I the undersigned, agree as follows: 1. I assume all risk of injury or illness to me resulting from, or arising out of, my participation in the Activity. I acknowledge that Aina Momona, and their respective affiliates, employees, agents and clients (collectively, the “Group”) are not responsible for any injury or illness I may suffer in connection with my participation in the Activity. I, for myself, and my (singularly and collectively) heirs, executors, administrators, trustees, legal representatives, successors and assigns hereby fully release and discharge the Group from any and all claims, charges, demands, sums of money, actions, rights, causes of action, obligations or liabilities, resulting from, or arising out of, my participation in the Activity, including but not limited to claims related to injuries, illness or property damage, and including but not limited to claims caused by any negligence (active or passive) of any member of the Group. 2. I hereby grant to Aina Momona and their respective licensees, successors and assigns and to other such persons as Aina Momona may designate from time to time, (the “Licensed Parties”) the right and permission to: (a) interview, film, photograph, videotape and otherwise record me and to record my voice, conversations and sounds in and in connection with the Activity (collectively the “Recordings”) and (b) use, publish and exhibit without restriction, limitation or further compensation to me the Recordings, my name, photograph, likeness, image, appearance, voice and statements made or created in connection with the Activity for any and all legal purposes whatsoever, including without limitation advertising, publicity and trade purposes, in perpetuity, in any and all media now known or hereafter developed throughout the world, without restriction as to frequency, in any manner or form and by any means available, with or without other materials, including without limitation advertising copy, in Aina Momona's sole discretion. I acknowledge and agree that Aina Momona shall be the absolute owners of all Recordings and all materials into which the Recordings are incorporated, as well as all rights, title and interest therein, including the copyright. 3. To the extent applicable to me, I expressly waive and release any rights or protections I may have under Hawaii law that would otherwise limit the scope of this release or the enforcement of this agreement, and I agree that this waiver is intended to include all claims, if any, which I do not know or suspect to exist in my favor and that this release extinguishes those claims. If the participant is a minor, a parent or legal guardian must sign this waiver on the minor's behalf. ACCEPTED AND AGREED
