Handling of Artwork: I/We agree to display, pack, and transport and provide for the return of the Artist's artwork, unless other prior arrangements have been made with IHSAE or the Center. If I/we are not available on-site to display, re-pack or re-transport the Artist's artwork, I/we give permission to IHSAE and the Center to do so on my/our behalf at my/our own risk and expense. Works left more than 14 days after the Art Exhibition closes become the property of IHSAE.
Recording Consent and Release: By participating in the Art Exhibition, I/We consent to be photographed, filmed and/or otherwise recorded. I/We acknowledge and agree that my/our presence constitutes my/our consent to such photography, filming and/or recording and my/our consent to allow photographs, videos or recordings of my/our name(s), image(s) and voice(s) to be used in perpetuity by IHSAE for non-profit use and without charge to display at an event, use in a multimedia presentation, reprint and distribute in any IHSAE non-profit publication with IHSAE copyright to accompany photos when used (for example, in newsletters, brochures, etc, and display or use quotes and video clips on the IHSAE Web site and blog. I/We release IHSAE from all liability on account of such usage.
Medical Treatment Authorization and Power of Attorney: In the event the Artist suffers any injury or condition during his/her participation in the Art Exhibition, including transportation to and from the Art Exhibition, which may endanger his/her life, cause disfigurement, physical impairment, or undue discomfort if medical treatment is delayed, and reasonable attempts to contact his/her parent or legal guardian (or such person's spouse) or other immediate family member have been unsuccessful, the Artist (if 18 years of age or older) or his/her parent or legal guardian (if the Artist is under 18 years of age) hereby appoints IHSAE staff as his/her agent ("Agent") to act for the Artist or the undersigned parent or legal guardian as applicable and in his/her name (in any way he/she could act in person) to make any and all decisions for the Artist concerning his/her personal care, medical treatment, hospitalization and health care. This power of attorney and delegation of authority shall terminate when the Agent is first able to contact the undersigned parent or legal guardian (or his/her spouse) or another member of the Artist's immediate family.
Insurance: I/We shall be solely and exclusively responsible to insure properly and adequately the Artist's artwork and property.
Assignment: Neither party shall assign or transfer any of its rights or obligations under this Agreement and any attempt to do so shall be void and of no effect.
Waiver and Effective Nullity: Waiver by either party of any provision of this Agreement shall not operate or be construed as a waiver of any provision by such party at any time hereafter. The nullity of any provision hereunder shall not affect the validity or enforceability of the remaining provisions hereunder of the Agreement, which shall survive.
Governing Law: The validity, construction and enforcement of, and the remedies under, this Agreement shall be governed by and interpreted and enforced in accordance with the laws of the state of Illinois, without giving effect to any choice of law or conflict of laws rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Illinois
This Agreement is binding on our heirs, successors and personal representatives.
