WAIVER

In consideration of being permitted to participate in paintball and/or airsoft activities and to use related equipment and facilities provided by Paintball Planet, PsychoPath, Sleeping Bear Retreat, and Watson & Watson LLC (collectively referred to as the “Released Parties”), I, the undersigned, on behalf of myself, my heirs, personal representatives, executors, administrators, and assigns, hereby agree to the following:1. Acknowledgment of RisksI acknowledge, understand, and agree that participation in paintball and airsoft activities involves inherent and significant risks, including but not limited to:Bodily injury, including bruises, lacerations, strains, fractures, and eye injuries;Serious injury, including paralysis, blindness, heat-related illness, heart attack;Illness or disease;Property damage;Death.I further acknowledge that such risks may arise from foreseeable or unforeseeable causes, including but not limited to the use or misuse of equipment, the actions or omissions of other participants, and environmental conditions.2. Assumption of RiskI voluntarily and knowingly assume all risks associated with participation in paintball and/or airsoft activities and the use of related equipment, whether such risks are known or unknown, inherent or otherwise.3. Release and Waiver of LiabilityTo the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise.4. Indemnification and Hold HarmlessI agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to my participation in these activities or my use of equipment, including claims brought by third parties.5. Negligence ClauseI expressly acknowledge and agree that this Waiver and Release is intended to be as broad and inclusive as permitted by applicable law and includes, without limitation, any claims arising from the negligence of the Released Parties.6. Binding EffectI agree that this Agreement shall be binding upon me and my heirs, assigns, personal representatives, and next of kin.7. SeverabilityIf any portion of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.8. Governing LawThis Agreement shall be governed by and construed in accordance with the laws of the State of Indiana.9. Acknowledgment of UnderstandingI have read this Waiver and Release of Liability, fully understand its terms, understand that I am giving up substantial rights (including the right to sue), and acknowledge that I am signing this agreement freely and voluntarily without any inducement.
