Payment. Your first payment will be drafted on the date indicated above and will continue to be drafted on the same day of each following month for the duration of the membership. Membership automatically renews on a month-to-month basis, unless cancelled, terminated, or suspended. You authorize Operator (and its successors and assigns) to process credit card, ACH, or any other payment method transactions according to the membership type and payment method selected above. This authorization will remain in effect until this agreement is terminated, suspended, or cancelled by the process detailed below. You agree to notify the Shop (defined below) of any changes to your payment information. Membership Benefits. Membership entitles you to receive one or two blowouts, based on the membership type selected, at your then-current standard monthly membership rate each month. Unused blowouts rollover each month as long as your account remains active and in good standing and unused blowouts may be used up to 90 days after the termination of this agreement, except as otherwise stated herein. You will not be entitled to a refund or any other reimbursement upon the expiration of prepaid blowouts. Members of The Barfly Double may share unused prepaid blowouts with a companion if the member and companion schedule their appointments together at the Shop. Any Free Add-ons or Anniversary Gifts are subject to availability and can only be redeemed at the Shop identified below. There may be additional membership benefits as determined by the Shop. You may use your unused prepaid blowouts at other participating Drybar® shops in the United States, subject to the terms and conditions set forth in this agreement. If you do not have any unused prepaid blowouts at the time of service, you will pay that shop’s then-current standard membership rates for the services. Documentation requirements and prices may vary (including based on location), and additional charges may apply among participating Drybar® shops. Notwithstanding the foregoing, each Drybar® shop is independently owned and operated. Except as otherwise stated herein, this membership and any prepaid blowouts are not assignable or otherwise transferable and are personal to the undersigned. Membership Cancellation and Termination. Memberships must be canceled via email on our Contact Us page. To cancel your membership, please send your name, phone, email and the date you'd like to cancel via email on our Contact Us page. To cancel this membership, a completed Cancellation Form must be submitted via email at Operator’s designated email address at least 72 hours prior to the next monthly payment date, or other notice as required by law. Cancellation will go into effect 3 business days/72 hours minimum and may take up to 10 days after Operator receives notice. In the event of failed payment or inappropriate conduct by you (as determined by Operator), Operator reserves the right to terminate your membership, which will be effective immediately. Operator may freeze your membership at any time, and from the date of the freeze until the membership is resumed or terminated by Operator, payment will not be drafted and blowouts will not accrue. Operator may terminate or suspend membership for violating Shop rules or the terms of this agreement (including for payment noncompliance). Upon suspension, all aspects of your membership will stop until and unless Operator allows your membership to resume. Operator will notify you if Operator allows you to resume your membership. If so, you may choose to resume a membership at the then-current membership rate and you must execute the then-current Membership Agreement. Unused prepaid blowouts will be forfeited and not refunded upon termination for inappropriate conduct. Appointment Cancellation. You may cancel up to 12 hours before the start of your appointment. By entering your credit card information, you agree to accept a $25 cancellation fee if you cancel within 12 hours of the start of your appointment. For group appointments of 3 or more, your card will be charged for any in the party who cancel within 12 hours. If you need to cancel or change your appointment, it's easy to do so, call your local shop directly, and/or cancel on the app or website. If you no show/or no call your appointment, you will be charged the full cost/price of your appointment. For group appointments of 3 or more, your card will be charged the full cost/price of the group appointment if they no show. Barfly Members will be charged one blowout benefit on your membership,. If no blow out benefit is present on your account, then you will be charged the current Member price of a blowout to the credit card on file. If you need to cancel or change your appointment, it's easy to do so, call your local shop directly, and/or cancel on the app or website. All applicable appointment cancellation charges will be automatically drafted from your payment method on file and are not refundable. Terms and Conditions. Subject to applicable law, Operator reserves the right to increase your standard monthly membership rate upon thirty (30) days’ written or electronic notice to you. Unless you complete the proper cancellation procedures above, you will incur the increased monthly membership rate on your next monthly auto payment date following the end of the notice period. Operator reserves the right to transfer or assign all or any part of its interest, rights, privileges, duties, and obligations hereunder to any person or legal entity without notice to you or your approval. You acknowledge and agree that this agreement shall be binding to the fullest extent permitted by law. This agreement is subject to applicable law in the jurisdiction where the Shop is located and such applicable law will prevail in the event of any conflict with the terms and provisions of this agreement. If any term or provision of this agreement is deemed to be invalid, illegal, or unenforceable, all other terms and provisions will remain in full force and effect and such invalidity, illegality, or unenforceability will not invalidate or render unenforceable such term or provision in any other jurisdiction. This constitutes the entire agreement between the parties and supersedes all prior or contemporaneous proposals, agreements, representations, statements, negotiations and understandings, whether oral or written, between the parties concerning the matters set forth in this agreement. By submitting below, I expressly authorize Operator to conduct the payment transactions specified above and hereby agree to all terms and provisions set forth in this agreement. Disclaimer. The Shop identified above is independently owned and operated by the Operator. Neither DB Franchise, LLC (“DBF”) nor any of its parents, subsidiaries, or affiliates, is the owner or operator of the Shop or a party to this agreement, nor are contractually or otherwise liable to you, the Member identified in this agreement. Please be advised your personal information (including but not limited to visit history, buying habits, personal preferences, and the contact information provided in this agreement) may be shared with DBF, its affiliated companies, approved third-party vendors, and other Drybar® locations for various purposes, including but not limited to marketing and providing, maintaining, and improving services at Drybar® locations.
