1) You enter and use this buyer undercover unloading facility at your own risk.
2) By entering and allowing your vehicle to remain in a designated unloading bay, you consent to these terms and conditions of entry. If you do not accept these terms and conditions of entry, you must not enter the designated loading bay.
3) You must:
3.1. Only park your vehicle in designated bays that are appropriate for your vehicle and not park in any area which is not designated for your use,
3.2. Park your vehicle wholly within the appropriate marked bay, and
3.3. Comply with all parking signs, permit zones and directions issued to you by PMGL or its authorised officers.
4) The primary purpose of PMGL providing undercover bays is to facilitate consollidation and loading of produce during CTA Market Operating Hours;
5) Bays are only permitted for exclusive use between 5:00am and 12:00pm on weekdays;
6) Vehicles must not stay in excess of twenty-four (24) hours without the approval of PMGL (otherwise they may be deemed as abandoned).
7) Bays are not allocated for exclusive use on weekends and only the Eastern Buyer Bays are available for non-exclusive use on Sundays.
8) PMGL reserves the right to change bay availability at any time to meet safety or Perth Market Site management requirements.
9) PMGL will allocate bays at its discretion, taking into account historic and expected usage patterns as well as compliance with the Market Rules, and the payment of fees.
10) Bays are available to registered or Authorised Transporters and Growers only who must also possess an Access Card.
11) Bays are available for use during official CTA weekday "open" times only.
12) Bays are to be clear of all items (including produce, pallets, forklifts) by 12:00pm each weekday or other such time as designated by PMGL.
13) Vehicles not complying with these car park/loading bay terms and conditions of entry may be issued with a parking breach notice and PMGL may claim damages from you.
14) PMGL or its authorised officers may, acting reasonably, direct the immediate removal of any vehicle from a car park in their sole discretion and without prior notice to you.
15) If your vehicle is towed away or impounded, you will be charged a fee for its release. You must call (08 9456 9215 to release your vehicle.
16) PMGL is not responsible or liable for any of the following:
16.1) Injury to you or anybody else,
16.2) Damage to, destruction of, theft of or unauthorised delivery up of your vehicle or any other vehicle (authorised or not), and/or
16.3) Damage to, destruction of, theft of or delivery up of any property (including anything in or on your vehicle or any other vehicle) however caused.
17) You indemnify and release PMGL in respect of any claim made against PMGL as a consequence of, in relation to, or in any way arising out of, your use of this car park.
18) Buyers must maintain Motor Vehicle and Public Liability insurances. Copies of these insurances may be requested by PMGL from time to time and are to be provided without undue delay.
19) All visitors without an access card or parking permit must report to the Gate House at the Bannister Road entrance or go to PMGL reception.
20) Unless approved by PMGL in writing, each Person is prohibited from using the Buyers Bays, Common Areas and other areas within the Market City Site as a staging post for the transshipment of Goods, ultimately to a destination outside of the Market City Site to Persons who are not Tenants of the Market City Site to Persons who are not Tenants of the Market City Site.
20.1) A Person, other than a CTA Tenant, is prohibited from using the Common Areas, including Buyers Bays as a staging post for the Sale or delivery of Goods to Persons who are not Tenants, including to ultimate destinations outside the Site, unless approved in writing by PMGL in accordance with this Guide.
20.2) Only Goods purchased from a CTA Tenant shall be delivered to Buyer Bays. All items must be accompanied by a valid consignment note.
20.3) Under no circumstances are Goods to be delivered to a Buyer on Site direct from a Grower, Secondary Wholesaler, Supplier or Transport Operator who is not a Tenant.
20.4) Any person found Transshipping on the Site will be requested to remove the Goods immediately and may have their access to Site withdrawn.
21) You acknowledge that PMGL uses surveillance cameras around the Market City site, and acknowledge that recording of the undercover unloading facility of your bay may occur. You consent to any such recording.
22) The PMGL Site Rules apply to all users of this car park and will form part of these terms and conditions of entry. You may access copy of the PMGL Site Rules at www.perthmarket.com.au or by contacting Reception on (08) 9456 9200.
23) These terms and conditions of entry are in addition to any other terms and conditions that apply to your Market City access card or PMGL parking permit (as the case may be).
24) PMGL requires thirty (30) days written notice to cancel any Buyer Bay. Please submit cancellations in writing to property@perthmarket.com.au.
