We may vary this Agreement at any time by giving you at least (7) seven days’ written notice to your last known email or residential address.All appointments for personal training will be scheduled directly between you and the Provider on the Provider’s booking system located at https://calendly.com/battlefitcoaching. By requesting a Direct Debit arrangement, you consent and acknowledge that you are authorised to give Direct Debit instructions on the nominated account.The payment will be deducted from your nominated account at the time you make the booking for the relevant session. If you make the appointment on a non-working day or public holiday, the payment will be processed on the next working day. It is your responsibility to ensure that you have sufficient funds in the nominated account when payments are to be drawn. If you do not have sufficient funds, the transaction will be rejected, and an administration fee may be charged to your account. We treat the payment as if it was never made.You should confirm your nominated account details are correct before submitting this Direct Debit request by checking them against a recent account statement. Be aware Direct Debiting through Bulk Electronic Clearing System is not available on all accounts. If in doubt, contact your financial institution.It is your responsibility to advise the Provider if your nominated account is altered, transferred or closed.Pursuant to the Privacy Act 1988, your records account details and other information will be kept private and confidential and will only be disclosed pursuant to the terms of this Agreement and at your request or at the request of the Financial Institution in connection with a claim made to an alleged incorrect or wrongful debit, or otherwise as required by law.Cancellation policyCancelation of a subscribed service can only be made after the given minimum term. Clients who wish to cancel within the minimum term must pay out the remaining fees of their subscription. After minimum term is complete, clients must give written notice via email as soon as possible. Only once notice has been confirmed does the 14day cancellation period begin and must be paid.If you have to cancel or reschedule any booked sessions, you must give the Provider written notice email as soon as possible. If cancellation of booking is within 24 hours of scheduled time, the booking cannot be rescheduled and counts towards paid sessions. If booking is outside 24 hours prior scheduled time, it does not count towards paid sessions and can be rescheduled at a later date.If you fail to appear for a booked session, it will be taken to have been cancelled and you will not be refunded for that session.If client is away and unable to book in their subscribed sessions, they have 30 days to schedule in desired booking times. After 30 days the sessions become expired and unable to be claimed.Health and liabilityYou warrant that you have consulted appropriate medical specialists with regards to risks of engaging in the booked session and confirm that you have no undisclosed pre-existing or limiting physical conditions or disabilities that would preclude you from participating in an exercise program or affect your ability to undertake rigorous physical exercise. You agree to inform the Provider by written notice of any relevant injury or illness and obtain a medical clearance from a medical specialist prior to booking any personal training session upon request by the Provider. If you are unsure at any time of any matters related to potential or pre-existing injury or illness with respect to any exercise or session, you agree to discuss them directly with the Provider beforehand.You acknowledge and accept that participating in exercise has inherent risks, including minor or major injury and accept full responsibility for your own health and well-being. You indemnify and continue to indemnify the Provider from any losses, damages, claims and or injuries arising from and or related to the sessions undertaken with the Provider.You acknowledge that the Provider provides services wholly in reliance of the warranties and acknowledgement provided by you.
Media Consent – images, photo and video BattleFit Coaching ABN 86 744 974 470 I/We acknowledge that the session I/we have booked with the Provider will be recorded for marketing and promotional purposes.By making the booking in the form prescribed in this Agreement, I/we give the Provider, the irrevocable right to use my name/photograph/image/audio recording/video recording and likeness in all forms and manner (“My Image”) for the purposes of advertising, media publicity, publication, general display, social media, promotional activities or for any other marketing or promotional purposes in whole or in part, including but not limited to publication on internet web sites, broadcasts and any other publications as released to or by the Provider and or its related entity (“Publication”).I/we expressly and irrevocably waive any interest, right or claim that I/we may have in the copyright to My Image now or at any future time and acknowledge that I/we am/are not entitled, nor shall in the future be entitled, to receive any payment or consideration in respect of it and agree to make no claim against the Provider for any payments for the Publication of My Image or request the removal from any Publication made by the Provider. I/we understand and acknowledge that the Provider cannot control unauthorised use of My Image by persons not associated with the Provider upon the Publication of My Image. I/we irrevocably and expressly forever waive any right to inspect or approve any Publication of My Image by the Provider and release, indemnify and keep indemnified the Provider from any loss, damage, costs, expense, or claim (including consequential loss) connected with the Publication of My Image, including action for defamation, libellous material, breach of privacy or copyright.If you have any questions, you may contact the Provider at admin@battlefitcoaching.com.au.
