TERMS AND CONDITIONS OF TRADING WITH DOGMASTER TRAINERS AU
A. Approved applicant will go onto a probationary pay up front account for the first 3 months which will be reviewed after an account history is attained. Thereafter, the applicant will have the opportunity to apply for a 30 day credit account.
B. Goods are sold ‘ex store’ and a delivery charge will be added to each invoice to cover freight costs.
C. All goods returned for credit shall be packed in their original containers and if soiled or damaged may be rejected or credited at a reduced rate at the sole discretion of DOGMASTER TRAINERS AU. No claim for credit on returned goods will be recognised unless made within seven (7) days of delivery and in every case the original invoice number and date must be quoted.
D. The Purchaser/s (Applicant) acknowledge that the title to the goods supplied in the order/s placed by the Purchaser/s (or any agent of the Purchaser/s or any person in the employ of the Purchaser/s acting on behalf of the Purchaser/s) with Dogmaster Trainers will not pass to the Purchaser/s until these goods have been paid in full and that until such time title and right to repossess the goods will rest with DOGMASTER TRAINERS AU who shall be entitled to retake possession of the goods. Goods remain the legal property of DOGMASTER TRAINERS AU until paid in full. Prices are subject to change without notice.
E. Goods are supplied at the sole risk of the Applicant from the time that the Applicant takes possession of them or they leave DOGMASTER TRAINERS AU’s premises whichever is earlier.
F. The Applicant agrees to inform DOGMASTER TRAINERS AU if any change of address and/or owners of the Applicant together with any information which may affect the decision of DOGMASTER TRAINERS AU to grant credit to the Applicant.
H. DOGMASTER TRAINERS AU may, if it advances credit to the Applicant, withdraw that credit at anytime for any reason whatsoever, in consideration of DOGMASTER TRAINERS AU agreeing to grant credit facilities to the Applicant if the Applicant is a company with the undersigned Directors of the Applicant, the Directors do hereby jointly and severally guarantee payment of the Applicant’s account and agree to indemnify DOGMASTER TRAINERS AU to the extent of, all monies now and hereinafter owed by the Applicant to DOGMASTER TRAINERS AU and agree to be bound by the terms and conditions contained on this application form and that DOGMASTER TRAINERS AU may at all times act as if it were the principal debtor. In the event of all Directors of the Applicant not signing the credit application, we the signatories of the credit application will accept full liability under this guarantee and agree if requested to execute DOGMASTER TRAINERS AU’s standard form of guarantee. A credit application is signed as a Deed.
I. The Applicant, in the event of default, agrees that DOGMASTER TRAINERS AU may commence Court Proceedings against the Applicant in any Australian Court and submits to the jurisdiction of that Court or to a debt collection agency.
J. DOGMASTER TRAINERS AU may retake possession of any goods or associated charges, not paid in full, by entering the Purchaser’s premises or vehicle/s without liability for trespass or any resulting damage. This includes those premises or vehicle/s of an associated company or agent where the goods are stored or displayed and we believe there are reasonable grounds that we may find goods in whole or in part, within. DOGMASTER TRAINERS AU may keep or re-sell these repossessed goods at our discretion. If the Purchaser has sold all goods and does not present payment on request of DOGMASTER TRAINERS AU, we will take action against the Purchaser.
K. Goods may be supplied in cartons. The Applicant shall check how many items there are per carton. The Company may supply sufficient whole cartons to satisfy the Applicant’s order. The Applicant agrees to accept all products so delivered.
The information collected on this form will be used for the purpose of opening a trading account with DOGMASTER TRAINERS AU. We may also use the information to contact you from time to time on special offers that may interest you. DOGMASTER TRAINERS AU is committed to ensuring the confidentiality and privacy of personal information it receives. When you provide your personal information to our company, we may store your personal information as consequence of the purpose for which you supplied it. We will not use or disclose any personal information for any purpose which it is not related to the products or services we provide to you, or for any purpose for which you would reasonably expect us to use the information. We may preserve the content of any information that you send us, for the purpose of storing the information, maintaining contact or if we believe that we have a legal requirement to so do. If you would like to access, update the personal information you have provided us, you may do so by notifying us in writing.
PLEASE NOTE: To qualify for Dealer, purchases must be a minimum of $500 per month (Dogmaster Trainers) which to be reviewed in every three month period. We have the right to terminate your wholesale account without notice.
