TERMS & CONDITIONS It is understood that Candice Floyd, of Owen J. Roylette Photography, is the exclusive, official photographer retained to perform the photographic services requested on this purchase form. Requested items must be paid prior to goods being delivered. Balances may be paid via Zelle (662-752-9271) or Cash App [+ $5 fee] ($CandiceJaneen). No part of any order, including digital images, will be delivered until the order balance has been paid in full. The 7% tax has been included in all packages. The content of the gallery is at the discretion of Candice Floyd and Owen J. Roylette Photography. Candice will select the best images, edit them to her discretion and post to your team's photo album for your viewing. Any further editing or culling will be subject to fee. REGARDING DIGITAL IMAGES: Proof (watermarked) action and head shots are/will be located within your team's photo album. Digital final images will be delivered within 5 business days of payment. Digital memory photos will not be created until after the payment is received. Final digital images purchased will be delivered either via text message and email. If the Client loses or damages his or her digital images, Owen J. Roylette Photography will not be liable for such loss or damage and will not replace lost or damaged files. It is highly recommended, by the Photographer, that clients immediately back-up any digital files on an external drive or via online cloud storage. Digital images purchased by the Client still remain the property of Owen J. Roylette Photography and may not be altered in any way, shape of form, including but not limited to editing the overall style of image, color/contrast/exposure changes, cropping portions of the images, adding objects/persons/graphics and deleting objects/persons/graphics. REGARDING PRINTED IMAGES: Proof (watermarked) action and head shots are/will be located within your team's photo album. Printed final images will be delivered within 7 days of payment. Printed posters and memory photos will not be created until after the payment is received.
Copyright, License To Use, and Model Release: It is understood that Owen J. Roylette Photography owns the copyright to all of the Digital Images and reserves the right to use them for display, publication, advertising or other purposes on her social media platforms and West Georgia Youth Sports - Lithia Springs social media platforms and webpage. If you do not wish for your child's digital image to be displayed, the parent/guardian is obligated to let the photographer know within 48 hours of submitting final payment. Upon receipt of final payment, the Client is granted a Non-Exclusive Unlimited print release, allowing the client to print the purchased images for their own personal use. Images may not be altered (i.e. applying a filter), cropped, sold, or submitted for publication. Images from your session may be shared on social media accounts. I would be so honored if you would tag photo credit to Candice Floyd (Candice Travis) and Owen J. Roylette's Photography's social media accounts (i.e. if posting on facebook you tag Candice Floyd facebook account and Owen J. Roylette Photography page, if posting on instagram you tag the @owenjroylettephotography instagram account). Something like this can really help a small business like myself. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce negatives, digital images and printed photographs elsewhere without Owen J. Roylette Photography’s permission, in the form of a Print Release, and violators of this Federal Law will be subject to its civil and criminal penalties. Owen J. Roylette Photography will retain the full copyright on all images (including digital files) and reserves the right to display, publish/etc. for any reason. Clients are prohibited from further editing of images. Clients may not, for any reason, sell their images to any third party. Clients will be granted printing rights for the images and are allowed to download and use digital files for printing purposes. I hereby give to Owen J. Roylette Photography, the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child(ren) in which she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, contests, advertising and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
