NOTE: THIS FORM MUST BE READ AND SIGNED BEFORE THE PARTICIPANT IS PERMITTED TO TAKE PART IN ANY EVENTS WITH TEXAS DAWGS BASEBALL, INC., D/B/A TD EDGE BASEBALL INCLUDING BUT NOT LIMITED TO ANY ORGANIZED TEAM PRACTICES, GAMES, COMPETITIONS OR OUTINGS. BY SIGNING THIS AGREEMENT, THE PARENTS(S)/LEGAL GUARDIANS OF THE PARTICIPANT AFFIRM(S) HAVING READ IT, UNDERSTANDING IT AND UNDERSTANDING THAT IT WAIVES CERTAIN LEGAL RIGHTS.

IN CONSIDERATION of being allowed to participate in the TD Edge Baseball Organization under the auspices of Texas Dawgs Baseball, Inc., I/We, the undersigned, parents(s)/legal guardian(s) of the Participant acknowledge, understand, and agree that: 1. I RISK BODILY INJURY, INCLUDING PARALYSIS, DISMEMBERMENT, DISABILITY AND DEATH, AND while particular rules of the sport, skills, equipment, and personal discipline may reduce this risk, THIS RISK OF SERIOUS INJURY DOES EXIST, AS WELL AS THE RISK OF DAMAGE TO OR LOSS OF PROPERTY; and, 2. I/WE RISK CONTRACTING THE COVID 19 VIRUS BY BEING INVOLVED IN ACTIVITIES OF THE TEXAS DAWGS BASEBALL, INC. OUTSIDE OF QUARANTINE DURING THIS TIME OF PANDEMIC; and, 3. I/WE KNOWINGLY AND FREELY ASSUME ANY AND ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERS, and assume full responsibility for the Participant’s participation; and, 4. I/We willingly agree to comply with the stated and customary terms and conditions for participation by the Participant. If, however, I/We observe any unusual significant hazard during the Participant’s presence or participation, or if I/We observe any concern in the Participant’s readiness for participation, I/We will immediately bring such to the attention of the nearest official and remove the Participant from participation; and, 5. I/We, FOR MYSELF/OURSELVES AND THE PARTICIPANT, and on behalf of my/our heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY, HOLD HARMLESS and PROMISE NOT TO SUE TEXAS DAWGS BASEBALL, INC., their officers, directors, coaches, officials, volunteers, employees, agents, and/or other participants, sponsors, advertisers, and, if applicable, the owners and lessors of premises used for the activity ("RELEASEES"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, and/or LOSS OR DAMAGE TO PERSON OR PROPERTY, INCLUDING AS A RESULT OF CONTRACTING COVID-19 WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, EXCEPT THAT WHICH IS THE RESULT OF GROSS NEGLIGENCE OR WANTON MISCOUNDUCT, to the fullest extent permitted by law. I/We have read this Release of Liability and Waiver Agreement, fully understand its terms, understand that I/We have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.

Participants, or their legal guardian(s), in TD Edge Baseball events agree to be filmed and photographed by photographers authorized by Texas Dawgs Baseball, Inc. I/We, as parent(s)/legal guardian(s) hereby give to Texas Dawgs Baseball, Inc. the right to use the Participants and their name, picture, and likeness (without any right of approval) for any use to promote the event in which they participate as well as to promote future events and activities of TD Edge Baseball. The duration of this authorization shall commence with registration for the event and continue before, during and for sixty (60) months after the period of participation in any TD Edge Baseball event.
