WEATHER RELATED ISSUES:
J&C SOFT PLAY INC. does not issue refunds or rain checks for any reason, including inclement weather. Our kind suggestion is to please check the weather forecast prior to your event and to have a Plan B if necessary. Should bad weather or wind become an issue, J&C SOFT PLAY INC. reserves the right to refuse or release such items. In the event of unexpected bad weather after set-up, J&C SOFT PLAY INC. reserves the right to pick-up early. The equipment must be covered or moved immediately to prevent damage. If any of the equipment is rained on, the security deposit will be forfeited and used as a cleaning fee.
If J&C SOFT PLAY INC. arrives for a delivery and the weather is bad or impending, we will call you or a contact person to discuss options. Please always provide an additional contact name and number should you be unavailable on the day of your event.
It is the responsibility of the client to have a suitable site ready for the soft play equipment. The area must be flat, well-drained, clear from glass, and clean of debris. We can not set up on dirt or gravel. We also kindly ask to clear the area from any pet feces. Ocala Soft Play & More LLC shall not be held responsible for any grass damage. During high temperatures, all equipment must be in a shaded area or under a tent to prevent overheating of equipment.
ORDERS AND CHANGES: All order/service changes must be emailed to avoid any confusion. A detailed invoice will be submitted following any changes to your order by email. Additional services require an appropriate deposit and will be due at the time of requested change(s Emails are considered legal and binding and do not require a signature to be valid. If changes are made the day of the event, a responsible party must pay any difference with cash, or the credit card will be billed automatically. Changes are based on availability of equipment or services.
CANCELLATIONS: Please be aware that once the contract is signed, and your event date scheduled, all other clients have been refused your specific rentals and services for your event date, and thus the 50% deposit is non-refundable and all other payments are non-refundable within 3 days of your event.
Should you need to postpone/reschedule due to an unforeseen circumstance within 3 days of your event, J&C SOFT PLAY INC. will hold the full amount paid as a credit for up to 6 months After 6 months, your credit will be forfeited.
You would not be obligated to pay the balance of your invoice unless you placed a custom order which was designed specifically for your event. In such cases, you would be contractually bound to pay the balance due on the account in the event of cancellation.
DAMAGE WAIVER: The renter is responsible for any loss or damage to the Equipment and for their return in the same condition in which they were received, except for ordinary wear and tear. To ensure that our equipment is received in the same manner it was delivered, J&C SOFT PLAY INC. requires a refundable security deposit. $100 for indoor events and $150 for outdoor events. A refund of the security deposit will only be granted to those that meet the terms of this policy.
RELEASE: In consideration of the services and or property provided, I, for myself and any minor children for which I am the parent, legal guardian, or otherwise responsible, any heirs, personal representatives, or assigns, do hereby release J&C SOFT PLAY INC., its principals, directors; officers, agents, employees and volunteers from any liability and waive any claim for damages arising from any cause whatsoever (except that which is gross negligence). I further agree to reimburse you for all attorney's fees and legal costs should I bring legal action against you and lose.
