  • I      (“Buyer/Owner”) understand that the following is an agreement between myself and Chase & Lydia Washburn (“Seller”) of The Recreational Homestead.

  • HERD SHARE & PAYMENT:

    1. The Buyer/Owner is responsible for an annual lease fee of $50 towards his/her share of a cow. The cost must be paid in full at the time of signing this agreement. If the Buyer/Owner is faced with the decision to terminate the contract before the full year is complete then they forfeit the lease fee in full. In the unlikely event that the Seller is faced with the decision of ending the herd share and needs to terminate the contract before the full year is complete, the Buyer/Owner will receive 50% reimbursement of their lease fee. In either scenario of the contract being terminated, the Seller will maintain possession of the animal. 
    2. One share is defined as one-twentieth ownership of a dairy cow. The Buyer/Owner will pay the Seller $7 per week per one share for the care and boarding of his/her share of the herd. If your weekly payment is not provided to us in full the day prior to your designated pickup day then it is considered default and will result in forfeiture of all money invested in the herd share.
    3. The one year lease agreement is valid for one full year as of the date of the signing of this contract. The Buyer/Owner is responsible to pay all fees within the contractual year. See above in cases of contract termination. 
  • BOARDING & CARE OF ANIMALS:

    1. The Seller agrees to provide care and boarding of the Buyer/Owners share of the herd. Care and boarding include: providing appropriate feed, water, living conditions, milking and routine health care. The Seller will inspect the herd regularly for signs of ill health. If veterinary care is deemed necessary for an individual animal or for the herd, the Seller is responsible for contacting a veterinarian to provide adequate care. The Buyer/Owner will not incur any additional costs for veterinary care.
    2. The Seller covenants that it uses no rBST, hormones or prophylactic antibiotics in the raising of the Buyer/Owners animals. 
    3. The Seller will regularly breed cows in order to ensure that the cows continue to produce milk. The Seller will absorb costs associated with insemination, pre-birth, and veterinary fees. 
    4. In the unlikely event that the Seller cannot supply the Buyer/Owner with milk because the herd members are "dry", the Buyer/Owner will not be charged the weekly share fee. In this scenario the annual lease fee will hold the Buyer/Owners place. The weekly share fee will resume once the herd members calve and milk production resumes. 
  • USE & LIABILITY:

    1. The Buyer/Owner agrees that they are leasing a member of the herd for the sole purpose of obtaining fresh milk. The Buyer/Owner does not assume any rights to the herd member's calf, and cannot take the herd member off of the Seller's property.
    2. The Buyer/Owner consents to take full responsibility for the product that they are obtaining from the Seller. The Buyer/Owner knows and understands the risks involved in consuming fresh, unprocessed whole milk and hereby agrees to hold the Seller harmless for any injury or illness caused by or thought to be caused by consuming fresh, unprocessed whole milk. 
    3. The Buyer/Owner agrees that they will educate themselves and/or their family with the risks associated with consuming fresh, unprocessed whole milk therefore releasing the Seller from any responsibility of education of the Buyer/Owner and/or the Buyer/Owner's family.
  • PICK-UP OF MILK:

    1. The parties agree that because milk is a perishable product, should the Buyer/Owner fail to retrieve his/her stored milk from the Seller on a weekly basis the Seller may, without notice to the Buyer/Owner, dispose of the stored milk in any way the Seller sees fit. Milk is not transferable to alternate dates. If the Buyer/Owner is unable to complete a pick up of milk then that week's milk is forfeited.
    2. The Seller reserves the right to two weeks vacation per year. The Seller agrees to provide two weeks notice for these vacations.
    3. The Buyer/Owner is responsible to thoroughly clean jars of fluid milk before returning to the Seller. The Seller will sanitize jars before filling. Failure to return jars or returning jars that are not properly cleaned will result in a fee of $5 per incident.
