Disciplinary
The agreement can be terminated by the agency with immediate effect for gross misconduct by the member following an investigation if the member is deemed to have broken the terms of the agreement and rules of operation. The agreement can also be suspended until pending investigation, or until further notice, or terminated with immediate effect should you misuse the terms of the online portal I.e providing access to unauthorised personnel. Your agreement can also be terminated with immediate effect if after an investigation has concluded you have deemed to plagiarize, or share the contents of the E-Book without authorization.
Should any of these occur, you will be in breach of your agreement, your access will be disabled, your agreement terminated and you will be locked out of the E-Book indefinitely.
Exit strategies
Should the member wish to end this agreement any time prior to end of the agreement they must do so in writing. This option means the agreement ends with immediate effect after the 28 days and the member will no longer be entitled to receive the benefits of this agreement.
Relationship between both parties
Member relationship with the agency will be that of an independent contractor and nothing in this agreement is intended to or should be constructed to create a partnership, agency or employment relationship. The member will not be entitled under this agreement to any of the benefits that the agency may make available to its employees, including but not limited to liability insurance, profit-sharing, retirement benefits, paid vacation, holidays or sick leave or workers compensation insurance.
Ownership of property and materials
Member acknowledges and agrees that any and all documents produced by the member, including but not limited to memoranda, research notes, correspondence, emails, pleadings, and reports during the course of their work for the agency, shall be the sole property of the agency and the member shall retain no ownership, interests or rights therein.
