  • Parma Animal Shelter ("PAS") Foster Application Volunteer & Non Volunteer

    Fostering a pet is a responsibility and a privilege. As consideration for being provided this opportunity, I agree as follows:

    1. Care of animal. I agree to act as a Foster for PAS by providing temporary care for PAS animals (the "PAS animal" This agreement applies to any animal placed with me by PAS. As a Foster, I will provide the PAS animal with high quality care, including but not limited to food, a clean living area, protection from heat, cold and the elements, dry bedding, daily exercise, and curative and preventative medical care. I shall ensure that the PAS animal is wearing an identification tag at all times. I shall keep the PAS animal confined or securely leashed at all times, and shall not allow the PAS animal to run free outdoors. I shall not permit the dog to be present at a dog park or participate indog daycare/playgroup without previous written permission from PAS. I will immediately notify PAS if the PAS animal is sick, injured, lost, bites, has a change in behavior, or dies.

    Medical care, food and supplies, if needed (e.g., crate, toys, etc, for the PAS animal will be provided by PAS.I agree that all such items are and remain the property of PAS. I understand that I may choose to provide supplies directly to the PAS animal at my own expense, and that I will not be reimbursed for such expenditures. I understand that medicines and other supplies provided by PAS are solely for use with the PAS animal and are not to be used for or administered to any other animal. PAS has provided me with the following initial supplies for the PAS animal and must return after the animal is no longer in my

    2. Other Animals. I am not and will not house any animal for any other organization or person. The animals I reside with all belong to me or another member of my household. I shall not house any animal for any other organization or person while I am housing a PAS animal without prior written permission from PAS. I shall not intake, nor offer to intake, any animal on behalf of PAS without prior written permission from PAS. Male and female animals that have not been spayed or neutered shall be kept apart to prevent breeding. Incompatible animals and/or ill animals shall be housed separately. I will keep the PAS animal separated from my own pets. I will manage any interactions between the PAS animal and humans and other animals to ensure safety. I further understand and agree that should my owned animal(s) or any other animal(s)become ill or injured due to the co-mingling of animals in violation of this Agreement, any resulting veterinary or other expenses will be my sole responsibility.

    3.Veterinary care. I will only provide veterinary and other professional services as approved in advance by PAS, from professionals approved by PAS. I shall contact the PAS Health and Welfare co-chairs or Vet Committee Member for such permission and shall not contact any veterinarian or other professional service provider prior to obtaining such permission. Ishall not euthanize, spay, or neuter thePAS animal without PAS' written permission, or unless such action is necessary to prevent the unnecessary suffering of the PAS animal where there is no other reasonable remedy or relief. I shall not declaw, taildock, or ear crop the PAS animal. I shall transport the body of any deceased PAS animal as may be directed by PAS for possible necropsy.

    In the case of emergency where the PAS animal is in imminent danger, I will immediately transport the PAS animal to one of the below PAS-approved emergency medical facilities and identify myself as a PAS Foster. I shall make all reasonable efforts to contact PAS before transporting and/or authorizing treatment.

    If provide care without prior approval, or from professionals who were not previously approved, I will be solely responsible for any costs incurred, and shall be considered a voluntary gift to PAS. I am responsible for providing veterinary care at my own cost to the PAS animal when the need for such care is caused by my own negligence or other violation of this agreement. Whether or not the PAS animal's condition was caused by my own negligence or a violation of this agreement shall by determined by PAS in its sole discretion.

    Iwill notify the Health and Welfare co-chairs or Vet Committee Member when I will be bringing the PAS animal to PASfor any reason in advance (i.e. revaccinations, checkups, blood tests, or return for adoption If I cannot make my scheduled time, I will notify the Health and Welfare co-chairs or Vet Committee Member as soon as possible in order to reschedule for the next most convenient time.

    If cannot make a scheduled veterinary appointment for the PAS animal, will notify the Health and Welfare co-chairs or Vet Committee Member as soon as possible. I understand that if fail to provide reasonable notice, I will be responsible to pay any cancelation fees incurred by PAS.

    Iunderstand that situations may arise where PAS may make a euthanasia decision for the PAS animal that is in the best interest of the animal and the safety of the public. I understand the euthanasia decision is made solely by PAS and I agree to comply with the decision.

    4.Grooming. I will only provide professional grooming services to the PAS animal as approved in advance by PAS, from professionals approved by PAS. I shall contact the PAS Health and Welfare co-chairs or Vet Committee Member for such permission and shall not contact any professional service provider prior to obtaining such permission.

    5. Communication and Transport. I agree to maintain timely communication with PAS via my assigned Foster Mentor or other assigned PAS representative. Further, I agree to provide updates about thePAS animal, including descriptions, photographs, and videos for marketing purposes, to PAS. I agree to transport PAS animals to and from veterinary appointments, events, boarding, meet and greets, etc. in order to facilitate the animal's adoption and well-being at PAS' request. Tagree to promote the PAS animal by way of social media, flyers, business cards, and by taking the dog to public locations with an adoption vest as often as possible. I understand that will not be reimbursed for these costs by PAS.

