Terms and Conditions below)

4. Commit to a regular weekly ongoing booking and agree to our Terms and Conditions.

To ensure the health and safety of your dog and all other guests, we require that all of our clients agree and comply with the following terms and conditions. These termas and conditions form part of the conditions of entry to Marley & Bear's:

1. I specifically represent to Marley & Bear’s that I am the legal owner of my dog. In addition, my dog is healthy, my dog meets Marley & Bear’s vaccination standards, my dog has not harmed or shown aggression or threatening behavior towards any person(s) or other dog(s) and has not been exposed to any known communicable disease within the 30 period immediately prior to admission to daycare. I further represent that each time my dog is brought to Marley & Bear’s, I will be recertifying that my dog is in good health and has not had any communicable illness of any kind for 30 days prior to admission. I further agree to inform Marley & Bear’s of any changes in my dog’s condition and/or behavior prior to any daycare visit.

2. If your dog is not spayed or neutered (we are aware vets recommend waiting until 12-18 months for some breeds) we will still consider them for daycare but we will be unable unable to accommodate your dog if she is either on heat or if your male dog is displaying any dominant / sexual behaviours. (Please note new changes to the Dog Act 1976 (Stop Puppy Farming Bill) coming soon)

3. I confirm my dog is required to be fully vaccinated (including Distemper, Parvovirus, Kennel Cough (Bordetella/Broncheptica), Andovirus or Hepatitis and Heartworm prevention) and I will provide Marley & Bear’s with proof thereof from my veterinarian. I agree to provide Marley & Bear’s with annual updates of my dog’s vaccination records. I acknowledge that it is my responsibility to ensure that my dog continues to be fully vaccinated and that Marley & Bear’s reserves the right to remove my dog from the facility if it is not fully vaccinated.

4. I understand that my dog must have flea protection in the form of a topical liquid such as K9 Advantix, Advantage or Frontline. I acknowledge that flea collars are not acceptable. I understand that my dog will be inspected for fleas when entering Marley & Bear’s and will be refused entrance if fleas are found. I further acknowledge that Marley & Bear’s shall not be held responsible if my dog contracts fleas while at Marley & Bear’s because proper flea protection is my responsibility.

5. I understand that the leash-free environment at Marley & Bear’s provides dogs the opportunity to play in close physical contact, including with their teeth and paws. I acknowledge that no amount of supervision or personalised care by Marley & Bear’s, its agents or employees, can prevent the possibility of injury or illness to my dog.

6. Illness and Injury are an assumed risk when dogs interact. Owners are soley responsible for their vet bills and any associated costs. I accept the risks involved and agree that I am solely responsible for any damages that result from injuries caused by my dog while at Marley & Bear’s. I agree to indemnify and hold harmless Marley & Bear’s from any and all claims, liabilities, costs and expenses, including court costs and legal fees, arising out of any harm, injury or damage caused by my dog to other dogs, persons or property.

7. I authorise Marley & Bear’s to do whatever is deemed necessary for the safety, health and wellbeing of my dog and I agree to assume full financial responsibility for any and all medical expenses incurred.

8. I expressively wave and relinquish any and all claims against Marley & Bear’s, its employees, agents, and representatives for any injury, illness, or harm to my dog. Under no circumstances will Marley & Bear’s be liable for consequential damages or damages beyond the replacement value of my dog. I agree to indemnify and hold harmless Marley & Bear’s from any and all claims, liabilities, costs and expenses, including court costs and legal fees, arising out of any harm, injury or damage caused to my dog by other dogs, persons or property.

9. I understand Marley & Bear’s reserves the right to refuse admittance to any dog that displays signs of untreated or potentially contagious conditions, demonstrates aggressive behavior, or who fails our standard health and temperament standards. I further understand and agree that any problems that develop with my dog will be treated as deemed appropriate by the staff of Marley & Bear’s, in their sole discretion.

10. I acknowledge and agree to my dog/s photos being used on Social Media sites and that my acceptance will be deemed as a weekly ongoing booking (or fortnightly by prior arrangement) and I agree to Marley & Bear's cancelation conditions and charges.

11. All non regular Daycare dogs must have completed one months day Daycare trial and one Overnight trial (at the current rates) before being accepted for a Sleepover / Holiday.

12. Overnight stay dates will not be confirmed until a 30% non refundable deposit or full payment is received. Full payment is requjired 7 days prior to the stay. All deposits are non refundable

13. Our cancellation charges will be calculated as follows:-

We require a minimum of 2 full weeks notice when cancelling a permanent regular booking. Failure to give the required notice will result in charges equal to, but not exceeding, the usual rate for cancelled bookings within the 2 week period.

Single Day Daycare Cancellations:-

More than 1 weeks notice - No charge

Less than 1 weeks notice - $10 admin fee

Less than 48 hours notice - 50% charge

Less than 24 hours - 100% charge

Overnight Cancellations:-

All deposits are non refundable

More than 2 weeks + $25 admin charge

Less than 2 weeks + 25% charge

Less than 7 days + 50% charge

Less than 24 hours + 100% charge

14. I agree to abide by Marley & Bear's current Drop Off and Pick Up times. A late fee of $10 per half hour (or part of) per dog will be made for any dog left after 4:30pm. When changes occur, please contact us or email admin@marletandbears.com. This will enable us to make sure staffing is available.

15. Marley & Bear's gives a four booking grace period for cancelation of bookings. If you cancel your regular day for four consecutive bookings, Marley & Bear's reserves the right to cancel your permanent regular booking. This is for waitlist and placement reasons.

16. In the event any provision of this agreement is declared by a court of competent jurisdiction to be unenforceable, the remaining provisions shall remain in full force and effect.
