This agreement is between Molly Hunter Photography, LLC (hereinafter referred to as Molly Hunter) and the undersigned (referred to as “Client” and “I”).

“Images” means all visual representations furnished to Client by Molly Hunter, whether captured, delivered, or stored in photographic, magnetic, optical, electronic, or any other media.

{1} Model Release*

I hereby grant Molly Hunter irrevocable and unrestricted right to use and publish images of the client and anyone photographed from the event for editorial, trade, advertising, web site promotion and any other purpose and in any manner and medium without compensation; and to copyright the same. Client hereby releases Molly Hunter and assigns from all claims and liability relating to said photographs.

{2} Photographic Integrity*

Molly Hunter's style and aesthetic should be reviewed before booking. A complete portfolio demonstrating this style and aesthetic can be viewed at www.mollyhunterphotography.com. Unless deemed a special circumstance, unedited images will not be given. This ensures that all images by Molly Hunter maintain the style and photographic integrity of the creator. Molly Hunter will select the best images and edit them to her discretion. Any further editing or culling will be subjected to a fee.

{3} Delivery*

Images will be delivered 2 weeks after the date of the session. Images are delivered as an instant digital download via a personal gallery. Discs, usb drives, and any print or a la carte items are available for purchase. The content of the gallery is in discretion of Molly Hunter.

{4} Usage*

All images and rights relating to them, including copyright and ownership rights in the media in which the images are stored, remain the sole and exclusive property of Molly Hunter. Usage licenses will be negotiated on an individual basis. Images released to Client are to be used for personal printing and display only, any other use of images is a violation of copyright. No printing rights are transferred to Client until payment has been received in full by Molly Hunter. The parties agree that any use of any image without the prior permission of Molly Hunter will be invoiced at three times the customary fee for such usage, and refusal to cooperate may lead to litigation. Digital files may contain copyright and other information embedded in the header of the image file or elsewhere; removing and/or altering such information is strictly prohibited and constitutes violation of the copyright act.

{5} Copyright*

Client hereby expressly consents to the jurisdiction of the federal courts with respect to claims by Molly Hunter under the copyright act of 1976, as amended, including subsidiary and related claims.

{6} Payments and Cancellation*

This contract between Molly Hunter and Client will not become effective until it is signed and the initial amount due has been paid. At the time the contract takes effect, Molly Hunter will reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that Client cancels the contract for any reason, all monies paid will be retained by Molly Hunter in order to offset its loss of business. Any remaining portion of the session fee is due at the time of the session. If the session fee is not submitted at the time of the session, a 24 hour window will be granted for Client to submit the balance. No images will be edited prior to balance being submitted. After such time, the images from the session are subject to being permanently deleted if balance is not paid.

{7} Penalty Fees and Charges*

There is a $25 charge for payments returned by the bank for any reason. There will be a $15 late payment fee for any payments that are not delivered to Molly Hunter by the required date.

{8} Non-Guaruntee*

Although every possible care will be taken to produce beautiful photographs during the photo session, Molly Hunter cannot place an unconditional guarantee on the above. She will not be held responsible for any ruined photographs due to any cause in or outside of her control.

{9} Performance*

The performance of this contract on behalf of Molly Hunter shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

{10} Limited Liability*

In the unlikely event of severe medical, natural, or other emergency it could be necessary to retain a different photographer. Molly Hunter will make every effort to secure a skilled replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the photo session. Molly Hunter takes the utmost care with respect to exposure, transportation, and processing the photographs including using professional grade equipment and professional grade backup equipment. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond Molly Hunter’s control, her liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost.
