• ILLINOIS HIGH SCHOOL ART EXHIBITION - Senior Scholarship Exhibition

  • GENERAL RELEASE AND HOLD HARMLESS AGREEMENT

  • The above-named Artist and, if the Artist is under the age of 18, his or her parent or legal guardian (hereinafter referred to individually as "I" or collectively as "we") desire that the Artist participate in various programs, events or activities in the 2022-2023 Illinois High School Art Exhibition on April 23, 2023 (hereinafter collectively referred to as the "Art Exhibition") operated or sponsored by the Illinois High School Art Exhibition, d/b/a "Art ConnectED," an Illinois not-for- profit corporation ("IHSAE"), and the East Bank Storage on 35th Street, Inc. d/b/a "Bridgeport Art Center", an Illinois corporation ("Center" The Art Exhibition includes, but is not limited to, the Senior Scholarship Exhibition, Northern Regional High School Art Exhibition, Central Regional High School Art Exhibiion, Art Throwdown, College and Careers Fair, Mini Portfolio Day, and the Early College Scholarship Program.

    I/We understand and acknowledge that IHSAE and the Center will not allow the Artist to participate in the Art Exhibition without releasing and holding IHSAE and the Center, their shareholders, directors and officers, and their employees, agents, and any parties volunteering on their behalf, harmless from any liability arising out of participation in the Art Exhibition. I/We have investigated the risk involved in the Artist's participation in the Art Exhibition and fully understand and assume such risks on my/our behalf. Specifically, I/we understand and acknowledge that the Artist may suffer or experience, among other things, personal injury or bodily damage, medical disabilities, loss or theft of personal property, abduction and even

    RELEASE OF LIABILITY: I/WE REQUEST THAT IHSAE AND THE CENTER ALLOW THE ARTIST TO PARTICIPATE IN THE ART EXHIBITION, AND IN CONSIDERATION THEREOF AGREE HEREBY TO RELEASE AND FOREVER DISCHARGE IHSAE AND THE CENTER, THEIR SHAREHOLDERS, OFFICERS AND DIRECTORS, AND THEIR EMPLOYEES, AGENTS, AND ANY PARTIES VOLUNTEERING ON THEIR BEHALF, FROM ALL ACTIONS, CAUSES OF ACTION, INJURIES, CLAIMS, DAMAGES, COSTS OR EXPENSES OF ANY KIND, GROWING OUT OF OR RELATED TO THE ART EXHIBITION. I/WE UNDERSTAND THAT THIS IS A FULL AND COMPLETE RELEASE OF ALL INJURIES AND DAMAGES WHICH WE OR THE ARTIST MAY SUSTAIN AS A RESULT OF HIS/HER PARTICIPATION IN THE ART EXHIBITION, REGARDLESS OF THE SPECIFIC CAUSE THEREOF. NEITHER IHSAE NOR THE CENTER SHALL BE LIABLE FOR ANY DAMAGE TO OR LOSS OF THE ARTIST'S WORK, EQUIPMENT OR OTHER PERSONAL PROPERTY ARISING OUT OF THE ART EXHIBITION, THE MOUNTING AND/OR ANY OTHER ACTIVITIES INVOLVED IN THE PREPARATION AND/OR PRESENTATION OF THE ART EXHIBITION. I/WE AGREE TO ASSUME ALL RISK OF DAMAGE OR LOSS OF THE ARTIST'S OWN ARTWORK FROM WHATEVER CAUSE.

  • Indemnification: I/We shall indemnify, save and hold harmless IHSAE and the Center, their shareholders directors, officers, employees, volunteers and agents from any and all claims, demands, causes of action and judgments, losses, costs and expenses, including but not limited to reasonable attorney's fees, arising due to the negligence of the Artist, including but not limited to any representation, warranty, term and/or condition of this Agreement. Statement of Ownership: I/We hereby represent and warrant to IHSAE and the Center that the Artist is the sole creator and owner of the artwork to be exhibited in the Art Exhibition.

    Artwork Release: I/We grant our full permission for IHSAE to reproduce the Artist's name, information describing his/her artwork, representations of his/her artwork and any other information he/she has provided for the purpose of display, promotion and publicity in print and digital form either now or in the future. The release stated in this section is valid for an unlimited time period. I/We acknowledge and agree that IHSAE is not required to pay any compensation or remuneration of any kind for the use of the Artist's name, artwork and any other information that he/she has provided to IHSAE.

  • Handling of Artwork: I/We agree to display, pack, and transport and provide for the return of the Artist's artwork, unless other prior arrangements have been made with IHSAE or the Center. If I/we are not available on-site to display, re-pack or re-transport the Artist's artwork, I/we give permission to IHSAE and the Center to do so on my/our behalf at my/our own risk and expense. Works left more than 14 days after the Art Exhibition closes become the property of IHSAE.

    Recording Consent and Release: By participating in the Art Exhibition, I/We consent to be photographed, filmed and/or otherwise recorded. I/We acknowledge and agree that my/our presence constitutes my/our consent to such photography, filming and/or recording and my/our consent to allow photographs, videos or recordings of my/our name(s), image(s) and voice(s) to be used in perpetuity by IHSAE for non-profit use and without charge to display at an event, use in a multimedia presentation, reprint and distribute in any IHSAE non-profit publication with IHSAE copyright to accompany photos when used (for example, in newsletters, brochures, etc, and display or use quotes and video clips on the IHSAE Web site and blog. I/We release IHSAE from all liability on account of such usage.

    Medical Treatment Authorization and Power of Attorney: In the event the Artist suffers any injury or condition during his/her participation in the Art Exhibition, including transportation to and from the Art Exhibition, which may endanger his/her life, cause disfigurement, physical impairment, or undue discomfort if medical treatment is delayed, and reasonable attempts to contact his/her parent or legal guardian (or such person's spouse) or other immediate family member have been unsuccessful, the Artist (if 18 years of age or older) or his/her parent or legal guardian (if the Artist is under 18 years of age) hereby appoints IHSAE staff as his/her agent ("Agent") to act for the Artist or the undersigned parent or legal guardian as applicable and in his/her name (in any way he/she could act in person) to make any and all decisions for the Artist concerning his/her personal care, medical treatment, hospitalization and health care. This power of attorney and delegation of authority shall terminate when the Agent is first able to contact the undersigned parent or legal guardian (or his/her spouse) or another member of the Artist's immediate family.

    Insurance: I/We shall be solely and exclusively responsible to insure properly and adequately the Artist's artwork and property.

    Assignment: Neither party shall assign or transfer any of its rights or obligations under this Agreement and any attempt to do so shall be void and of no effect.

    Waiver and Effective Nullity: Waiver by either party of any provision of this Agreement shall not operate or be construed as a waiver of any provision by such party at any time hereafter. The nullity of any provision hereunder shall not affect the validity or enforceability of the remaining provisions hereunder of the Agreement, which shall survive.

    Governing Law: The validity, construction and enforcement of, and the remedies under, this Agreement shall be governed by and interpreted and enforced in accordance with the laws of the state of Illinois, without giving effect to any choice of law or conflict of laws rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Illinois

    This Agreement is binding on our heirs, successors and personal representatives.