    6.Rules. I will abide by all policies and procedures as adopted by PAS, and as they may change from time to time, and will abide by any instructions from PAS regarding any PAS animals.

    7. Ownership. The PAS animal remains the sole property of PAS at all times. I shall not sell, give, or otherwise transfer ownership or possession of the PAS animal to another party without prior written permission of PAS. If I move or change my contact information while a PAS animal is in my care, I shall immediately notify PAS of my new contact information.

    8.Inspection and return. At any time with reasonable prior notice, I shall permit PAS to inspect PAS animals, their veterinary records, and living conditions. I, at my own expense, shall promptly return any PAS animal to PAS at PAS' request within 24 hours. PAS shall have the right, but not the obligation, to enter my premises without further notice to retrieve the PAS animal, and such entry shall not be deemed a trespass. I shall be liable to PAS in the amount of fifty dollars ($50.00) in liquidated damages (not as a penalty) for each day fail to return an animal to PAS pursuant to this Agreement. The parties agree that actual damages for such breach would be difficult to determine, and that $50.00 per day is reasonable compensation for depriving PAS of possession of any animal.

    9.Risks. I am aware of and assume the many risks associated with being around animals. Although PAS may provide me with some information about the animal, PAS makes no claims, representations, warranties, or guarantees regarding the temperament, behavior, or health status of any animal. Therefore, I accept the PAS animal "AS IS" and "with all faults." On behalf of myself and my heirs, assigns, executors and administrators, I hold harmless and indemnify PAS, its officers, agents, volunteers and employees, from any and all losses, claims, actions or proceedings of every kind and character, including claims for negligence and for damages of any kind, including damage to property, personal injury, or death to me or to third

  • parties which may arise directly or indirectly from my presence at properties controlled by PAS, my handling or being in the vicinity of PAS animals, or my participation in PAS activities, including acting as a Foster. Since I am not an employee, I understand that there is no worker's compensation or insurance coverage for any injury, illness, loss, or damage arising out of my volunteer activities. PAS encourages all volunteers and fosters to maintain their own medical, property, and life insurance coverage while serving as a volunteer, as all costs for injury or loss are my personal responsibility.

    10.Termination. I understand that PAS may terminate my volunteer or foster activities at any time, with or without cause. Upon termination, or upon my voluntary resignation, I will immediately return all PAS animals, equipment, records, and other property owned by PAS to PAS within 24 hours.

    11.Public statements or contracts. I have no authority to make public statements on behalf of PAS, adopt out PAS animals, enter into contracts for PAS, or otherwise obligate PAS in any way. I shall not contact any PAS transfer partner (kennel, humane society, owner surrendering an animal, etc regarding the PAS animal without prior written permission from PAS.

    12. Criminal history. I certify that the information contained in my volunteer or foster application is true and further, that I or anyone in the home have never been charged with or convicted of any offense related to cruelty, abuse, neglect, or abandonment of animals, or any other violent or sexual criminal offense.

    13. Reimbursement policy. I will be only be entitled to reimbursement for out-of-pocket expenses when I have previous written permission from the PAS Board, and can provide receipts as proof of each expenditure. Otherwise, I will be personally responsible for any expenditure I make while volunteering or fostering for PAS. Anything I purchase and any service I arrange or provide for PAS shall be considered a donation to the organization.

    14. Publicity. I irrevocably grant permission to PAS to use any photograph, video, sound recording, or quote taken of or made by me relating to my volunteer or foster activities with PAS without compensation.

    15.Remedies. PAS may bring an action at law or in equity in a court of competent jurisdiction to enforce the terms of this Agreement, to enjoin the violation, ex parte as necessary, by temporary or permanent injunction, to recover any damages towhich it may be entitled for violation of the terms of this Agreement. PAS' rights under this paragraph apply equally in the event of either actual or threatened violations of the terms of this Agreement. I agree that PAS' remedies at law for any violation of the terms of this Agreement are inadequate and that PAS shall be entitled to the injunctive relief describedin this paragraph, both prohibitive and mandatory, in addition to such other relief to which PAS may be entitled, including specific performance, without the necessity of proving either actual damages or the inadequacy of otherwise available legal remedies. PAS' remedies described in this paragraph shall be cumulative and shall be in addition to all remedies now or hereafter existing at law or in equity. In the event of legal action arising from my failure to comply with this Agreement, I shall pay PAS' costs and attorney fees, whether incurred prior to or after legal action is filed.

    16.General provisions. This Agreement is the entire understanding between the parties. This Agreement may not be amended or modified without a writing signed by both parties. This Agreement shall be governed by Ohio law. Any action to enforce orinterpret this Agreement must be made in the appropriate court with jurisdiction over Parma, Cuyahoga County, Ohio. The failure of PAS to insist on the performance of any of the terms of this Agreement shall not waive or bar the future enforcement of any such terms.

    THE UNDERSIGNED HAS READ, UNDERSTANDS, AND VOLUNTARILY AGREES WITH THE ABOVE TERMS.
